The Trial Court's Gatekeeper Role Under Frye, Daubert, And Kumho: A Special Look At Children's Cases, John Eric Smithburn

Journal Articles

The typical requisites for receiving testimony from an expert witness are that the expert be qualified in a particular subject or area of expertise, that the expert testify in opinion form or otherwise, which will help the fact finder, and that there be a proper basis for the expert's testimony. This article examines the changing meaning in the law of evidence of the expert's subject area in cases involving children. During most of the last century, where the expert witness proposed to testify concerning a new or novel scientific system, process or technique, the court applied the rule of Frye …

Unfunding Terror - Perspectives On Unfunding Terror (Panel One), Jimmy Gurulé

Journal Articles

According to the FBI, the September 11, 2001 terrorist attacks against the World Trade Center and the Pentagon that claimed the lives of 2,973 innocent civilians required as much as $500,000 to stage. At the time, al Qaeda, the jihadi terrorist organization responsible for the mass killings, was operating on an annual budget between $30 and $50 million. However, despite the obvious fact that terrorists need money to support their terrorist operations and organizational infrastructure, prior to 9/11, preventing the financing of terrorism was not a priority for the United States or international community. Moreover, a comprehensive legal framework to …

The European corn borer, Ostrinia nubilalis (Hu¨ bner) (Lepidoptera: Crambidae), is a major pest of maize, Zea mays L., in many temperate parts of the world. Genotype-by-environment interaction effects can make relative performance unpredictable and may hamper selection for resistance to European corn borer. The objective of this study was to determine the effect of environment on genotypic reaction to European corn borer resistance in maize. A set of 12 maize inbred lines was chosen to represent a range of European corn borer responses. Eleven testing environments ranged from Delaware, Ohio, Illinois, Iowa, Nebraska, Missouri, to Mississippi. For length of …

Investigation Of Femtosecond Laser-Assisted Micromachining Of Lithium Niobate, A. Malshe, D. Deshpande, E. Stach, Kamlakar Rajurkar, Dennis R. Alexander

Department of Electrical and Computer Engineering: Faculty Publications

Lithium Niobate has a potential for applications in electronics and communication industries due to its unique electro-optical, piezoelectric and nonlinear properties. Femtosecond laser machining offers the best alternative to machine the mechanically fragile and optically delicate lithium niobate crystal. This paper reports a study of the effect of femtosecond laser machining on the surface integrity of lithium niobate. The transmission electron microscopy reveals a 100nm thin amorphous region and a void. The chemical analysis shows a loss of lithium and oxygen from the surface and sub-surface. Optical illumination facilitates the selective readout of the written spots of 2 microns size.

Reassessing The "Basel-Wittenberg Conflict": Dimensions Of The Reformation-Era Discussion Of Hebrew Scholarship, Stephen G. Burnett Jan 2004

Reassessing The "Basel-Wittenberg Conflict": Dimensions Of The Reformation-Era Discussion Of Hebrew Scholarship, Stephen G. Burnett

Department of Classics and Religious Studies: Faculty Publications

The study of Reformation-era Christian Hebraism has benefited from increased scholarly attention over the past fifty years. Sebastian Münster, Paul Fagius, Wolfgang Capito, and Conrad Pellican have all been the subjects of biographies. Luther scholars have analyzed not only Luther's use of Hebrew but to a lesser extent the Hebrew scholarship of Melanchthon, Bugenhagen, and Goldhahn. Historians of the book trade have provided analytic bibliographies and studies of prominent Christian Hebrew printers, including Heinrich Petri, Thomas Anselm, and Robert Estienne as well as studies of the Hebrew book trade in Augsburg and Basel. The role of Jewish scholars in facilitating …

Hope And Guidance For Parents Of Children With Ocd: A Review Of Freeing Your Child From Obsessive-Compulsive Disorder [Book Review Section], Richard J. Cowan, Susan M. Swearer Napolitano Jan 2004

Hope And Guidance For Parents Of Children With Ocd: A Review Of Freeing Your Child From Obsessive-Compulsive Disorder [Book Review Section], Richard J. Cowan, Susan M. Swearer Napolitano

Department of Educational Psychology: Faculty Publications

A favorable review of Freeing Your Child from Obsessive-Compulsive Disorder by T.E. Chansky (Crown Publishers, 2004). From the review: "Closely following March and Mulle's (1998) treatment protocol, this book is guided by the philosophy that an individual with OCD must “boss back” symptoms in order to break the symptom cycle. With this approach OCD is objectified (and externalized) as a “brain bully” or enemy that can be overcome with knowledge, determination, and support. Separating the child from his/her OCD symptoms is an effective, concrete technique that children and adolescents will readily comprehend. Such a tactic reminds parents that their child …

Guidelines For Managing Lesser Prairie-Chicken Populations And Their Habitats, Christian A. Hagen, Brent E. Jamison, Kenneth M. Giesen, Terry Z. Riley Jan 2004

Guidelines For Managing Lesser Prairie-Chicken Populations And Their Habitats, Christian A. Hagen, Brent E. Jamison, Kenneth M. Giesen, Terry Z. Riley

United States Geological Survey, Northern Prairie Wildlife Research Center: Publications

Lesser prairie-chicken (Tympanuchus paidicinctus) populations have declined by >90% since the 1800s. These declines have concerned both biologists and private conservation groups and led to a petition to list the lesser prairie-chicken as threatened under the Endangered Species Act. Most of the land in the current range of the lesser prairie-chicken is privately owned, and declines have been primarily attributed to anthropogenic factors. Conversion of native rangeland to cropland and excessive grazing have been implicated as leading causes in the species' decline. Periodic drought probably has exacerbated these problems. Little research on habitat requirements was conducted prior to …

Temporal Dynamics Of Leafy Sspurge (Euphorbia Esula) And Two Species Of Flea Beetles (Aphthona Spp.) Used As Biological Control Agents, Diane L. Larson, James B. Grace

United States Geological Survey, Northern Prairie Wildlife Research Center: Publications

The goal of this study was to evaluate the biological control program of leafy spurge (Euphorbia esula) in a large natural area, Theodore Roosevelt National Park, western North Dakota, USA. Aphthona lacertosa and Aphthona nigriscutis have been released at more than 1800 points in the 18,600-ha South Unit of the park beginning in 1989; most releases have occurred since 1994. We established permanent vegetation plots throughout the infested area of the park and determined stem counts and biomass of leafy spurge and abundance of the two flea beetle species at these plots each year from 1999 to 2001. …

Pest Control: Rodents, Mark E. Tobin, Michael W. Fall Jan 2004

Pest Control: Rodents, Mark E. Tobin, Michael W. Fall

United States Department of Agriculture Wildlife Services: Staff Publications

Rodents are an important and ubiquitous group of mammals that occur as indigenous or introduced species throughout the world. The populations of a relatively few species that live in close association with humans sometimes cause economic damage or become threats to the health of humans or domestic animals. When rodent control efforts are contemplated, the type of problem and the objectives of these efforts should be carefully defined. Successful management of rodent problems depends upon correct identification of the rodent species involved and on obtaining information on the biology, ecology, and behavior of the species in the ecological setting where …

Federal Listing Of Prairie Grouse: Lessons From The Attwater’S Prairie Chicken, Michael Morrow, Terry A. Rossignol, Nova J. Silvy

United States Geological Survey: Staff Publications

Considerable controversy has often surrounded proposals to confer official status (i.e., list) species under the authority of the Endangered Species Act (ESA) of 1973 as amended or its precursors. Recent proposals to list the lesser prairie-chicken (Tympanuchus pallidicinctus), the western sage grouse (Centrocercus urophasianus phaios), and the Gunnison sage grouse (C. minimus) were met with strong opposition by those concerned with prospects of an increased regulatory environment associated with such an action. The Attwater's prairie-chicken (T. cupido attwateri) was one of the first species listed under The Endangered Species Conservation Act of …

History Of Greater Sage-Grouse In The Dakotas: Distribution And Population Trends, Joe T. Smith, Lester D. Flake, Kenneth F. Higgins, Gerald D. Kobriger Jan 2004

History Of Greater Sage-Grouse In The Dakotas: Distribution And Population Trends, Joe T. Smith, Lester D. Flake, Kenneth F. Higgins, Gerald D. Kobriger

United States Geological Survey: Staff Publications

The greater sage-grouse (Centrocercus urophasianus) has declined throughout its range and its status is of major concern to federal, state, and provincial wildlife agencies. We collected information on current and historical greater sage-grouse distribution and lek activity in western North and South Dakota. A steady decline in lek attendance by males occurred over the entire recorded period in North Dakota (1951-2002) and South Dakota (1972-2002). There was no apparent change in numbers of known active leks due to discovery of new leks, but there was an abandonment of regions once occupied by active leks.

Factors Affecting The Realized Niche Of Common Sunflower (Helianthus Annuus) In Ridge-Tillage Corn, Michael G. Burton, David A. Mortensen, David B. Marx, John L. Lindquist Jan 2004

Factors Affecting The Realized Niche Of Common Sunflower (Helianthus Annuus) In Ridge-Tillage Corn, Michael G. Burton, David A. Mortensen, David B. Marx, John L. Lindquist

Department of Agronomy and Horticulture: Faculty Publications

Because soil characteristics and weed densities vary within agricultural landscapes, determining which subfield areas are most favorable to weed species may aid in their management. Field and greenhouse studies were conducted to determine whether subfield environments characterized by higher soil organic carbon (SOC), or ridge vs. furrow microsites, affect common sunflower seed germination after winter burial, seedling emergence, or the control afforded by a preemergence herbicide in a ridge-tillage corn production system. Among seeds buried in situ during winter months and germinated in the laboratory, no differences in common sunflower seed germination or mortality were detected between high-SOC (1.8% mean) …

Mobilization Of Intracellular Copper Stores By The Ctr2 Vacuolar Copper Transporter, Erin M. Rees, Jaekwon Lee, Dennis J. Thiele Jan 2004

Mobilization Of Intracellular Copper Stores By The Ctr2 Vacuolar Copper Transporter, Erin M. Rees, Jaekwon Lee, Dennis J. Thiele

Department of Biochemistry: Faculty Publications

Copper plays an essential role in processes including signaling to the transcription and protein trafficking machinery, oxidative phosphorylation, iron mobilization, neuropeptide maturation, and normal development. Whereas much is known about intracellular mobilization of ions such as calcium, little information is available on how eukaryotic cells mobilize intracellular copper stores. We describe a mechanism by which the Saccharomyces cerevisiae Ctr2 protein provides bioavailable copper via mobilization of intracellular copper stores. Whereas Ctr2 exhibits structural similarity to the Ctr1 plasma membrane copper importer, microscopic and biochemical fractionation studies localize Ctr2 to the vacuole membrane. We demonstrate that Ctr2 mobilizes vacuolar copper stores …

Long-Range Visibility Of Greater Sage Grouse Leks: A Gis-Based Analysis, Andrea S. Aspbury, Robert M. Gibson Jan 2004

Long-Range Visibility Of Greater Sage Grouse Leks: A Gis-Based Analysis, Andrea S. Aspbury, Robert M. Gibson

School of Biological Sciences: Faculty Publications

We investigated whether male greater sage grouse, Centrocercus urophasianus, select lek locations on the basis of topographic features that affect their visibility to both conspecific females and a major avian predator, the golden eagle, Aquila chrysaetos. We mapped locations of displaying males at all leks in a local population and used a Geographic Information System (GIS) and digital elevation model (DEM) to generate ‘viewsheds’ around male locations within a boundary set by the estimated maximal visual acuity of the viewer. Areas visible around leks were compared to those visible around random sites with the same conformation of displaying …

The Southwestern Association Of Parasitologists: The First 35 Years: 1967–2002, Donald W. Duszynski Jan 2004

The Southwestern Association Of Parasitologists: The First 35 Years: 1967–2002, Donald W. Duszynski

Harold W. Manter Laboratory of Parasitology: Faculty Publications

First two paragraphs:

It is likely that the idea to organize southwestern parasitologists into a regional group originated over cocktails one night in the late 1950s during a regional or national meeting. What is clear is that two men—Drs. Robert E. Kuntz and Donald V. Moore— were instrumental in turning the idea into what has become, in reality, the Southwestern Association of Parasitologists (SWAP). Dr. J. Teague Self (personal communication, 1981) stated, “The beginning of SWAP was an idea of Robert Kuntz who felt that something could be gained if several of us here in the southwest could get together …

Metallic Single-Walled Silicon Nanotubes, Jaeil Bai, Xiao Cheng Zeng, Hideki Tanaka, J. Y. Zeng Jan 2004

Metallic Single-Walled Silicon Nanotubes, Jaeil Bai, Xiao Cheng Zeng, Hideki Tanaka, J. Y. Zeng

Xiao Cheng Zeng Publications

Atomistic computer-simulation evidences are presented for the
possible existence of one-dimensional silicon nanostructures: the
square, pentagonal, and hexagonal single-walled silicon nanotubes
(SWSNTs). The local geometric structure of the SWSNTs
differs from the local tetrahedral structure of cubic diamond
silicon, although the coordination number of atoms of the SWSNTs
is still fourfold. Ab initio calculations show that the SWSNTs
are locally stable in vacuum and have zero band gap, suggesting
that the SWSNTs are possibly metals rather than wide-gap
semiconductors.

Building Data Warehouses Using The Enterprise Modeling Framework, Joseph O. Chan

Journal of International Technology and Information Management

This paper proposes an enterprise modeling framework for the deployment of data warehouses. The framework provides the information roadmap coordinating source data and different data warehouses across the business enterprise. The paper introduces a solution to address data warehousing issues at the enterprise level while avoiding the pitfalls of creating enterprise data warehouses and universal data marts. It further proposes a change of paradigm from point solutions focus to a methodology driven by enterprise requirements to meet the challenges of the new economy. The proposed framework emphasizes the separation of the conceptual construct from the physical and operational constructs of …

The Ecology Of Interorganizational Information Sharing, Jane Fedorowicz, Janis L. Gogan, Amy W. Ray Jan 2004

The Ecology Of Interorganizational Information Sharing, Jane Fedorowicz, Janis L. Gogan, Amy W. Ray

Journal of International Technology and Information Management

Increasingly, companies use interorganizational information systems to support business process partnerships, such as automatic replenishment systems and other supply chain initiatives, invoicing and payments, and insurance claims processing. Inter-firm networking in turn can increase the visibility of information generated and used by business partners. These business partners may experience intended and unintended impacts from the changes in the partnering relationship, in effect altering the ecology of the organization. Yet IT researchers rarely study an organization’s ecology, focusing instead on impacts upon internal processes. Our goal in this paper is to propose a definition of interorganizational information ecology, to provide IT …

A Conceptual Framework For E-Branding Strategies In The Non-Profit Sector, Horst Treiblmaier, Irene Pollach, Arne Floh Jan 2004

A Conceptual Framework For E-Branding Strategies In The Non-Profit Sector, Horst Treiblmaier, Irene Pollach, Arne Floh

Journal of International Technology and Information Management

E-branding provides non-profit organizations (NPOs) with new opportunities to communicate their missions, which is of paramount importance in a market segment that competes for donations and voluntary labor. Since successful e-branding is determined by both internal and external communication strategies, we developed a framework which explains the interdependency of these two factors in NPOs. Our findings are based on qualitative interview data and a website analysis of eleven Austrian NPOs. The NPOs' internal and external e-communication strategies are categorized into three successive levels each and combined in a two-dimensional grid, which shows how NPOs integrate their communication strategies.

Journal of International Technology and Information Management

eXtensible Markup Language (XML) has received much attention in the popular press lately as a new technology designed to facilitate information sharing among business entities. One of the biggest problems that companies are experiencing today with XML is that many executives do not understand what XML is and why it is important, nor do they understand what its potential impact on their information strategy might be. In this paper, we present an overview of XML and a framework for generating IS strategic alternatives, which was introduced in its original form in the 1980s. This framework is adapted to suit the …
