Judicial And Law Review Citation Frequencies For Articles Published In Different 'Tiers' Of Law Journals: An Empirical Analysis, Gregory S. Crespi

An empirical study of the judicial and law journal citation frequencies for a large and comprehensive sample of 550 articles that were published from 1996 through 1998 in fifteen selected law journals resulted in several findings. First, these articles averaged only 0.4 judicial citations and 14.5 law journal citations through May 30, 2003. Second, both courts and scholars cite articles that are published in the three most prestigious law journals at much higher rates than they cite articles that appear in either mid-level or lower-tier law journals. Third, courts virtually ignore altogether legal scholarshipthat appears in lower-tier law journals. Finally, …

Two of André Gide’s books, L’Immoraliste and La Porte étroite, exemplify the ethical struggles that defined the author’s life through the codependence of their singular message. By submitting these two intrinsically similar works to a structuralist analysis of the binary oppositions that exist between them, the relationship between good and evil becomes solidified through the structures and semiotic codes of the novels, the opposition of the protagonists, and the motifs of geography, personal relationships, nature, and religion.

Children need to learn appropriate behavior in their early years. Educators of young children have been given the job of importing very important social competency skills, such as coping, problem solving, cooperation, and self-control skills. Interventions designed to meet the developmental level and individual needs of the children enrolled in a preschool should build factors that will lead to increased social skills and resiliency. This research involved implementing social skill prevention in a preschool classroom in a non-profit childcare center in rural West Virginia. I examined relationships between landscape physiographic factors and summer stream temperatures in the Cheat River watershed, WV and developed statistical models to characterize thermal patterns at the stream segment and watershed scales. I also examined the influence of modeled thermal regimes on the distribution of smallmouth bass (Micropterus dolomieui) and brook trout (Salvelinus fontinalis) in this system. The main goal of this thesis research was to develop an Internet-based contextual GIS and demonstrate its use as a tool for prehistoric cultural landscape study. GIS provides the ability to synthesize and display both quantitative and qualitative data that provide important information about the characteristics of a cultural landscape in a digital context. In addition, the ability to embed spatial multimedia including photographs, video, and text allows the contextual GIS to provide essential qualitative data. While the advantages of Artificial Neural Networks (ANN) for reservoir characterization are widely known, this project expands such benefits by providing a method by which an ANN can be trained prior to its application to real data. First, a geological and 3D seismic interpretation of the lower Pennsylvanian Atoka-Morrow sequence in the Buffalo Valley Field, New Mexico was executed. Then, to design the ANN and to test its predictions, I generated well-logs and synthetic seismic models for seismic attributes extraction. A Hands-On Approach To Calculus was a research study designed to examine the use of hands-on inquiry centered teaching strategies in a first semester calculus class and the ramifications of the hands-on strategies. The study used an experimental class, where activities were implemented into the teaching strategies, and a control class, where traditional teaching strategies of lecture of theory and drill were used. Students' learning in the two classes was examined by comparing exam scores in the two classes and by analyzing students' journals from the experimental class. The purpose of this study was to examine the influence of image properties on the accuracy of remote sensing change detection methods. Spectral class separability, radiometric normalization and image band correlation were evaluated through experiments with simulated data. The experimental results were then evaluated as a tool for predicting the relative accuracy of change detection results obtained from Landsat TM satellite image pairs of three U.S. cities: Las Vegas, Nevada; Phoenix, Arizona; and Atlanta, Georgia. The change detection methods used were post-classification comparison, direct classification, image differencing, principal component analysis, and change vector analysis. The politics of local economic development in the Brazilian favela (urban slums) are contentious. This dissertation examines the politics of economic development in the urban slum of Sao Pedro, which is located in the city of Vitoria, Brazil. Spatial structure in remotely sensed imagery is shown to impact the change detection procedure. Methods to incorporate spatial statistics into correlation-based and regression-based change detection that control for the spatial structure in this data are proposed. These procedures are presented by means of an urban change detection case study utilizing Landsat TM and Landsat ETM+ imagery in the area to the west of the Baltimore, MD I Washington D.C. metropolitan area between 1989 and 2002. In the correlation-based analysis, the results show that the use of point-to-point correlation is often inappropriate in the examination of spatial datasets. In addition, spatial …

For nearly 100 years American historians, with few exceptions, have maintained that migration of colonists to the trans-Appalachian frontier was a communal experience for those from New England and Northern regions but that the Southern frontiersman represented a non-communal, individualistic spirit of colonization. This dissertation traces the migration and settlement patterns of the earliest colonists along the northwestern Virginia frontier, the area organized as Wood County in 1799, from three Eastern regions, New England, the Middle Atlantic, and the Northern Neck of Virginia. It determines that emigrants from all regions migrated cohesively and sequentially in large kinship/neighbor groups and that …

This dissertation examines Kenyan peri-urbanization using a GIS and Society conceptual framework. The study integrates historical and cultural peri-urban experiences of local communities into a conventional GIS to enhance an analysis of uneven development of residential space in Athi River town, Kenya. The research is guided by three broad objectives: (1) understanding how GIS is impacting Kenyan urban geographic research; (2) building a GIS to study uneven development of residential space, and; (3) integrating community local knowledge into a GIS-based analysis of uneven residential development in a peri-urban setting. This essay is one of a series destined to appear in a Foundation Press book, Administrative Law Stories, now set for publication in the fall of 2005. The decision in Citizens to Preserve Overton Park v. Volpe represents a transition from political to judicial controls over decisions broadly affecting a wide range of community interests. Unmistakable and dramatic as it is, that transition is not universally applauded. But the transition was striking and quick. The primary goal of this project is to develop a relative chronology of events in the geologic history of the Kentucky River, and to consider the geologic controls on those events. This study utilized published geologic and topographic data, as well as field observations and extensive compilation and comparison of digital data, to examine the fluvial record preserved in the Kentucky River valley in central Kentucky. Numerous fluvial features including abandoned paleovalleys, fluvial terraces and deposits, bedrock benches, and relict spillways between adjacent river valleys were identified during the course of the study. The Social Life Of Poetry: Pluralism And Appalachia, 1937-1946, Christopher Allen Green

This dissertation demonstrates how poetry about Appalachia expanded American considerations of democracy, ethnicity, and cultural values. I argue that poetry is profoundly communal in its construction and investigate how the value of poetry changes based upon its transfer through varying networks of production, circulation, and reception. Informed by theories of cultural capital and rhetoric, the chapters trace three books of poetry from their composition and publication to their reception and influence, noting how central political and social institutions and individuals shaped that process. The dissertation establishes how the poets crafted their writing to sway specific interpretive communities attitudes on pluralism. …

The story is about a girl who achieves her mythological destiny through her metamorphosis from a human form to that of a sea turtle which symbolizes universal love, fertility and desire. During preproduction the original concept (see Thesis Proposal in Appendix A) took a dramatic shift, becoming less of a traditional narrative work and evolving more into a visual lyrical form. Ancient Promises begins with the female lead character appearing restless during her strangely frantic investigations on a beach. She hears voices which surprise and intrigue her. Transverse zones are important syn-kinematic components of thrust belt development. Various scales of data were utilized to develop three-dimensional geometric and kinematic models for the Bessemer transverse zone (BTZ) of the Alabama Alleghanian thrust belt.
Regional analysis of the BTZ began with the examination of geologic maps (1:250,000, 1:48,000, and 1:24,000 scales), seismic reflection profiles, well data, and previous stratigraphic research. All Paleozoic-age stratigraphic contacts, major thrust faults and associated folds, and various unnamed minor structures were compiled to create two strike-perpendicular, and five-strike parallel, cross sections transecting the extent of the BTZ at a scale of 1:100,000. Cubas provision of free health services to the entire population via neighborhood-based family doctors produced dramatic health gains and achieved a relative state of health equality. Since 1989, however, the termination of Soviet trade, a grave economic crisis, intensification of the US embargo, welfare reductions, and population aging have placed Cubas health successes and elder care services in jeopardy. Little independent research, though, has focused on the influence of post-Cold War circumstances on citizen attitudes about health programs and resources targeting Cubas older population. G-Portal is a Java-based digital library system for managing the metadata of geography related resources on the Web. In addition to providing a flexible repository subsystem to accommodate metadata of different formats using XML and XML Schemas, G-Portal organizes metadata into projects and layers, and supports an integrated and synchronized classification and map-based interfaces over the stored metadata. G-Portal also includes a classification subsystem that creates category structures and classifies metadata resources into categories based on user-specified classification schemas. The estimation of vote splitting in mixed-member electoral systems is a common problem in electoral studies, where the goal of researchers is to estimate individual voter transitions between parties on two different ballots cast simultaneously. Because the ballots are cast separately and secretly, however, voter choice on the two ballots must be recreated from separately tabulated aggregate data. The problem is therefore of one of making ecological inferences. Because of the multiparty contexts normally found where mixed-member electoral rules are used, furthermore, the problem involves large-table (R × C) ecological inference.
