Syllabi

Asbury Seminary's Master of Arts program in World Mission and Evangelism is essentially a two-year (60 semester credit hours) academic degree beyond the B. A. "…Und Die Tiere" Constitutional Protection For Germany's Animals, Kate M. Nattrass Jan 2004

"…Und Die Tiere" Constitutional Protection For Germany's Animals, Kate M. Nattrass

Animal Law Review

In the summer of 2002, Germany welcomed animals into the folds of constitutional protection. With the addition of the words “and the animals,” Germany became the first country in the European Union, and the second on the European continent, to guarantee the highest level of federal legal protection to its nonhuman animals.

Troubled Waters Under The Bridge: Red Tide, Aquatic Pollution, And The Prince Edward Island Shellfish Poisoning Of 1987, Jacquelyn A. Shaw Jan 2004

Troubled Waters Under The Bridge: Red Tide, Aquatic Pollution, And The Prince Edward Island Shellfish Poisoning Of 1987, Jacquelyn A. Shaw

Dalhousie Journal of Legal Studies

Toxic red tides, such as the one that poisoned PEI in 1987, are a coastal aquatic phenomenon that cause harm to wildlife and humans alike, seemingly with increasing frequency. They appear tied to nutrient pollution of aquatic habitats, especially by the food-producing industries, such as aquaculture and industrial farming. Canada has made (non-binding) global commitments to protect marine waters from such land-based pollution, resulting in its ‘National Program of Action’. To date, however, Canada’s attempts to meet this goal have been hampered by the federal division of powers, and by an overall fragmented legal protection for the aquatic environment. Respecting …

Banning Books, Burning Bridges: Recognizing Student Freedom Of Expression Rights In Canadian Classrooms, Devon Peavoy Jan 2004

Banning Books, Burning Bridges: Recognizing Student Freedom Of Expression Rights In Canadian Classrooms, Devon Peavoy

Dalhousie Journal of Legal Studies

In Canada, books and magazines are regularly intercepted at the border and are consistently removed from libraries, schools and bookstores. The banning of books is a controversial topic that involves issues of censorship and freedom of expression rights. The Supreme Court of Canada recently examined the issue in Chamberlain v. Surrey School District No. 36, where it was found that the School Board acted unreasonably in banning several books depicting same sex couples. The Court, however, did not consider the freedom of expression rights of students in reaching their decision. Despite this recent opportunity to comment on a student’s right …

Recruiting And Using Children As Soldiers: The Case For Defining The Offence As A Crime Against Humanity, Shawn Tock Jan 2004

Recruiting And Using Children As Soldiers: The Case For Defining The Offence As A Crime Against Humanity, Shawn Tock

Dalhousie Journal of Legal Studies

The increasing number of domestic conflicts around the world has put civilian populations in general, and children specifically, in harmʼs way. Due to their vulnerability and the lack of social support that is likely to result as a consequence of combat, children are often recruited and put to use as soldiers and participants in these wars. The international community has only recently begun to address this egregious practice, and much remains to be done to halt the recruitment and use of child soldiers. This paper surveys the current humanitarian and human rights laws applicable to this issue, and examines the …

Boys Will Be Girls: Sex Reassignment Surgery And The Ethics Of State Funding, Megan Leslie

Dalhousie Journal of Legal Studies

This paper was developed as a result of the author’s involvement with the Nova Scotia Rainbow Action Project in Halifax, Nova Scotia, who are planning an action whereby a member of the group will submit a complaint of discrimination to the provincial Human Rights Commission, contrary to the Nova Scotia Human Rights Act, on the ground of sex. The complaint will be based on a memberʼs denial of Nova Scotia Medical Services Insurance coverage for sex reassignment surgery, which is prohibited in Nova Scotia. This paper outlines the players and decision-making involved in determining whether or not sex reassignment surgery …

The Constitution At The Threshold Of Life And Death: A Suggested Approach To Accommodate An Interest In Life And A Right To Die, Michael P. Allen Jan 2004

The Constitution At The Threshold Of Life And Death: A Suggested Approach To Accommodate An Interest In Life And A Right To Die, Michael P. Allen

American University Law Review

In the past fifteen years, the United States Supreme Court has decided three cases in which it tentatively began to explore what the United States Constitution has to say about issues that are popularly described as the "right to die." In this article, I suggest that the current state of constitutional analysis does not provide for an effective mechanism for securing an individual's "right to die," at least not without undervaluing a state's interest in the preservation of human life should a state choose to take such a position. In the article, I suggest that it is possible to adopt …

Access Denied: The Problem Of Abused Men In Washington, Melody M. Crick Jan 2004

Access Denied: The Problem Of Abused Men In Washington, Melody M. Crick

Seattle University Law Review

This Comment explains how the Washington legislature and court system have failed to provide abused men with much needed protection, despite a law that is facially gender neutral. Following this Introduction, Part II explores the wording of Washington's domestic violence statutes and analyzes the current implementing regulations. Part III demonstrates that the problem of abused men is legitimate by examining increasing social awareness and the results of current studies. By examining the prevailing national viewpoint embodied in the Violence Against Women Act, Part IV discusses how such a viewpoint adversely affects the availability of resources for abused men. Part V …

Patent Politics, Michael Henry Davis Jan 2004

Patent Politics, Michael Henry Davis

Law Faculty Articles and Essays

To observe that so-called intellectual property (IP) flowered in the late twentieth century, even supplanting, to a large extent, the place of real and tangible personal property in terms of corporate, if not individual, wealth, is almost trite. Since IP has become the bedrock of most commercial wealth, especially in international trade, and since international trade is, or is about to become, the center of most commercially valuable trade, a comprehensive understanding of IP has become essential. Instead of being the reserve of technicians, the field demands a full examination by jurists and the larger society.Although IP literature has blossomed, …

Pslra, Slusa, And Defrauded Retirement Investors: Overlooked Side Effects Of A Potent Legislative Medicine, Michael J. Borden

Law Faculty Articles and Essays

This Article highlights a harmful and far-reaching unintended consequence of two major pieces of securities litigation reform legislation that were passed as part of the Republican party's Contract with America in the mid-1990s. These reforms were justified, in part, on the grounds that they would benefit investors by improving disclosure of financial information by corporations. However, for many aggrieved investors, the effect of the legislation was just the opposite. Because of inadequate and misleading disclosures made by life insurance companies and their registered representatives, consumers were induced to purchase inappropriate investments carrying excessive fees that reduced the value of their …

Nutritional Composition Of Selected Traditional Native American Foods, Suzanne Parker Stluka, Mary Lynn Gengler Jan 2004

Nutritional Composition Of Selected Traditional Native American Foods, Suzanne Parker Stluka, Mary Lynn Gengler

The Journal of Undergraduate Research

Food choices have changed among Native American populations. Healthy food choices are subject to lifestyles, cooking skills, nutrition knowledge and the availability of healthy foods. There is a paucity of nutritional information on traditional and cultural Native American foods. Sixteen traditional Dakota recipes were prepared by members of the Sisseton Wahpeton Oyate, Sisseton, South Dakota. These foods were pureed, lyophilized and analyzed for moisture, ash, fat, protein, carbohydrate and individual mineral content using officially accepted methods. The following mineral elements were analyzed: calcium, copper, iron, magnesium, manganese, phosphorus, potassium, sodium and zinc. Methods of the Association of Official Analytical Chemists …

Patient Age, Number And Type Of Clinical Encounters, And Provider Advice To Quit Smoking. Brfss 2000, Sean C. Lucan

Yale Medicine Thesis Digital Library

The purpose of this study was to determine how often smoking patients receive quit advice and if patient age, and number and type of clinical encounters are associated with odds of receipt. Behavioral Risk Factor Surveillance System (BRFSS) 2000 data were used to study 10,582 smokers (aged ≥ 18) having ≥ 1 of three types of clinical encounters in the past year: routine checkups, other physician encounters, or dental visits. Multivariate-adjusted odds ratios (ORs) for quit advice by patient age, encounter type, and number of doctor's visits were calculated. Almost 55% of patients were advised to quit smoking. Brief Relational Mathematics Counseling As An Approach To Mathematics Academic Support Of College Students Taking Introductory Courses, Jillian M. Knowles Jan 2004

Brief Relational Mathematics Counseling As An Approach To Mathematics Academic Support Of College Students Taking Introductory Courses, Jillian M. Knowles

Educational Studies Dissertations

Traditional approaches to college mathematics support focus on cognitive aspects of the student's approach and only incidentally address affective problems such as mathematics and testing anxiety. Because such affective conditions may be symptoms of underlying relational problems rooted in a student's learning history, I proposed a brief relational mathematics counseling approach that integrates cognitive constructivist mathematics tutoring into a brief relational conflict counseling framework.
