Facilitating Prior Informed Consent Context Of Genetic Resources And Traditional Knowledge, Anne Perrault

Sustainable Development Law & Policy

This paper traces the evolution of free prior informed consent (“FPIC”) and describes the importance of FPIC to achieving the objectives of the Convention on Biological Diversity (“CBD”). It briefly highlights elements of current approaches to obtaining FPIC from national governments and local communities, identifies limitations to obtaining FPIC, and provides examples of how the Bonn Guidelines do and do not respond to these limitations. The paper does not provide a detailed analysis of all issues related to implementation of FPIC, but rather highlights issues that will, hopefully, promote constructive discussions to advance progress on the implementation of FPIC.

Medicinal plants constitute an effective source of traditional and modern medicines. The plant is a biosynthetic laboratory, not only for chemical compounds but also a multitude of the compounds. The present research work was confined to study the macro, microscopic features and analysis of powdered drug of Acacia modesta Wall., Acacia nilotica (L.) Delile, Berberis lycium Royle and Zanthoxylum alatum D. C. Prod. These studies were carried out in Botany laboratory of University of Arid Agriculture, Rawalpindi during 2004. This study represents first comprehensive ethnobotanical survey in Palas valley, Pakistan and is also an attempt to sum up the preexisting ethnobotanical information. A total of 139 ethnobotanically important plant species are being reported from the study area belonging to a total of 72 plant families. The most important families in this regard were Rosaceae (20 species), Asteraceae (9 species), Lamiaceae and Polygonaceae (5 species each). Herbs (59 species) were found to be the most used life forms followed by trees (40 species), shrubs (36 species) and Climbers (4 species) in descending order. Plant Tissue Extraction Method For Complexed And Free Cyanide, Joseph T. Bushey, Stephen D. Ebbs, David A. Dzombak

A method for free cyanide and strongly-complexed cyanide measurement within plant tissue was developed to study uptake and movement of cyanide species separately from cyanide metabolism and metabolite movement by a willow plant (Salix eriocephala var. Michaux). Spike recoveries from solutions with and without plant tissue, using various solvent combinations, and background control tissue contributions were investigated to obtain an accurate and precise extraction method for measurement of complexed and free cyanide concentrations within plant tissue. The optimum extraction technique involved the freezing of plant tissue with liquid nitrogen to facilitate homogenization prior to extraction. Homogenized willow tissue samples, 1 …

After September 11, 2001, the U.S. Congress and President initiated legal changes to combat terrorism. In the late 20th century, Europe also experienced terrorist attacks on its soil and initiated legal adaptations. Europe's legal history with terrorism shows that harsh procedure-stripping rules do not stop terrorism and come at great costs in civil liberties and legal clout. More procedural safeguards would bring the U.S. legal response back in line with its traditional legal values while still providing a way to fight terrorism. Advocates of free trade extol the virtues of trade without borders, while opponents decry its abysmal consequences. While debates about the benefits and detriments of free trade seem never-ending, there has been comparatively little discussion of the actual impact of international trade obligations on sub-national components of federal governments. Although the relationship between America's trade treaties and the policies of state governments has become a more visible issue in international trade, relatively little is known about how these international trade obligations really shape state law-making among the fifty U.S. states. Dawn Raids Here At Home - The Danger Of Vanishing Privacy Expectations For Corporate Employees, Sarah Plotkin Paul

This article posits that, due to the limited and diminishing privacy protections for corporate employees, Fourth Amendment jurisprudence is closer to permitting dawn raids in the workplace than popular opinion might suggest. First, the employee "standing" requirement to challenge an illegal search means employees must have a privacy interest in the particular workspace searched. In certain instances, then, individual employees have no way of protesting the use of illegally obtained corporate documents against them, including documents they have authored. In 1923, the Treaty of Lausanne ended the Greek-Turkish war of 1919-1922 and established two distinct minorities in both Greece and Turkey after a convention signed at the same time provided for the compulsory exchanges of populations; about a million and a half Greeks left Turkey for Greece, and about a half-million Turks left Greece for Turkey.' This important volume attempts to evaluate and measure the impact of equal opportunities in the National Health Service and in part, on higher education (4) (i.e. the progress of ethnic minorities through their respective career hierarchies). The major dynamics at work are the desire on the part of excluded social groups to try to gain access into other occupational areas and the success of dominant social groups in closing a particular niche. Muslim minorities throughout Europe are under threat of collateral damage from the Blair/Bush 'War on Terror.' In Scotland they also have to cope with the added possibility that Scottish nationalism might develop an 'ethnic' as well as a 'civic' dimension. But is Scottish nationalism part of the problem or part of the solution? Paradoxically, Muslims are under less pressure in Scotland than in England, despite Scotland's move over recent decades--psychologically as well as institutionally--towards nationalism.

The legal community's response to 9/11 was fast, thoughtful, comprehensive, creative, and collaborative. The success of the legal community's efforts must be measured not only by analysis of the response to the 9/11 crisis itself, but also by consideration of whether the lessons learned paved the way for an improved response for the legal community to the legal crises facing families every day. The Report on the New York City Bar's response to 9/11 outlined unmet legal needs, many of which still remain unmet.
