The Distinctiveness Of Trial Narrative, Robert P. Burns Sep 2004

The Distinctiveness Of Trial Narrative, Robert P. Burns

Public Law and Legal Theory Papers

Scholars have drawn on the rich literature on narrative in their research into the American trial, a perspective at least implicitly endorsed by the United States Supreme Court in the Old Chief case. This is all to the good. However, the real power of the "narrative approach" emerges when one thinks concretely about what is distinctive to the different kinds of narrative employed at trial. This article explores the rhetorical and epistemological significance of trial narrative in the full context of the "consciously structured hybrid" of language practices that make up the American trial. Such a perspective enables us to …

Bioinformatic Analysis Of A Mammalian Bip Gene For Insertion Into Green Algae And Comparison Of Its Possible Effects On The Synthesis Of A Mammalian Antibody, Katrina Ghazanfar Sep 2004

Bioinformatic Analysis Of A Mammalian Bip Gene For Insertion Into Green Algae And Comparison Of Its Possible Effects On The Synthesis Of A Mammalian Antibody, Katrina Ghazanfar

Theses and Dissertations

This dissertation describes a study utilizing bioinformatics to analyze homologues of a molecular chaperone, glucose-regulated protein 78 (grp 78), also known as BiP. The selected homologous proteins originate from organisms of infinitely diverse genera. Comparisons of protein sequence yielded the first clues of a common ancestry among these proteins. Furthermore, protein molecular weights, isoelectric points, N-terminal amino acids and half-lives of a known homolog and a non-homologous protein were examined. Additionally, electroporation, a state-of-the-art plasmid insertion technique, was explored using Chlamydomonas reinhardtii, a green alga, as the recipient of a parent plasmid, pSP124S. Distinctive hypertonic solutions and three separate field …

Rethinking Regulatory Democracy, Mariano-Florentino Cuellar Sep 2004

Rethinking Regulatory Democracy, Mariano-Florentino Cuellar

ExpressO

This article empirically examines democratic participation in three different regulatory proceedings, involving financial privacy, nuclear regulation, and campaign finance. It then uses that analysis to critique -- and suggest alternatives to -- existing mechanisms to achieve public participation in the regulatory state. The current mechanism for structuring public participation in regulatory decisions (or “regulatory democracy”) relies on demand-driven procedures like the Administrative Procedure Act’s notice and comment process. Organized interests and others who decide they have sufficient resources and interest to do so comment on regulations. While some observers consider this process close to ideal, others instead seem to accept …

Montesquieu's Mistakes And The True Meaning Of Separation, Laurence Claus Sep 2004

Montesquieu's Mistakes And The True Meaning Of Separation, Laurence Claus

University of San Diego Public Law and Legal Theory Research Paper Series

“The political liberty of the subject,” said Montesquieu, “is a tranquility of mind arising from the opinion each person has of his safety. In order to have this liberty, it is requisite the government be so constituted as one man needs not be afraid of another.” The liberty of which Montesquieu spoke is directly promoted by apportioning power among political actors in a way that minimizes opportunities for those actors to determine conclusively the reach of their own powers. Montesquieu’s constitution of liberty is the constitution that most plausibly establishes the rule of law. Montesquieu concluded that this constitution could …

Supermajority Rules And The Judicial Confirmation Process, Michael B. Rappaport, John O. Mcginnis Sep 2004

Supermajority Rules And The Judicial Confirmation Process, Michael B. Rappaport, John O. Mcginnis

University of San Diego Public Law and Legal Theory Research Paper Series

In this paper we assess the effect of possible supermajority rules on the now contentious Senate confirmation process for judges. We deploy a formula for evaluating supermajority rules that we have developed in other papers. First, we consider a sixty-vote rule in the Senate for the confirmation of federal judges–an explicit version of the supermajority norm that may be emerging from the filibuster. While we briefly discuss how such a rule would affect the project of maximizing the number of originalist judges, for the most part we evaluate the rule on the realist assumption that judges will pursue their own …
