The Impact Of The Impact Bias On Negotiation, Chris Guthrie, David Sally
The Impact Of The Impact Bias On Negotiation, Chris Guthrie, David Sally
Vanderbilt Law School Faculty Publications
The theory of principled or problem-solving negotiation assumes that negotiators are able to identify their interests (or what they really want) in a negotiation. Recent research on effective forecasting calls this assumption into question. In this paper, which will appear in a forthcoming symposium issue of the Marquette Law Review devoted to the Emerging Interdisciplinary Canon of Negotiation, we explore the impact of this research on negotiation and lawyering.
Risk Realization, Emotion, And Policy Making, Chris Guthrie
Risk Realization, Emotion, And Policy Making, Chris Guthrie
Vanderbilt Law School Faculty Publications
In their study of terrorism and SARS, Professor Feigenson and his colleagues report "significant positive correlations between people's risk perceptions and their negative affect." In their review of the judgment and decision-making literature, Professor Slovic and his colleagues document the interplay between reason and emotion in assessing risk. And in the context of a soldier's concerns for himself and his family, Professor Moran provides a powerful narrative of fear. But what happens when such threats are actually realized? Do we accurately predict the emotional impact of such events? Or are there meaningful and predictable differences between the feelings we forecast …

Dartmouth Scholarship
We introduce the NOAO Fundamental Plane Survey (NFPS), a wide-field imaging/spectroscopic study of rich, low-redshift galaxy clusters. The survey targets X-ray–selected clusters at 0.010 < z < 0.067, distributed over the whole sky, with imaging and spectroscopic observations obtained for 93 clusters. This data set will be used in investigations of galaxy properties in the cluster environment and of large-scale velocity fields through the fundamental plane. In this paper, we present details of the cluster sample construction and the strategies employed to select early-type galaxy samples for spectroscopy. Details of the spectroscopic observations are reported. From observations of 5479 red galaxies, we present redshift measurements for 5388 objects and internal velocity dispersions for 4131. The velocity dispersions have a median estimated error ~7%. The NFPS has ~15% overlap with previously published velocity dispersion data sets. Comparisons to these external catalogs are presented and indicate typical external errors of ~8%.

Theater In The Courtroom, The Chicago Conspiracy Trial, Pnina Lahav
Theater In The Courtroom, The Chicago Conspiracy Trial, Pnina Lahav
Faculty Scholarship
The Chicago Conspiracy Trial (otherwise known as the Chicago Seven Trial) is a Rorschach test of American society in the late 1960s and early 1970s. Following the riots at the Democratic Convention in Chicago in 1968, leaders of the antiwar movement, the counterculture and the Black Panthers were put on trial for a "conspiracy to cross state lines with intent to incite a riot." The trial has been too easily dismissed as a circus, not worthy of legal attention, when in fact it does contain important legal insights. This paper suggests that the theory of the theater provides the key …
How Like A Winter? The Plight Of Absent Class Members Denied Adequate Representation, Susan P. Koniak
How Like A Winter? The Plight Of Absent Class Members Denied Adequate Representation, Susan P. Koniak
Faculty Scholarship
Class actions assume absent class members. 2 Notices in class actions tell class members that they need not show up in the courthouse, although they may if they choose.3 Class members are told that class counsel and the named class representatives will look out for them, although if they choose to hire their own lawyer, she may appear on their behalf.4 They are also routinely told that once the decision in the class action becomes final they will be bound by it, losing any and all right to protest the resolution of their claims by the class action …

Employment Discrimination Remedies And Tax Gross Ups, Gregg D. Polsky, Stephen F. Befort
Employment Discrimination Remedies And Tax Gross Ups, Gregg D. Polsky, Stephen F. Befort
Scholarly Works
This article considers whether a successful employment discrimination plaintiff may be entitled, under current law, to receive an augmented award (a gross up) to neutralize certain adverse federal income tax consequences. The question of whether such a gross up is allowed, the resolution of which can have drastic effects on litigants, has received almost no attention from practitioners, judges, and academics. Because of the potentially enormous impact of the alternative minimum tax (AMT) on discrimination lawsuit recoveries, however, the gross up issue is now beginning to appear in reported cases.
The three principal federal anti-discrimination statutes - Title VII, the …
Toward A Contractual Approach To Arbitral Immunity, Peter B. Rutledge
Toward A Contractual Approach To Arbitral Immunity, Peter B. Rutledge
Scholarly Works
This Article breaks from conventional wisdom in both case law and scholarship. It proposes a simple but novel thesis: Arbitrators and arbitral institutions, in cases of voluntary submission of disputes, should not be entitled to any form of legal immunity. Instead, any limit on or waiver of the arbitrator's or institution's liability should come in the form of a contractual release-either adopted in the parties' arbitration agreement or negotiated between the parties and the arbitrator.
Central to this thesis is a distinction between two types of immunity. The first form of immunity is “contractual immunity.” The hallmark of contractual immunity …

Servant Of The Story: Judas As Tragic Hero In Film, Kaile Shilling
Servant Of The Story: Judas As Tragic Hero In Film, Kaile Shilling
Journal of Religion & Film
Judas is perhaps best defined and best understood through mythic mediums such as story and film, as opposed to historical, scriptural studies that adhere strictly to the gospel texts alone. Judas, as seen in story and film, is not restricted to or defined exclusively by a series of actions that characterize him as a villain. Rather, especially in filmic depictions, he shifts from a villain to a tragic hero, and as such, allows for a fuller discussion of the various influences and choices with which Judas may have been faced than is possible in the genre of gospel text.

The Origins Of American Felony Murder Rules, Guyora Binder
The Origins Of American Felony Murder Rules, Guyora Binder
Journal Articles
Contemporary commentators continue to instruct lawyers and law students that England bequeathed America a sweeping default principle of strict liability for all deaths caused in all felonies. This Article exposes the harsh "common law" felony murder rule as a myth. It retraces the origins of American felony murder rules to reveal their modern, American, and legislative sources, the rationality of their original scope, and the fairness of their original application. It demonstrates that the draconian doctrine of strict liability for all deaths resulting from all felonies was never enacted into English law or received into American law. This Article reviews …

The Challenge Of Editing Einstein's Scientific Manuscripts, Tilman Sauer
Documentary Editing: Journal of the Association for Documentary Editing (1979–2011)
The Einstein Papers Project is a long-term editorial project devoted to publishing the Collected Papers of Albert Einstein (CPAE). The first volume was published by Princeton University Press in 1987 [CPAE1], followed by eight more volumes to date [CPAE2j-[ CPAE9j. To complete the series, some twenty more volumes are anticipated during the next 30-40 years. The documentary edition of the CPAE is supplemented by an English translation series. In addition to these publications in b09k format, the project has launched a website jointly with the Albert Einstein Archives of the Hebrew University of Jerusalem. Known as Einstein Archives Online (www.alberteinstein.info). …
