The Christological And Ecclesial Pacifism Of Stanley Hauerwas-A Lutheran Analysis And Appraisal, Joel Lehenbauer Oct 2004

The Christological And Ecclesial Pacifism Of Stanley Hauerwas-A Lutheran Analysis And Appraisal, Joel Lehenbauer

Doctor of Philosophy Dissertation

The first purpose of this study, therefore, is to explore and examine the nature and content of Hauerwas's pacifist convictions and claims as a way of understanding more deeply and clearly his contribution to contemporary theology and ethics. There are, as we will see, many different varieties of pacifism. What are the essential characteristics of Hauerwas's pacifism, and what distinguishes it from these other varieties? Where do his pacifist convictions fit into his program for reforming Christian ethics? How do they inform and impact his theology as a whole?

A second purpose will be to examine Hauerwas's pacifism in the …

This report provides a means for disseminating information to interested private and public service weed scientists.

The F-Word, Paula B. Bishton Oct 2004

The F-Word, Paula B. Bishton

English Theses & Dissertations

This is a collection of six short stories about family dynamics. The stories follow a rough chronology of family development, beginning with two stories of early family life. In "Wedding Gift" a recently divorced young woman severs a lingering emotional attachment to her ex-husband when she returns a wedding present. In "Strolling," the young female protagonist questions her own fitness as a mother when she witnesses a near-tragedy involving a stranger's child in a stroller. The third story, "Cousin Edward," features a woman at midlife who questions her own happiness as a wife and a mother when she's called on …

Application Of Queuing Theory And Procedure Time Estimation In A Local Healthcare System, Galina Tsoy Oct 2004

Application Of Queuing Theory And Procedure Time Estimation In A Local Healthcare System, Galina Tsoy

Engineering Management & Systems Engineering Theses & Dissertations

People in the United States pay more for their basic healthcare needs than do people in any other nation in the world. When we consider that the United States is the wealthiest nation in the world, controlling the majority of the world's resources, it seems only reasonable to ask: Why should it be this way?

In an effort to address this problem, this thesis examines two possible methods of improving health care efficiency in hospitals. The thesis is thus in two parts: the first part examines resource allocation in medical units using Queuing Theory, and the second part examines a …

The Limits Of International Criminal Law: House Demolitions In An Occupied Territory, Ariel Zemach Oct 2004

The Limits Of International Criminal Law: House Demolitions In An Occupied Territory, Ariel Zemach

Connecticut Journal of International Law

The values of liberty, fairness and democracy underlie Western criminal law systems.' Each of these values challenges the International Criminal Court ("ICC") system, established under the Rome Statute of the International Criminal Court2 ("Rome Statute" or "Statute"). This article analyzes these challenges and shows that they can be properly addressed only by adopting a moral gravity requirement in determining the scope of international criminal prohibitions.

But how should we apply a requirement of moral gravity in international criminal law? How does such requirement bear on the prohibitions contained in the Rome Statute? This article takes up those questions by focusing …

Currents And Crosscurrents In The International Intellectual Property Regime, Peter K. Yu Oct 2004

Currents And Crosscurrents In The International Intellectual Property Regime, Peter K. Yu

Faculty Scholarship

Since the establishment of the TRIPs Agreement, intellectual property protection has been expanding rapidly, and many less developed countries have become dissatisfied with the international intellectual property regime. From bilateral free trade agreements to the increasing use of technological protection measures, many commentators fear that the recent "one-way ratchet" will roll back the substantive and strategic gains made by less developed countries during the negotiation of the TRIPS Agreement. Interestingly, intellectual property rightsholders feel equally threatened by the recent developments, in particular the development of the Doha Declaration, the World Summit on the Information Society, the WIPO Development Agenda, and …

The Origins Of Cctld Policymaking, Peter K. Yu

Extract:

A long time ago in a galaxy not so far away, there was a decentralized global network of computers. These computers shared information with each other regardless of how far apart they were and whether there was any direct line of communication between them. In the very beginning, this network was used exclusively by government and military agencies, educational and research institutions, government contractors, scientists, and technology specialists. Instead of the domain names we use today, such as “www. amazon.com,” users typed in numeric addresses, such as “123.45.67.89,” and, later, host names to send information to other computers.

Muss Es Sein? Not Necessarily, Says Tort Law, Anita Bernstein Oct 2004

Muss Es Sein? Not Necessarily, Says Tort Law, Anita Bernstein

Law and Contemporary Problems

The rule of law helps to check tendencies to excess, aligns remedies with what happened to similarly situated persons in the past, and give both power and accountability to public officials. Asserting its perpetual demand of Muss es sein? in reaction to oppressions, tort law jolts stais into change.

International Law, International Relations Theory, And Preemptive War: The Vitality Of Sovereign Equality Today, Thomas H. Lee Oct 2004

International Law, International Relations Theory, And Preemptive War: The Vitality Of Sovereign Equality Today, Thomas H. Lee

Law and Contemporary Problems

The norm of sovereign equality in international law is so resolutely canonical that its precise meaning, origins, and justifications are rarely examined. Whatever the general merits of the norm, its retention seems fairly open to question when one sovereign state appears supremely unequal among 191 states in terms of military power.

The Future And Past Of U.S. Foreign Relations Law, Martin S. Flaherty

Law and Contemporary Problems

The increasing role that the US plays in the world can only mean a correspondingly greater role for foreign affairs law in the US legal community. The Supreme Court has recently cited international and comparative law materials to a striking, and all but unprecedented, degree.

Current And Future Challenges For Asian Nonproliferation Export Controls: A Regional Response, Scott A. Jones Dr. Oct 2004

Current And Future Challenges For Asian Nonproliferation Export Controls: A Regional Response, Scott A. Jones Dr.

Books, Monographs & Collaborative Studies

As Asia develops into a clearly demarcated economic "region," it is confronted by similar export control challenges as those faced in Europe with the advent of the Common Market. As such, a regional system of export control standards and practices emerged as a means to ensure not only economic parity, but regional and international security as well. While not necessarily as advanced in terms of regional identity as the European free trade area, the states of Asia could benefit profitably from a regional approach to export control development and coordination. In addition, the states of Asia could also gain from …

Civil-Military Cooperation In Peace Operations: The Case Of Kosovo, Thomas R. Mockaitis Dr. Oct 2004

Civil-Military Cooperation In Peace Operations: The Case Of Kosovo, Thomas R. Mockaitis Dr.

Books, Monographs & Collaborative Studies

The humanitarian intervention in Kosovo provides an excellent case study of civil-military cooperation (CIMIC) in peace operations. The intervention required 40,000 heavily armed combat troops from NATO and Partnership for Peace countries to provide security and coordinate relief efforts with the UN, the OSCE, and over 500 humanitarian organizations. CIMIC provided the mechanism for such cooperation and support. Like any concept employed in coalition warfare, CIMIC varied widely in the quality of its application. This study examines the effectiveness of CIMIC within each brigade area and throughout the province as a whole. It identifies best practices and common mistakes to …

Isolation Versus Quarantine And Alternative Measures To Control Emerging Infectious Diseases, Fahad A. Al-Ateeg Oct 2004

Isolation Versus Quarantine And Alternative Measures To Control Emerging Infectious Diseases, Fahad A. Al-Ateeg

Saudi Medical Journal

In the past 25 years, the world has witnessed the emergence and re-emergence of many infectious diseases. In the early stages of their emergence, isolation and quarantine may be the only and last resort to effectively control infectious diseases when we are confronted with limited or no knowledge of a newly identified and previously unknown contagious disease, which causes a serious public health threat either locally or internationally. The article traces back the origins of isolation and quarantine; defines precisely the terms isolation and quarantine as they are currently used in the modern era; compare and contrast these terms; identifies …

Abdominal Cocoon. An Unusual Cause Of Intestinal Obstruction, Abdulla Al-Abassi, Mohammed Emad Oct 2004

Abdominal Cocoon. An Unusual Cause Of Intestinal Obstruction, Abdulla Al-Abassi, Mohammed Emad

Saudi Medical Journal

We report a case of abdominal cocoon in a young male patient, presenting with acute intestinal obstruction and abdominal mass. This is a rare acquired condition of the peritoneum in which the small bowel is encased either partially or totally by a dense fibrous membrane. Operative findings, perioperative imaging and treatment guidelines are discussed. A better awareness of this condition may facilitate preoperative diagnosis; prevent inadvertent bowel damage at laparoscopy and unnecessary bowel resection at laparotomy.

Lower Extremity Muscle Strength And Risk Of Self-Reported Hip Or Knee Osteoarthritis, Jennifer M. Hootman, Shannon J. Fitzgerald, Carol A. Macera, Steven N. Blair Oct 2004

Lower Extremity Muscle Strength And Risk Of Self-Reported Hip Or Knee Osteoarthritis, Jennifer M. Hootman, Shannon J. Fitzgerald, Carol A. Macera, Steven N. Blair

Faculty Publications

Purpose: The purpose of this study was to investigate the gender-specific longitudinal association between quadriceps strength and self-reported, physician-diagnosed hip or knee osteoarthritis (OA).

Methods: Subjects were 3081 community-dwelling adults who were free of OA, joint symptoms and injuries, completed a maximum treadmill exercise test, had isokinetic knee extension and flexion and isotonic leg press strength measurements taken at baseline and returned at least one written follow-up survey. Multivariate logistic regression was used to estimate odds ratios and 95% confidence intervals.

Results: Women with moderate or high isokinetic quadriceps strength had a significantly reduced risk (55% to 64%) of hip …

Nietzsche, The Kantian Self, And Eternal Recurrence, Philip J. Kain Oct 2004

Nietzsche, The Kantian Self, And Eternal Recurrence, Philip J. Kain

Philosophy

Nietzsche’s concept of the self grows out of Kant—and then attempts to subvert Kant. Nietzsche agrees that a unified subject is a necessary presupposition for ordered experience to be possible. But instead of a Kantian unified self, Nietzsche develops a conception of the self of the sort that we have come to call postmodern. He posits a composite bundle of drives that become unified only through organization. This subject is unified, it is just that its unity is forged, constructed, brought about by domination. But if the self is a bundle of struggling and shifting drives, how could it remain …

Is Chaos Theory Postmodern Science?, J. Linn Mackey Oct 2004

Is Chaos Theory Postmodern Science?, J. Linn Mackey

Reconstruction: Studies in Contemporary Culture

[Editors' Introduction]

Based on a comparison between the theories of N. Katherine Hayles (Chaos Bound: Orderly Disorder in Contemporary Literature and Science) and Vladimir Tasic (Mathematics and the Roots of Postmodern Thought), J. Linn Mackey asks the question Is Chaos Theory Postmodern Science and looks at parallels between the literature dubbed as postmodern and the scientific branch more properly termed complex dynamics. His conclusions are surprising: both Hayles and Tasic miss important connective elements of both the science and the practice of postmodernism. Postmodern science does, in fact, exist, and literature just may be it.

The Globalization (Americanization?) Of Executive Pay, Randall Thomas, Brian R. Cheffins Oct 2004

The Globalization (Americanization?) Of Executive Pay, Randall Thomas, Brian R. Cheffins

Vanderbilt Law School Faculty Publications

In the United States, the remuneration packages of top executives are characterized by a strong emphasis on pay-for-performance and by a highly lucrative "upside." There is much discussion of the possibility that executive pay practices will globalize in accordance with this pattern. This Article assesses whether such convergence is likely to occur. After surveying briefly the key components of managerial remuneration and after examining the essential elements of the "U.S. pay paradigm," the Article considers market-oriented dynamics that could constitute a "global compensation imperative." These include wider dispersion of share ownership, more cross-border hiring of executives, growing international merger and …
