Professors Haar and Wolf reiterate their endorsement of Progressive jurisprudence, as embodied in the Supreme Court's opinion in Village of Euclid v. Ambler Realty Co., despite Professor Eric Claeys's effort to expose the political theory underlying Progressive legal thought. They highlight problems with Professor Claeys's portrayal of the actual practice of zoning and with his use of history, problems that seriously undercut Professor Claeys's findings regarding the political beliefs of early zoning and planning advocates, the evolution of zoning law in the courts, and the role natural law played in American legal history.

Plant Pigment Types, Distributions, And Influences On Shallow Water Submerged Aquatic Vegetation Mapping, Carlton R. Hall, Charles R. Bostater Jr., Robert Virnstein

Development of robust protocols for use in mapping shallow water habitats using hyperspectral imagery requires knowledge of absorbing and scattering features present in the environment. These include, but are not limited to, water quality parameters, phytoplankton concentrations and species, submerged aquatic vegetation (SAV) species and densities, epiphytic growth on SAV, benthic microalgae and substrate reflectance characteristics. In the Indian River Lagoon, Fl. USA we conceptualize the system as having three possible basic layers, water column and SAV bed above the bottom. Each layer is occupied by plants with their associated light absorbing pigments that occur in varying proportions and concentrations. …

Epa Oversight In Determining Best Available Control Technology: The Supreme Court Determines The Proper Scope Of Enforcement, Jennifer A. Davis Foster

In Alaska Department of Environmental Conservation v. EPA, the Supreme Court addressed the issue of whether the EPA was authorized to bar construction of a new major emitting facility where it found the state permitting authority’s best available control technology (BACT) determination unreasonable. The Court held that, given the legislative history and plain language of the enforcement provisions contained in the Clean Air Act, the EPA reasonably believes that the state permitting authority has acted arbitrarily in determining BACT. McDonagh, the Supreme Court of Missouri clarified the standard of admissibility for expert testimony in civil cases and administrative proceedings. This Note will examine the different standards that Missouri courts have applied and explore how the new McDonagh standard will impact Missouri courts.

One doubts that Robert Carter, Thurgood Marshall, Spottswood Robinson, Jack Greenberg and the rest of the legal team that argued Brown v. Board of Education spent much time thinking about mass torts. Nonetheless, it is entirely appropriate that a commemoration of their achievements include not only that topic but also international human rights and health care, as well as the more expected ones of education and social welfare. Brown was part of a revolution, and revolutions often have collateral effects as important as their immediate consequences. The civil rights movement followed the same pattern.

The human immunodeficiency virus HIV type 1 has evolved as one of the most important global infectious pathogens. Although the virus had initially emerged among certain high risk groups in developed countries, it quickly gained momentum in developing countries threatening most population groups. The first case of acquired immunodeficiency syndrome from the Kingdom of Saudi Arabia was diagnosed in 1984. Twenty years later, by the end of 2003, 1509 patients have been reported to have acquired HIV 1. The majority of the early infected patients have acquired HIV 1 from blood product transfusion. OBJECTIVE: The purpose of this study was to investigate the knowledge and practice of breast self-examination (BSE) among Saudi female nursing college students in Riyadh, Kingdom of Saudi Arabia (KSA). METHODS: A cross-sectional study was conducted between October and December 2003. Saudi female nursing students (149) from the College of Applied Medical Sciences, King Saud University, and from the College of Nursing, King Abdulaziz Medical City, National Guard, Riyadh, KSA, constituted the study population. OBJECTIVE: To identify the risk factors for brucellosis in Palestine, to estimate their association with the disease and to recommend appropriate prevention measures. METHODS: An unmatched case-control study was conducted in the West Bank of Palestine. A total of 450 subjects (150 cases and 300 controls) chosen from all districts were investigated. Data were collected during the year 2000. Subjects were interviewed using a standard questionnaire acquiring demographic and risk factor information. OBJECTIVE: Impacts of air pollution on the human health have been recognized over the last decades. Smokes, in particular, have deleterious effects on the respiratory system. According to a local tradition, incense "Bakhour" is burnt and the resultant heavy smokes are inhaled. The objective of the present study is to investigate the ultrastructural pulmonary changes which can be induced by Arabian incense, Bakhour, exposure. Investigation Of The Transmission Of Mycobacterium Bovis From Deer To Cattle Through Indirect Contact, Mitchell V. Palmer, W. Ray Waters, Diana L. Whipple

Objective—To investigate the infection of calves with Mycobacterium bovis through oral exposure and transmission of M bovis from experimentally infected white-tailed deer to uninfected cattle through indirect contact.
Animals—24 11-month-old, white-tailed deer and 28 6-month-old, crossbred calves.
Procedure—In the oral exposure experiment, doses of 4.3 X 106 CFUs (high dose) or 5 X 103 CFUs (low dose) of M bovis were each administered orally to 4 calves; as positive controls, 2 calves received M bovis (1.7 X 105 CFUs) via tonsillar instillation. Calves were euthanatized and examined 133 days after exposure. Deer-to-cattle transmission was …

Aging In Place At Harbor Point: Outreach Follow-Up Of Older Adults Living In Independent Mixed-Income Apartments, Judith M. Conahan, Nina M. Silverstein, Kelly Fitzgerald

Most older people, despite functional impairments, plan to stay in their homes and/or communities as long as possible. According to an AARP survey, 82% of adults 65+ reported that they believe that they are “very likely” or “somewhat likely” to stay in their current homes or apartments for the rest of their lives. With increasing age, housing and community characteristics and services gain importance in meeting the challenges of “aging in place.” Staying in their homes maximizes elder’s independence, sustains their social connections, and reaffirms their identity and value.

Multivariate And Multistrata Nonparametric Tests: The Nonparametric Combination Method, Livio Corain, Luigi Salmaso
Journal of Modern Applied Statistical Methods
Researchers and practitioners in many scientific disciplines and industrial fields are often faced with complex problems when dealing with comparisons between two or more groups using classical parametric methods. The data arising from real problems rarely are in agreement with stringent parametric assumptions. The NonParametric Combination (NPC) methodology frees the researcher from stringent assumptions of parametric methods and allows a more flexible analysis, both in terms of specification of multivariate hypotheses and in terms of the nature of the variables involved in the analysis. An outline of NPC methodology is given, along with case studies.

With departments of human resource (HR) struggling over the past ten years to establish an equal strategic role with operating managers and other functional specialties, there is ongoing debate regarding the strategic alignment and practical impact of human resource management (HRM) practices. Reforming Reprehensibility: The Continued Viability Of Multiple Punitive Damages After State Farm V. Campbell, Rachel M. Janutis
San Diego Law Review
In this Article, the author discusses how the Supreme Court's recent decision in State Farm v. Campbell reformed the reprehensibility analysis and how this reformation may have the perhaps unintended consequence of eliminating the practice of awarding total harm damages. In particular, in an effort to limit the size of individual punitive damage awards, Campbell limits the use of evidence of conduct directed at parties not before the court.
