Toward An Indigenous Jurisprudence Of Rape, Sarah Deer

Faculty Scholarship

This article sets forth some preliminary issues and perspectives for the development of indigenous models of rape jurisprudence. Part I examines the reasons for and importance of developing an indigenous jurisprudence of rape. Part II addresses tribal jurisdiction issues, particularly the current limitations on tribal authority. Part III provides a historical context for the issue, including examples of the role of colonization in the responses to sexual violence. Misrepresentation By Lawyers About Credentials Or Experience, Vincent R. Johnson, Shawn M. Lovorn Jan 2004

Misrepresentation By Lawyers About Credentials Or Experience, Vincent R. Johnson, Shawn M. Lovorn

Faculty Articles

Authorities appropriately condemn dishonesty by attorneys in the broadest terms. In moving from moral principles to legal liability, however, it is important to think carefully about when a lawyer’s conduct misleads a client in a way that is actionable. Whether liability will be imposed depends upon the nature of the misrepresentation, the status of the plaintiff, the theory of liability, and the presence of competing interests or special considerations.

Basic principles of American tort law provide useful guidance in defining the disclosure obligations of attorneys. But like tort law itself, the answers are not simple. What an attorney may, must, …

What Lies Beneath: Determining The Necessity Of International Groundwater Policy Along The United States - - Mexico Border And A Roadmap To An Agreement (Comment), Amy Hardberger

Faculty Articles

The United States and Mexico share water in many aquifers along the border. Although significant attention has been given to international surface water, little to no policy has been generated regarding shared groundwater. Groundwater is a resource of growing importance because surface water resources are quickly being depleted.

While there are almost no international agreements for groundwater, guidance documents suggest what should be included. Increased dependence on groundwater by both sides of the border creates the potential for conflict because the only legal framework for water allocation involves surface water. The US and Mexico must shift from passive to active …

Exogenous Estrogen Boosts Circulating Estradiol Concentrations And Calcium Uptake By Duodenal Tissue In Heat-Stressed Hens, K.K. Hansen, M.M. Beck, S.E. Scheideler, Erin E. Blankenship Jan 2004

Exogenous Estrogen Boosts Circulating Estradiol Concentrations And Calcium Uptake By Duodenal Tissue In Heat-Stressed Hens, K.K. Hansen, M.M. Beck, S.E. Scheideler, Erin E. Blankenship

Department of Animal Science: Faculty Publications

In the hen, heat stress (HS) disrupts shell calcification and reproductive processes, including hormone synthesis and egg production. Two studies were conducted to investigate palliative effects of exogenous estrogen or dietary vitamin D3 on Ca homeostasis and reproductive physiology during HS. Study 1: Hy-Line W36 hens were randomly assigned to thermoneutral (TN) or HS treatments and to 1 of 7 estrogen treatments: zero (control) or one Compudose 200 implant given 1, 2, 3, 8, 9, or 10 d before onset of HS. With no implant, HS reduced plasma estradiol (E2) and total Ca absorbed (CaT) by duodenal cells (P < 0.05). In TN hens with implants, plasma E2 tripled within 24 h (P < 0.05) and remained elevated (P < 0.05) through d 9. In HS hens with implants, plasma E2 rose 6-fold (P < 0.05) to equal TN+E2 concentrations and remained elevated through d 10. In TN and HS hens with implants, the rate of Ca absorption (CaTR) and CaT increased dramatically; the responses were quadratic and essentially identical. Study 2: Hy-Line W36 hens were provided diets formulated either according to NRC requirements (NRC, 1994), or with the addition of 22,000 IU/kg vitamin D3 (+VD hens). A 24-h HS episode was imposed 2 wk after initiation of the dietary regimen. Duodenal samples were collected for Ca absorption assays after the 24-h HS episode. Both CaTR and CaT in +VD hens were approximately 3-fold higher than in hens in the NVD group (P = 0.102). The results lead to the conclusion that exogenous estrogen, high levels of dietary vitamin D, or both, before a HS episode, are efficacious in alleviating at least some of the effects of HS and should be further investigated.

Engaging Students In The Agricultural Education Model: Factors Affecting Student Participation In The National Ffa Organization, B. Allen Talbert, Mark Balschweid

Department of Agricultural Leadership, Education, and Communication: Faculty Publications

The purpose of this study was to determine the degree of engagement of agricultural education students in the FFA, their agricultural education courses, their high school courses, and agriculture. This descriptive study using self-administered mailed questionnaires had a 52% useable response rate from FFA members and a 63% useable response rate from nonmembers. Members of the National FFA Organization more than non-members had a higher percentage that were current or former 4-H members, a higher percentage that had parents or siblings who were in agricultural education or 4-H, and a higher percentage self-reported that they lived on a farm. A …

Women’S Work, Child Care, And Helpers-At-The-Nest In A Hunter-Gatherer Society, Raymond Hames, Patricia Draper Jan 2004

Women’S Work, Child Care, And Helpers-At-The-Nest In A Hunter-Gatherer Society, Raymond Hames, Patricia Draper

Department of Anthropology: Faculty Publications

Considerable research on helpers-at-the-nest demonstrates the positive effects of firstborn daughters on a mother’s reproductive success and the survival of her children compared with women who have firstborn sons. This research is largely restricted to agricultural settings. In the present study we ask: “Does ‘daughter first’ improve mothers’ reproductive success in a hunting and gathering context?” Through an analysis of 84 postreproductive women in this population we find that the sex of the first- or second-born child has no effect on a mother’s fertility or the survival of her offspring. We conclude that specific environmental and economic factors underlay the …

Expelling From Top And Bottom: The Changing Role Of Scatology In Images Of Peasant Festivals From Albrecht Dürer To Pieter Bruegel, Alison Stewart Jan 2004

Expelling From Top And Bottom: The Changing Role Of Scatology In Images Of Peasant Festivals From Albrecht Dürer To Pieter Bruegel, Alison Stewart

School of Art, Art History, and Design: Faculty Publications and Creative Activity

During the first half of the sixteenth century, the earliest visual representations of peasant festivals in European art were produced in Germany. These works, all prints, showcase peasants expelling their drink with the result that art historians today, nearly 400 years later, have described these prints as gross and indecent. In their revulsion and distancing from sixteenth-century Germany’s insistently colorful visual and verbal vocabulary, art historians of Northern European art appear to have stressed both the values and preferences of their own twentieth-century culture and that of the sixteenth-century Netherlands rather than those of the society that produced them—sixteenth-century Germany. …
