Homeless Persons' Residential Preferences And Needs: A Pilot Survey, Russell K. Schutt

The 2003 Pilot Survey of Residential Preferences and Needs sampled individuals with psychiatric difficulties at three large generic shelters for adult individuals in Boston and one of four transitional shelters funded by the Metro Boston Region of the Massachusetts Department of Mental Health.
The survey measured: homeless persons’ residential preferences; the residential recommendations of shelter-based clinicians for these homeless persons; clinicians’ assessments of these persons’ living skills and safety.
Respondents at the DMH shelter were somewhat more satisfied with their shelter and with the people who stayed there than were those at the generic shelters. The DMH shelter …

This Article is focused on a specific and important issue: the relationship of law to the social reality of group deprivations. From this primary issue, several important sub-issues are generated having a real and substantial impact upon the role of law in the management of group deprivations at every level of social organization (local, national, regional, and international). To focus on the social reality of group deprivations requires a critical starting point. In 2003, the Supreme Court in the landmark decision Lawrence v. Texas found a Texas law, banning homosexual, but not heterosexual, sodomy to be unconstitutional. Thus, Lawrence ended the Bowers era in which morality was deemed to be a justification for discrimination against gays and lesbians. While the decision did bring to United States Constitutional analysis the radical idea that gays and lesbians are people too, it stopped short of addressing the real problem the case presents--the existence of a second-class citizenry. Damages: Using A Case Study To Teach Law, Lawyering, And Dispute Resolution, Leonard L. Riskin

Seven law school faculty members and one practicing attorney recently developed and taught a wholly new kind of law course based on an already published case study, Damages: One Family's Legal Struggles in the World of Medicine, by Barry Werth, an investigative reporter who spent several years researching to write the book. Damages, an in-depth account of a medical malpractice case, presents the perspectives of the injured family, the defendant physician, the lawyers, and the three mediators. In this Symposium Introduction, the authors provide a summary of Werth's book, explain why they decided to create a course based on …

The effect of compost application on weed, fungal, and insect pest management in apple orchards was investigated from 1999 to 2001. Composted poultry manure was applied in June 1999 to half of two small research orchards which had previously received little or no management. The compost provided weed control for 1 year after application. There was no effect of compost on apple scab (Venturia inaequalis) infection. In a laboratory experiment, growth of the brown rot fungus (Monilinia fructicola) was significantly slower on a compost substrate than a sterilized compost substrate. The compost significantly affected arthropod abundance …

Family leave is not an end in itself, but rather is part of a much bigger picture: work/family policy. The goal of work/family policy is to achieve a good society by supporting families. Ideally, families enable children to develop to their fullest capacity and to contribute to their communities and society. Public rhetoric in the United States has always strongly supported families. Our policies, however, have not. In the area of work/family policy, the United States continues to lag behind every other advanced industrialized country, as well as many developing countries, in the degree to which we provide affirmative support …

The ultimate goal of work/family policy has always seemed deceptively clear: to provide institutional and cultural support to permit a healthy balance between family and work. An implicit assumption of that goal is that it would be achieved without undermining principles of equality. Indeed, the assumed result of work/family balance is that it would help achieve equality: families would be treated equally, caregivers would be supported equally, and children and family members would receive necessary and important care equally. It has long been recognized that work/family balance is especially critical to gender equality. Equality principles require that work/family policy and …

The Messenger Model: Don't Ask, Don't Tell?, Jeffrey L. Harrison

This article makes the case that the messenger model is either tacitly or inadvertently a "don't ask, don't tell" policy when it comes to competitor cooperation. In addition, this article presents an economic framework that explains how such a policy may benefit health care consumers. Finally, it is suggested that the "don't ask, don't tell" policy has created an area of per se legality that precludes an examination designed to distinguish consumer-benefiting practices from those that provide no benefit.

The American institution of retirement has sustained numerous attacks over the last twenty years, to the extent that it may cease to exist by the time most of today's workers reach their midsixties. Professor Patricia Dilley describes how all of the components of the "three-legged stool" that represents private pensions, personal savings, and Social Security, have declined so significantly in recent years that the combination may not be able to provide support for the elderly in the future, particularly those retired seniors who are in the lower and middle classes. In Inner Lives: Voices of African American Women In Prison, Professor Paula Johnson has written about the most invisible of incarcerated women — incarcerated African American women. The number of women incarcerated in the United States increased by seventy-five percent between 1986 and 1991. Of these women, a disproportionate number are black women. The percentages vary by region and by the nature of institution (county jail, state prison or federal facility), but the bottom line remains the same. In every instance, black women are incarcerated at rates disproportionate to their percentage in the general population. In Inner Lives, …

"[I]t is difficult ... to imagine an event or transaction that does not involve insurance in some way." So it is with the most salient event in the lives of Tony and Donna Sabia, whose son Tony John Sabia, or "Little Tony," was born with profound disabilities. In the final analysis, the ability of Tony and Donna to pay for the future medical care and living expenses needed by their son depends on whether they can reach the liability insurance coverage possessed by the health care providers who attended Donna and Little Tony at the time of his birth. Public Law and Legal Theory Working Papers
Under the WTO’s dispute settlement procedures, a party that has been injured by a scofflaw state’s failure to comply with its trade obligations may retaliate against the scofflaw state by withdrawing equivalent trade concessions. Legal and economic commentators generally view retaliation as an economically perverse strategy for enforcing free trade norms. This Article explores an alternative explanation, arguing that retaliation may provide the optimal enforcement mechanism for trade liberalization given the prevalence of low compliance incentives and high enforcement costs in international cooperation agreements. This Article argues that retaliation is superior to other remedial options because it enables an injured …

While other studies have researched the level of satisfaction of parents whose children are receiving early intervention services, no current studies have been done directly relating to services provided in North Dakota. The purpose of this study was to investigate the current need for information regarding rights and regulations that families with children eligible for early intervention services in North Dakota may have. In addition, the level of satisfaction of eligible families regarding the support given to them by Infant Development, along with their current and preferred methods of receiving pertinent information, was researched.

Background and Purpose: The purpose of this study was to determine perception of the utilization of preventive health screenings as compared to actual utilization for benefitted University of North Dakota employees. The research was designed to determine the perception of compliance and barriers to receiving recommended health screenings for benefitted employees. Many people use repeated overhead movements in their occupations or recreational activities. Literature has shown that this repeated overhead activity greatly contributes to the incidence of shoulder pathologies such as impingement syndrome. The purpose of this study was to establish whether the lower trapezius was more successfully recruited in the traditional muscle testing position of 145° of shoulder abduction or a modified position consisting of shoulder external rotation while in 80° of shoulder abduction and 90° of elbow flexion.
Forty-one subjects between the ages of 21 and 45 voluntarily participated in this study. One subject was excluded due to exceeding …

Arthritis is a prevalent condition found throughout the entire population. Manifestations of this disease can lead to increased pain in multiple joints leading to decreased functional mobility and limitations in activities of daily living. Ionized bracelets have become an increasingly popular non-traditional, conservative treatment for decreasing pain and improving well-being in persons with multiple diagnoses and body system involvement. Very little research has been conducted on the effects of ionized bracelets; therefore, additional research needs to be conducted to validate these theories.

The triceps surae, composed of the soleus and the two heads of the gastrocnemius, is a very active muscle in all activities involving the lower extremities. This study compared the maximal force generated by these ankle plantarflexors in a knee extended and knee flexed position to determine relative contribution to plantarflexion force in varying positions. Eighteen male and female college students were tested for maximal concentric plantarflexor force generation isokinetically at 3D/sec in both positions. Means of maximal force in knee extension and flexion, 242.56 Ibs. and 227.22 Ibs., respectively, were found to be statistically significantly different. The mean of …

Names Of Plants In Kalam Kohistani (Pakistan), Joan L.G. Baart, Esther L. Baart-Bremer, Muhammad Zaman Sagar
Work Papers of the Summer Institute of Linguistics, University of North Dakota Session
This paper presents a preliminary ethnobotanical lexicon of plant names in the Kalam Kohistani language, spoken in the mountainous north of Pakistan. The list includes 203 Kalam Kohistani plant lexemes, with their English and Urdu glosses; 137 of these are tentatively identified with their Latin scientific names. Many of the glosses include brief notes on the occurrence and local uses of the plants. The paper ends with an index of 116 English common plant names with their Kalam Kohistani equivalents, followed by an index of scientific names.

Turn Down The Volume: The Constitutionality Of Ohio's Municipal Ordinances Regulating Sound From Car Stereo Systems, Stuart A. Laven

This article will examine municipal ordinances criminalizing the emission of sound from car stereo systems in excess of proscribed limits, including the methods adopted to measure offending sound and the penalties imposed for violations, the Ohio (and certain non-Ohio) cases which have challenged the constitutionality of such ordinances, and certain constitutional aspects of such ordinances and their enforcement which have yet to be addressed.
