Gift From Mistress To Slave With An Empire's Tag: Language Of The Law In The Post-Colonial Matrices Of Derek Walcott's "Omeros", Jennifer J. Kramer Jan 2004

Gift From Mistress To Slave With An Empire's Tag: Language Of The Law In The Post-Colonial Matrices Of Derek Walcott's "Omeros", Jennifer J. Kramer

Electronic Theses and Dissertations 2000 - 2009

The text focuses on the language of the law in Omeros , which is defined as "the representation and expression of social order, principles, morality, conscience, and conduct of a community or nation." The language of the law is inherent in the dynamics of the Caribbean's hybrid, cultural community and is revealed through Walcott's characters. Walcott attempts to resolve how the colonial cultural system has maintained cultural and socio-economic authority in a politically independent West Indies. Walcott's characters view the language of the law and each other according to their cultural matrices. Helen is Walcott's key. Helen is the West …

Great Mind Is Androgynous: A Look At The Late Poetry Of Sylvia Plath Through Virginia Woolf's Theory Of The Androgynous Consciousness, Shilo R. Blackburn Jan 2004

Great Mind Is Androgynous: A Look At The Late Poetry Of Sylvia Plath Through Virginia Woolf's Theory Of The Androgynous Consciousness, Shilo R. Blackburn

Electronic Theses and Dissertations 2000 - 2009

The female subject in the late poetry of Sylvia Plath experiences a physical and intellectual transformation, as Plath attempts to challenge and redefine the social construction of woman through Virginia Woolf's influence. Plath aspires to achieve a poetic voice that embodies characteristics of both genders simultaneously, an androgynous consciousness by Woolf's account, and one that can speak despite Western culture's imposed inferiority of women writers. Since traditionally masculine language has defined women's social roles through their physical bodies, Plath's aim is to immerse her female subject in the experiences of her corporeal body as a means to transcend her physical …

Ideological Complexity Of Kipling, Jonathan D. Noble Jan 2004

Ideological Complexity Of Kipling, Jonathan D. Noble

Electronic Theses and Dissertations 2000 - 2009

The works of Kipling are generally read under the discursive ideology of Orientalism. According to Edward Said, Orientalism is an institution for dominating the Orient with Foucauldian power/knowledge. While much of Kipling's work falls easily within the lines of Orientalism, important exceptions disrupt this singular reading. The hybrid character Kim, for example, demonstrates an uncertainty concerning the identity of the Anglo-Indian as colonizer constructed along racial lines, where white Anglo-Indian represents colonizer and brown Indian represents colonized. This simplified racial division is further problematized by Kipling's attention to social class in other works of prose and verse, which place the …

Implementation Of Digital Filters With Labview, Thomas. Landrin Jan 2004

Implementation Of Digital Filters With Labview, Thomas. Landrin

Electronic Theses and Dissertations 2000 - 2009

In this thesis, realization and implementation of one-dimensional (1-D) and two-dimensional (2-D) recursive digital filters using LabVIEW are presented. A number of direct and state-space realizations for 1-D filters are implemented either as in general form or second-order modules. Implementation programs are provided and simulation results are presented to show the effectiveness of the proposed method. In addition, several realizations for 2-D separable-in-denominator filters are proposed. These realizations have the properties of highly parallel structure and improved throughput delay. The performance as well as the implementation of 2-D filters using LabVIEW is also presented.

"And Yet God Has Not Said A Word!": Robert Browning And The Romantic Killer In Literature, Erin. Burns-Davies Jan 2004

"And Yet God Has Not Said A Word!": Robert Browning And The Romantic Killer In Literature, Erin. Burns-Davies

Electronic Theses and Dissertations 2000 - 2009

Robert Browning's dramatic monologues often characterize the darker aspect of romantic love through speakers who demonstrate their devotion to violence. Exploring the innovations in discourse, Browning gives his narrators voices that allow them to speak from an ancient literary tradition. For Browning's speakers, words make the silencing of the lover either the act of ultimate devotion or the result of disappointed expectations. The narrator speaks of the absence of God, as when Porphyria's lover holds her body to him: "and yet God has not said a word!" With the poet's strong speech---in all his attractiveness, his destructive display of love …

Socratic Pedagogy, Critical Thinking, Moral Reasoning And Inmate Education: An Exploratory Study, Peter Boghossian Jan 2004

Socratic Pedagogy, Critical Thinking, Moral Reasoning And Inmate Education: An Exploratory Study, Peter Boghossian

Dissertations and Theses

This exploratory study examines the hypothesis that Socratic pedagogy is a useful tool for imparting critical thinking and moral reasoning skills to inmates. The study explores the effectiveness of a new curriculum, Introducing Socrates, which relies on Socratic pedagogy to achieve its objectives. The curriculum draws from the effective criminal justice research on cognitive education to determine its objectives, and then looks to the Platonic dialogues to find broad philosophical questions that tie into those objectives. The program also evaluates salient criticisms of Socratic pedagogy that are found in the educational and philosophical literature, and then isolates and evaluates constructs …

Lawsuit Abandonment Options In Possibly Frivolous Litigation Games, Peter H. Huang Jan 2004

Lawsuit Abandonment Options In Possibly Frivolous Litigation Games, Peter H. Huang

Publications

This paper develops a new theory of possibly frivolous litigation by focusing on a plaintiff's options to unilaterally abandon a lawsuit. Federal Rule of Civil Procedure 41(a)(1)(i) and its various state law counterparts permit, under certain circumstances, a plaintiff to voluntarily dismiss her lawsuit without prejudice. This paper's options approach to litigation, including quite possibly, frivolous litigation is placed in the context of the literature of economic models about litigation in general and frivolous litigation in particular. This paper demonstrates that possibly frivolous lawsuits will be filed and settled when the values of a plaintiff's options to unilaterally abandon litigation …

Not For Attribution: Government's Interest In Protecting The Integrity Of Its Own Expression, Helen Norton Jan 2004

Not For Attribution: Government's Interest In Protecting The Integrity Of Its Own Expression, Helen Norton

Publications

Public entities increasingly maintain that the First Amendment permits them to ensure that private speakers' views are not mistakenly attributed to the government. Consider, for example, Virginia's efforts to ban the Sons of Confederate Veterans' display of the Confederate flag logo on state-sponsored specialty license plates. Seeking to remain neutral in the ongoing debate over whether the Confederate flag is a symbol of "hate" or "heritage," Virginia argued that the state would be wrongly perceived as endorsing the flag if the logo appeared on a state-issued plate adorned by the identifier "VIRGINIA." The Fourth Circuit was unpersuaded, holding that the …

Protecting The Lady From Toledo: Post-Usa Patriot Act Electronic Surveillance At The Library, Susan Nevelow Mart Jan 2004

Protecting The Lady From Toledo: Post-Usa Patriot Act Electronic Surveillance At The Library, Susan Nevelow Mart

Publications

Library patrons are worried about the government looking over their shoulder while they read and surf the Internet. Because of the broad provisions of the USA PATRIOT Act, the lack of judicial and legislative oversight, the potential for content overcollection, and the ease with which applications for pen register, section 215 orders, or national security letters can be obtained, these fears cannot be dismissed.

Two Wrongs Make A Right: Hybrid Claims Of Discrimination, Ming Hsu Chen Jan 2004

Two Wrongs Make A Right: Hybrid Claims Of Discrimination, Ming Hsu Chen

Publications

This Note reinterprets and recontextualizes the pronouncement in Employment Division v. Smith (Smith II) that exemptions from generally applicable laws will not be granted unless claims of free exercise are accompanied by the assertion of another constitutional right. It argues that when Arab American Muslims, and others who are of minority race and religion, bring claims for exemption from generally applicable laws on the basis of free exercise and equal protection principles, they ought to be able to invoke Smith II's hybridity exception, thus meriting heightened judicial scrutiny and increased solicitude from courts.

Righting Victim Wrongs: Responding To Philosophical Criticisms Of The Nonspecific Victim Liability Defense, Aya Gruber Jan 2004

Righting Victim Wrongs: Responding To Philosophical Criticisms Of The Nonspecific Victim Liability Defense, Aya Gruber

Publications

Modern criminal law is intensely one-sided in its treatment of victims and defendants. Crime victims and criminal defendants do not enter the trial process on an equal moral footing. Rather, from the beginning victims are assumed blameless, truthful, and even beyond doubt, while defendants are guilty, not worthy of credence, and immoral. This one-sided view of victims, however, is a fiction. As any other people, victims differ in their characterizations. Some are indeed trustworthy, truthful, blameless and ultimately innocent. Others, however, are bad actors themselves, have memory failures, falsely identify, provoke, and even lie. Some victims are in fact, and …

Methods Of Filicide: Stepparents And Genetic Parents Kill Differently, Viviana A. Weekes Jan 2004

Methods Of Filicide: Stepparents And Genetic Parents Kill Differently, Viviana A. Weekes

Electronic Theses and Dissertations 2000 - 2009

Stepparents commit filicide at higher rates than do genetic parents. According to M. Daly and M. I. Wilson (1994), motivational differences generate differences in the methods by which stepparents and genetic parents kill a child. Using Canadian and British databases, Daly and Wilson (1994) found that stepfathers were more likely than genetic fathers to commit filicide by methods revealing feelings of bitterness and resentment not present to the same degree in genetic fathers. Genetic fathers, in contrast, were more likely than stepfathers to commit filicide by methods that often produce a quick and less painful death. Results replicate and extend …

The study applied the principles of Critical Discourse Analysis and Critical Pedagogy in studying the impact of artistic and hegemonic communication on student achievement. The purpose of the study was to critically analyze the language discourse of educational leaders and to determine the extent to which the language discourse contributes to the persistence of the achievement gap and the continuing marginalization of diverse groups of children. This research study offers a practical set of recommendations on how to use the process of critical discourse analysis to arrive at more …

Negotiation Of Meaning In Interlanguage Talk, Friederike A. Tegge Jan 2004

Negotiation Of Meaning In Interlanguage Talk, Friederike A. Tegge

Electronic Theses and Dissertations 2000 - 2009

This small-scale study investigated the extent to which negotiations of meaning during methodologically focused communicative partner-activities were concerned with a grammatical target structure, the dative case following spatial prepositions in German. In addition, the impact of the negotiation of the target structure on subsequent learner performance was investigated. The subjects, beginning-level students of German, participated in two two-way information-gap activities, preceded and followed by the same grammaticality judgment test. The interaction was audiotaped and transcribed. The improvement in accuracy between the pretest and the posttest was calculated and correlated with the number of negotiation moves. The results indicate that the …

Nest Placement By Three Species Of Sea Turtles In Southeast Florida, Usa, Lawrence D. Wood Jan 2004

Nest Placement By Three Species Of Sea Turtles In Southeast Florida, Usa, Lawrence D. Wood

Electronic Theses and Dissertations 2000 - 2009

Studies of loggerhead, leatherback and green turtle nest distribution across beaches (between water and dune) have revealed conflicting random versus non-random patterns of nest placement. I examined nest placement on a southeast Florida beach (Juno and Jupiter) with average beach widths of 30 (natural) and 90 m (nourished beach) and tested slope as a proximal cue for nesting using long-term data sets and GPS technology. All three species had similar species-specific crawl lengths and nest sites relative to distance from water, regardless of beach width. Loggerheads and leatherbacks crawled and nested significantly shorter median distances (8--14 m) relative to the …
