Bilingualism And Equality: Title Vii Claims For Language Discrimination In The Workplace, James Leonard Oct 2004

Bilingualism And Equality: Title Vii Claims For Language Discrimination In The Workplace, James Leonard

University of Michigan Journal of Law Reform

Linguistic diversity is a fact of contemporary American life. Nearly one in five Americans speak a language other than English in the home, and influxes of immigrants have been a constant feature of American history. The multiplicity of languages in American society has touched nearly all aspects of American culture, and specifically has added new and important challenges to the American workplace. Chief among these new concerns are the growing number of legal claims centered around language discrimination in the workplace. The common vehicle for these claims has been Title VII, and there is considerable support in the academic literature …

The Public And Private Faces Of Derivative Lawsuits, Robert B. Thompson, Randall S. Thomas Oct 2004

The Public And Private Faces Of Derivative Lawsuits, Robert B. Thompson, Randall S. Thomas

Vanderbilt Law Review

Are shareholder derivative suits at death's door? Once described as "the most important procedure the law has yet developed to police the internal affairs of corporations,"' derivative suits are today regularly portrayed as nuisance suits whose "principal beneficiaries ... are attorneys." Even if these critics are wrong, there may now be less need for derivative suits, as other forms of representative suits have grown up that do much of their work. Federal securities fraud class actions increasingly address legal claims that raise issues about management care, and fiduciary duty class actions under state law are the principal litigation vehicle to …

A Review Of Gender And Full-Range Leadership Research And Suggestions For Future Research, Kelli K. Smith, Gina S. Matkin, Susan Fritz

Department of Agricultural Leadership, Education, and Communication: Faculty Publications

In this paper the research on gender and Full-Range Leadership is documented and explored. Included is consideration of research that studied Full-Range Leadership directly as well as indirect study that contributed to the field of research on Full-Range Leadership. The paper culminates in a series of recommendations for future research. It is hoped that these will help to move the field from documenting the differences or similarities of leadership (or perceptions of leadership) between women and men, to studying why these differences might exist. Additional recommendations are included that will help transport the value of this research from the pages …

The Muddled Duty To Disclose Under Rule 10b-5, Donald C. Langevoort, G. Mitu Gulati Oct 2004

The Muddled Duty To Disclose Under Rule 10b-5, Donald C. Langevoort, G. Mitu Gulati

Vanderbilt Law Review

Because the federal securities laws are, at heart, about disclosure, the question of whether and when there is a duty to disclose is often the central question in any given case. Certainly, the Securities & Exchange Commission (SEC) has broad powers to compel disclosures by issuers and certain others and has crafted a mandatory disclosure regime that creates many explicit duties. For a variety of reasons, however, this explicit regime falls short of a comprehensive answer to the duty question. For some sixty years now, the hardest duty questions have been addressed under the rubric of fraud, mainly under Rule …

Punishment: Benefits, Risks, And Alternatives In A Business Setting, Chris Vaden Oct 2004

Punishment: Benefits, Risks, And Alternatives In A Business Setting, Chris Vaden

Senior Honors Theses

Punishment is utilized in many settings in the world today, but it is continually getting more negative responses for its use in the workplace. Punishment's main use is to decrease the occurrence of a behavior that is undesirable. In a business setting, this would most likely be a behavior that is a violation of policy or unsatisfactory work performance. A comparison of the positive aspects of punishment with its negative features, by utilizing information provided by scholarly journals and websites along with a survey of 31 employees, has yielded the results that there may be a better alternative to punishment.

External Influences Of Children's Socialization To Gender Roles, Sarah A. Chartschlaa Oct 2004

External Influences Of Children's Socialization To Gender Roles, Sarah A. Chartschlaa

Senior Honors Theses

It is evident in North American society that there are certain roles placed on boys and girls in accordance with their gender. These gender roles are imposed on children from birth and are taught until eventually they are accepted as absolute truth. Newborn babies are carried out of the hospital in either a pink blanket or a blue blanket depending on gender. Gifts of trucks or dolls are given to toddlers depending on the child's sex. Stories about princesses are read to little girls, while stories of dragons and swords are read to little boys. This socialization of gender roles …

Church Growth Consulting: Focusing On The ‘Main’ Thing Or Boosting The Reproductive Quotient, R. Daniel Reeves Oct 2004

Church Growth Consulting: Focusing On The ‘Main’ Thing Or Boosting The Reproductive Quotient, R. Daniel Reeves

Journal of the American Society for Church Growth

In this article, I want to challenge the complexity and mechanism of some of the consulting practices we have used and show how important it is to “keep our eye on the ball,” and focus on the “main thing,” – the “reproductive quotient.” What is the reproductive quotient? Very simply it is that evidence or measure that shows a congregation that it is meeting its God given assignment of winning and making disciples of Jesus Christ. As we help a congregation to raise its “reproductive quotient,” we focus attention on four specific areas – reproducing new disciples, new leaders, new …

Spirituality In Limbo: An Observation And Analysis Of Mongolia’S Modern Religious Climate, Dustin Saldarriaga Oct 2004

Spirituality In Limbo: An Observation And Analysis Of Mongolia’S Modern Religious Climate, Dustin Saldarriaga

Independent Study Project (ISP) Collection

This paper is essentially a history of religion in Mongolia with the purpose of illuminating the present state of religion at a socially, culturally, and politically unique point in Mongolia’s history. It has only been fourteen years since Mongolia experienced a political transition from totalitarianism to democracy, and the country now finds itself in a kind of “Limbo” with respect to not only the political state of the nation, but also the spiritual state of its individuals. The result is a religious climate filled with uncertainty and speculation, but also with passion and love. I attempt to explore this current …

Finding The Door In The Mirage: The Politics Of Cultural Change In Mongolia, Evan Buxbaum Oct 2004

Finding The Door In The Mirage: The Politics Of Cultural Change In Mongolia, Evan Buxbaum

Independent Study Project (ISP) Collection

In 1996, as the Mongolian delegation entered the Olympic arena in Atlanta, a Russian announcer let his tongue slip and heralded the country as a true independent nation, because nobody depends on them. The comment triggered a scandal which was suppressed under a deluge of meaningless public apologies, yet merely eight years later, the Russian announcer’s insult seems to barely even apply anymore. With Mongolia’s entrance into the international community of interdependents, free from dictatorial control for the first time during the age of globalization, it has plunged into an era of change. The outcome of this transitional period will …

Indigenous Healing Practices And Their Effect On Tb And Hiv/Tb Patients’ Utilization And Compliance With Anti-Tb Medication, Josephine Thinwa

Independent Study Project (ISP) Collection

A sample of 27 Tuberculosis patients attending New Brighton Clinic in small urban community for treatment were surveyed and interviewed on their use of alternative treatments and interpretation of TB. This study specifically focused on TB patients’ use of traditional medicine in treating TB and whether this use had an effect on the patients’ willingness to utilize and adherence to anti-TB treatment from the clinic. Investigations were also done to characterize if an HIV positive status influenced TB patients’ inclination to utilize traditional medicine. Through a focus group discussion with three traditional healers, information was provided on traditional medicine and …

Managing The Commons Through Obligation: Communality In The Sierra Juárez Of Oaxaca, Katie Moyer Oct 2004

Managing The Commons Through Obligation: Communality In The Sierra Juárez Of Oaxaca, Katie Moyer

Independent Study Project (ISP) Collection

As one of the most ethnically, culturally, and biologically diverse states in the Mexican Republic, Oaxaca proved to be a good location to learn about alternative forms of social organization. With 570 municipalities, Oaxaca has 23% of the municipalities in the entirety of Mexico. The vast majority of Oaxaca’s municipalities—480—are politically and socially organized through communality, a traditional form of self-government widely known as usos y costumbres (uses and customs). Within the four weeks allotted for this research project the majority of my time was spent in the Northern Sierra Juárez in the state of Oaxaca.

I first visited the …

Ich Rede, Wie Ich Mich Wohl Fühle: Language And Ethnic/Cultural Identity Among German-Born Young Adults Of Turkish Descent In Berlin, Emily R. Jenkins Oct 2004

Ich Rede, Wie Ich Mich Wohl Fühle: Language And Ethnic/Cultural Identity Among German-Born Young Adults Of Turkish Descent In Berlin, Emily R. Jenkins

Independent Study Project (ISP) Collection

My study consisted of ethnographic interviews with young adults ages 19-28, who were born and raised in Germany to parents emigrated from Turkey. My main research question was, “What role does language play in the subjects’ conception of ethnic/cultural identity?” Specifically, I focused on the role of language in how subjects identify with or distinguish themselves from: (1) the ethnic/cultural majority in their country of residence, i.e. Germans; (2) the ethnic/cultural majority in their parents’ country of origin, i.e. Turks in Turkey; and (3) others of similar immigration background, i.e. other German-born people of Turkish descent. Originally I only intended …

The Depoliticization Of Czech Female Art, Roya Amirsoleymani Oct 2004

The Depoliticization Of Czech Female Art, Roya Amirsoleymani

Independent Study Project (ISP) Collection

Contemporary Czech art is heavily influenced by a history of Communism, the 1989 transition to capitalism, and the impact had on visual culture by the political and economic changes after the Velvet Revolution. Czech female art, defined as art made by women that is informed by themes of female identity, image, the body, sexuality, feminism, sexual identity, and gender theory, responds to how female identity has been affected by these social changes. This essay argues that Czech female art is depoliticized by its artists, through either neglect or resistance to political connotations and ramifications, but that it is simultaneously engaged …

Initial Visions Of Paradise: Antebellum U.S. Government Documents On The South Pacific , Bert Chapman Oct 2004

Initial Visions Of Paradise: Antebellum U.S. Government Documents On The South Pacific , Bert Chapman

Libraries Research Publications

During the first half of the 19th century, the United States grew from a nation confined to the Atlantic seaboard to a country on the verge of becoming a global power. One factor prompting this growth was the United States’ growing intellectual, economic, and strategic interests in the Pacific Ocean. These growing interests were fueled by the material contained in governmental reports produced by entities such as the U.S. Exploring Expedition (1838–1842). This article examines U.S. government documents on the South Pacific ocean prior to the Civil War, how such documents contributed to the creation of the Smithsonian Institution, and …

This report describes the rationale, approaches, organization, and resource development leading to a large-scale deletion bin map of the hexaploid (2n = 6x = 42) wheat genome (Triticum aestivum L.). Accompanying reports in this issue detail results from chromosome bin-mapping of expressed sequence tags (ESTs) representing genes onto the seven homoeologous chromosome groups and a global analysis of the entire mapped wheat EST data set. Among the resources developed were the first extensive public wheat EST collection (113,220 ESTs). Described are protocols for sequencing, sequence processing, EST nomenclature, and the assembly of ESTs into contigs. These contigs plus singletons …

Fish Assemblage Stability Over Fifty Years In The Lake Pontchartrain Estuary; Comparisons Among Habitats Using Canonical Correspondence Analysis, Martin O'Connell, Robert Cashner, Christopher Schieble Oct 2004

Fish Assemblage Stability Over Fifty Years In The Lake Pontchartrain Estuary; Comparisons Among Habitats Using Canonical Correspondence Analysis, Martin O'Connell, Robert Cashner, Christopher Schieble

Earth and Environmental Sciences Faculty Publications

We assessed fish assemblage stability over the last half century in Lake Pontchartrain, an environmentally degraded oligohaline estuary in southeastern Louisiana. Because assemblage instability over time has been consistently associated with severe habitat degradation, we attempted to determine whether fish assemblages in demersal, nearshore, and pelagic habitats exhibited change that was unrelated to natural fluctuations in environmental variables (e.g., assemblage changes between wet and dry periods). Collection data from three gear types (trawl, beach seine, and gill nets) and monthly environmental data (salinity, temperature, and Secchi depth) were compared for four collecting periods: 1954 (dry period), 1978 (wet period), 1996–1998 …

Teaching Catholicism, As Easy As Play., Tj Lynch Oct 2004

Teaching Catholicism, As Easy As Play., Tj Lynch

Plymouth Institute of Education

In society, sport often connotes a religious reference. Sport as a medium for learning is directly related to the curriculum key learning area of Health and Physical Education (HPE), as it can be used as a vehicle for teaching the HPE concepts. The unique ‘learning through movement’ nature of HPE enables a focus on the physical dimension. Hence, sport interacts intimately with the strand ‘developing concepts and skills for physical activity’, which is embedded in the Queensland HPE syllabus. In the physical dimension students can be presented with many practical and social experiences that require acknowledgement and reflection upon Catholic …
