Why Am I My Brother's Keeper?, Donald H. Regan

I want to cast doubt on a proposition which many people would regard as the first axiom of moral theory. Joseph Raz has stated the proposition thus: 'Morality is ... concerned with the advancement of the well-being of individuals.' Actually, Raz includes a qualifier-the full quote says that morality 'is thought to be concerned with' advancing the well-being of individuals. But the whole tenor of his ensuing discussion suggests that Raz generally shares this view of what morality is about.
As I say, I want to cast doubt on this axiom, but I shall not take issue with any particular …
Child Protection Law And Procedure, Frank E. Vandervort
Child Protection Law And Procedure, Frank E. Vandervort
Book Chapters
Child protective proceedings are governed by the Child Protection Law (CPL), MCL 722.621 et seq.; the Juvenile Code, MCL 712A.l et seq.; and Subchapter 3 .900 of the Michigan Court Rules. Taken together these sources of authority establish a comprehensive scheme for reporting cases of suspected abuse and neglect, investigating those reports, and responding with appropriate action.

Protein Similarity Score: Simplified Version Of The Blast Score As Superior Alternative To Percent Identity For Claiming Genuses Of Related Protein Sequences, Christopher M. Holman

Recombinant proteins form the basis for most of the products of biotechnology, including drugs, diagnostics, research reagents, genetically modified organisms and industrial enzymes. However, the nature of proteins and the rules of patentability conspire to make it difficult to achieve adequate patent protection for novel proteins and the polynucleotides that encode them. Narrow patent claims limited to protein sequences sharing a high degree of structural identity can generally be designed around by introducing structural changes in the claimed protein, thereby avoiding the patent without substantially altering the protein's function. However, inventors are generally restricted in their ability to broadly claim …

A New Dynamism In The Public Domain, Robert P. Merges
University of Chicago Law Review
Many believe intellectual property has overreached, and that policymakers must respond. In this Essay, I argue that the critique may have merit, but private parties are in some cases taking matters into their own hands. Firms and individuals are increasingly injecting information into the public domain with the explicit goal of preempting or undermining the potential property rights of economic adversaries. Biotechnology firms invest millions of dollars in public domain gene sequence databases, to prevent hold-ups by firms with patents on short gene sequences. Major software firms fight entrenched rivals by investing millions of dollars, contributing to open source operating …

The Right To Health, Sarah Friedmann
The Right To Health, Sarah Friedmann
Human Rights & Human Welfare
In the human rights discourse and practice the right to health has been and continues to be a contentious arena. Primarily located within legal frameworks that focus on civil and political rights, the right to health is more frequently being used to challenge abuses of health by invoking social and economic rights, even though this places the right to health on slippery terrain that is not as internationally accepted as civil and political rights.
Access To Health, Natalie Huls
Access To Health, Natalie Huls
Human Rights & Human Welfare
Access to health is an often-overlooked aspect of the right to health. Without practical access, the right to health becomes an empty promise. International human rights conventions and declarations do not directly mention access to health, but the above comment on the International Covenant on Economic, Social, and Cultural Rights does address the issue.

Aligning Or Maligning - Getting Inside A New Idea, Getting Behind No Child Left Behind And Getting Outside Of It All, Stephen A. Rosenbaum
UC Law SF Journal on Gender and Justice
The pending reauthorization of the Individuals with Disabilities Education Act (IDEA) alters the landscape of special education for parents and advocates of children with special needs. The proposed modifications are based on an effort to reduce the bureaucracy associated with the current procedural safeguards and to incorporate the concept of accountability embodied in the No Child Left Behind Act. Many advocates are waiting with apprehension for the final version of the bill due to the philosophical changes that it will bring to special education federal law. This article gives an overview of the pending legislation and urges advocates to adapt …
