The Constitution In Two Dimensions: A Transaction Cost Analysis Of Constitutional Remedies. , Eugene Kontorovich Oct 2004

The Constitution In Two Dimensions: A Transaction Cost Analysis Of Constitutional Remedies. , Eugene Kontorovich

George Mason University School of Law Working Papers Series

This Article reveals the underappreciated role of liability rules in constitutional law. Conventional constitutional theory insists that constitutional entitlements require, by their nature, property rule protection. That is, they can only be taken with the owner's consent; nonconsensual takings can be enjoined. This Article shows that many constitutional values are in fact protected by liability rules, which allow for forced transfers followed by payment of compensation. Substantive entitlements form one dimension of constitutional law. The various ways in which they are protected against transfers form the second dimension. The full picture of constitutional law only emerges from looking at both. …

Analysis And Comparison Of Three Acoustic Energy Density Probes, Lance Lester Locey Oct 2004

Analysis And Comparison Of Three Acoustic Energy Density Probes, Lance Lester Locey

Theses and Dissertations

Traditional methods for the investigation of sound fields generally rely on a microphone to convert sound pressure into an electrical signal which can be recorded, displayed, and so forth. The squared sound pressure is directly related to potential energy density. Consequently, the measurement of sound pressure alone does not inherently provide insight into the total energy density of the sound field. Specifically, no information about the kinetic energy density of the sound field is available from this measurement alone. However, it is possible to use two microphones to estimate particle velocity. The squared particle velocity magnitude is directly related to …

A Survival Guide For Small Businesses: Avoiding The Pitfalls In International Dispute Resolution, Susan Franck

Scholarly Articles in Law Reviews & Journals

In the past decade, the number of small, entrepreneurial businesses participating in the global economy has tripled. With this increase comes a rise in the number of cross-border commercial disputes. The unwary small business, not familiar with international transactions, may commit errors that adversely affect their ability to do and stay in business. This article focuses on analyzing which methods small businesses should use in constructing their dispute resolution provisions and how to avoid errors in drafting and negotiation.

Stabilizing Moduli With String Cosmology, Scott Watson Oct 2004

Stabilizing Moduli With String Cosmology, Scott Watson

Physics - All Scholarship

In this talk I will discuss the role of finite temperature quantum corrections in string cosmology and show that they can lead to a stabilization mechanism for the volume moduli. I will show that from the higher dimensional perspective this results from the effect of states of enhanced symmetry on the one-loop free energy. These states lead not only to stabilization, but also suggest an alternative model for cold dark matter. At late times, when the low energy effective field theory gives the appropriate description of the dynamics, the moduli will begin to slow-roll and stabilization will generically fail. However, …

A Case Study Of Teaching A Quantitative Course Using Archived Streaming Video, Paul Savory

Department of Industrial and Management Systems Engineering: Faculty Publications

This case study highlights some of the issues and difficulties experienced in teaching a quantitative course using three methods of delivery: in-class to an audience of students, television broadcast over a satellite system to distance students, and archived streaming video accessible by students. The discussion is applicable to administrators and faculty exploring the option of teaching a course using multiple delivery approaches.

Coagu-Flocculation Mechanism Of Flocculant And Its Physical Model, Zhan Hanhui, Zhang Xiaoqi, Zhan Xuehui Oct 2004

Coagu-Flocculation Mechanism Of Flocculant And Its Physical Model, Zhan Hanhui, Zhang Xiaoqi, Zhan Xuehui

Separations Technology VI: New Perspectives on Very Large-Scale Operations

On the basis of summarizing and analyzing the theory of coagu-flocculation and its practical application, this paper proposes a physical model for coagu-flocculation. The model defines the process of coagu-flocculation as three steps: mixing, coagulation and flocculation, though there is no strict distinction in the practical processes themselves. Through experiment, two facts are verified: (1) with organic flocculants mixing and flocculation occur substantially in the same step, and need strong mixing intensity; while with inorganic flocculants much weaker mixing intensity is needed; (2) so as to ensure big floccules are formed, weaker mixing for a certain period of time is …

Lawmaking By Public Welfare Professionals, Margaret F. Brinig Oct 2004

Lawmaking By Public Welfare Professionals, Margaret F. Brinig

ExpressO

In an era of shrinking state and local resources for domestic violence prevention and detection, governments face a critical question of how to best allocate scarce funds. This paper suggests some answers for treating violence by caregivers and presents a model for evaluating other programs. To reach our conclusions, we analyzed data and survey results supplied by more than 1700 county-level adult protective services (APS) authorities.

We found that some expensive programs produce very few results in terms of reporting, investigating, and substantiating elder abuse. For example, requiring a specific education or experience level (and therefore guaranteeing higher salaries) or …

An Ex-Ante View Of The Battle Of The Forms: Inducing Parties To Draft Reasonable Terms, Omri Ben-Shahar Oct 2004

An Ex-Ante View Of The Battle Of The Forms: Inducing Parties To Draft Reasonable Terms, Omri Ben-Shahar

Law & Economics Working Papers Archive: 2003-2009

This paper focuses on one type of ex-ante effect of the battle of the forms: the incentive to draft reasonable boilerplate terms. It argues that the experience with the battle-of-the-forms rule under the CISG reinforces what we already know, that existing legal solutions do not provide any incentive for the parties to draft reasonable forms. The paper suggests that the goal of inducing parties to draft reasonable terms can be significantly promoted by a third rule, a variant of the “best-shot” rule proposed by Victor Goldberg. Under the version labeled the “reasonable-shot” rule, the court would resolve the battle of …

Effective Strategies For Comprehensive Corridor Management, Kristine M. Williams, Karen E. Seggerman Oct 2004

Effective Strategies For Comprehensive Corridor Management, Kristine M. Williams, Karen E. Seggerman

Transportation Planning, Policy, and Processes (TP3) Final Reports

Despite the increasing importance of comprehensive corridor management at the state and local government level, questions remain regarding effective methods for developing and implementing corridor management plans. Further insight is also needed into how best to coordinate FDOT and local government policies and procedures. Obtaining answers to these questions is important to managing land development and access on the Florida’s newly design Strategic Intermodal System (SIS) and other state highways. This study documents success stories in comprehensive corridor management and identifies best practices that can be applied by the Florida Department of Transportation, metropolitan planning organizations, and local governments. The …

Technology For Humanitarian Action, Kevin M. Cahill, M.D. Oct 2004

Technology For Humanitarian Action, Kevin M. Cahill, M.D.

Institute of International Humanitarian Affairs

Humanitarian workers around the world struggle under dangerous conditions. Yet many do not have the technological tools readily available elsewhere to help them realize their mission to provide essential services and save lives.

This book, the fruit of a historic conference, is a practical guide to current technologies that can help relief and humanitarian aid workers succeed. Designed to facilitate needed technology transfer to the humanitarian sector, the essays focus on areas where technology is underused and predict where new technological advances may be applied to relief efforts.

The essays cover essential areas: communications technology and infrastructure support and security. …

Consumption Asymmetry And The Stock Market: Empirical Evidence, Nicholas Apergis, Stephen M. Miller Oct 2004

Consumption Asymmetry And The Stock Market: Empirical Evidence, Nicholas Apergis, Stephen M. Miller

Economics Working Papers

This paper examines whether U.S. stock-market wealth asymmetrically affects consumption. After identifying asymmetric behavior for consumption and stock market wealth, the results confirm that stock-market wealth asymmetrically affects real per capita consumption. Negative 'news' affects consumption more than positive 'news'.

The Discontinuous Nature Of Kriging Interpolation For Digital Terrain Modeling, Thomas H. Meyer Oct 2004

The Discontinuous Nature Of Kriging Interpolation For Digital Terrain Modeling, Thomas H. Meyer

Thomas H. Meyer's Peer-reviewed Articles

Kriging is a widely employed method for interpolating and estimating elevations from digital elevation data. Its place of prominence is due to its elegant theoretical foundation and its convenient practical implementation. From an interpolation point of view, kriging is equivalent to a thin-plate spline and is one species among the many in the genus of weighted inverse distance methods, albeit with attractive properties. However, from a statistical point of view, kriging is a best linear unbiased estimator and, consequently, has a place of distinction among all spatial estimators because any other linear estimator that performs as well as kriging (in …
