Two Wrongs Make A Right: Hybrid Claims Of Discrimination, Ming Hsu Chen

This Note reinterprets and recontextualizes the pronouncement in Employment Division v. Smith (Smith II) that exemptions from generally applicable laws will not be granted unless claims of free exercise are accompanied by the assertion of another constitutional right. It argues that when Arab American Muslims, and others who are of minority race and religion, bring claims for exemption from gen erally applicable laws on the basis of free exercise and equal protection principles, they ought to be able to invoke Smith Il's hybridity exception, thus meriting height ened judicial scrutiny and increased solicitude from courts.

This applied dissertation was designed to improve the support of beginning teachers at University School of Nova Southeastern University, a private high school. Veteran teachers, administrators, and support staff were not adequately prepared to integrate the beginning teachers who were rapidly leaving for employment elsewhere. There had been no attempt to identify their needs or evaluate their support system. Therefore, school leaders did not have the information necessary to address the retention problem.

This applied dissertation was designed to gain better understanding for the integration of the Reggio Emilia philosophy into the Early Childhood Education Endorsement program at a teacher preparation institution.
The methodology that was used included class discussion, observation, deconstruction of the Reggio Emilia principles, reflective practice, collaboration meetings, interviews, and field trips. The findings confirmed the findings in reviewed literature that the image and role of the preservice teachers should be that of an active apprentice not as an object of instruction.
Generalization of the findings to other teacher preparation programs must be done with caution because of the limitations …

Improving African American Males’ Academic And Social Success Through Implementation Of An Alternative Classroom Setting, Kenneth E. Daniels Jr

In school year 2001, African American males at Swainsboro Elementary School in Swainsboro, Georgia, comprised 51% of total discipline referrals. Numbers were even higher in 2002 and 2003, those being 58% and 70%, respectively. Studies suggested that African American males are the most at-risk group in modern society because of lack of role models, lack of cultural identity, and lack of appropriate social skill development that would reduce social conflicts.
The intervention model contained in this applied dissertation addressed the areas of conflict resolution and social skills development, cultural awareness, and mentoring. Participating students were placed in an alternative setting …

Teachers’ educational backgrounds and professional development are positive predictors of program quality while teacher turnover is a negative predictor of program quality. Recent research suggests a significant link between teacher turnover and opportunities for professional development. The supposition is that, if the early childhood field could increase the quality of professional development training, then the level of teacher turnover could be reduced. Therefore, nonparticipation in professional development training opportunities is a critical issue in the early childhood industry.

The Cooperative Education and Internships program is charged with placing students in positions that will allow them to gain experience in a work environment related to their major area of study. Job development specialists receive no type of written feedback from the employer, the faculty advisor, or the student on whether or not the placement was successful. This applied dissertation was designed to improve the implementation of early intervention therapy services in natural environments. Active caregiver participation during therapy is vital to the success of early intervention. However, the caregivers of infants and toddlers with developmental delays who were receiving early intervention therapy from an agency that served three counties in the southeastern United States were not actively participating in the implementation of the Individualized Family Service Plans (IFSPs).

This applied dissertation was designed to increase the integration of technology in the academic classrooms of an independent college preparatory school. Technology had been introduced to the faculty in a random manner. Some teachers embraced technology, some were accepting but unknowing, and some were vocally resistant. There was no plan to present an administrative vision to the faculty in order to support a framework for technology integration, to provide a professional development program, to establish standards for teacher competency, or to determine an assessment process. This applied dissertation was designed to increase the amount of team-planning time and classroom proximity provided to teaching teams at 1 middle school. The amount of time provided within the school day to each team for team planning was inadequate to meet the needs of effective teams. Additionally, teachers had been assigned to classrooms with little concern for team member proximity.

According to their mission statement, employees of the Family and Youth Counseling Agency, Inc., (FYCA) operated on the assumption that all individuals possessed the ability to solve their own challenges and live full and healthy lives when support was available. In practice, however, agency counseling reflected a deficit-based, hierarchical framework, wherein counselors expanded on clients’ deficits and failings, defined the goals of counseling, and regarded counselors as more knowing than clients about how best to change. By discrediting the client’s voice, counselors failed to put into action the agency’s guiding principle.

The major purpose of this study was to reduce the number of student discipline referrals in a suburban elementary school with a student population of approximately 830 in 2003. An analysis of the annual School Administrative Student Information System Discipline Report indicated that over the past two years (2000-2002), discipline referrals had increased by 44%.
The design most conducive for this applied research was a descriptive design. Pre- and postdata were compared to determine if there was a decrease in student discipline referrals. The problem was that the state of Georgia Women, Infants, and Children (WIC) Program was noncompliant with antidiscrimination laws and therefore, risked the loss of federal funds to operate the WIC Program. The purpose of this applied dissertation was to conduct a national survey of civil rights training programs with plans for development, implementation, and evaluation of training for Georgia WIC Program employees.

The Supreme Court’s long-awaited decisions this past summer in the Michigan affirmative action cases provided yet another landmark in the continuing controversy regarding race and education. A quarter century, almost to the day, after the Court handed down its badly splintered decision in Regents of the University of California v. Bakke,[1] the Court again concluded that universities may sometimes, but not always, give some preference to racial and ethnic minorities in deciding whom to admit. The Court, in a 5-4 decision in Grutter v. Bollinger, upheld the constitutionality of the University of Michigan Law School’s admission policy that considered race …

Images Of Health Insurance In Popular Film: The Dissolving Critique, Elizabeth Pendo

Several recent films have villainized the health insurance industry as central elements of their plots. This Article examines three of those films: Critical Care, The Rainmaker, and John Q. It analyzes these films through the context of the consumer backlash against managed care that began in the 1990s and shows how these films reflect the consumer sentiment regarding health insurance companies and the cost controlling strategies they employ. In addition, the Article identifies three key premises about health insurance in the films that, although exaggerated and incomplete, have significant factual support. Ultimately, the author argues that, despite their passionately critical …
