Intergenerational Preferences Regarding Punishment Of Criminal Offenders, Allison Deutsch, Molly Movall, Christine Van Berkum Jan 2004

Intergenerational Preferences Regarding Punishment Of Criminal Offenders, Allison Deutsch, Molly Movall, Christine Van Berkum

Presidential Scholars Theses (1990 – 2006)

The purpose of this study is to examine intergenerational differences regarding corporal punishment of criminal offenders, particularly preferential differences that occur between members of the Baby Boom and Echo-Baby Boom generations. This research is of interest due to America 's changing culture. The children of Baby Roomers see fewer acts and practices as sinful and morally wrong than do their parents, and our research examines if similar changes occurred in the criminal justice system in response to how offenders should be punished. No studies currently exist which examine this issue, and this research will create awareness in the discipline of …

Satirical Legal Studies: From The Legists To The Lizard, Peter Goodrich Jan 2004

Satirical Legal Studies: From The Legists To The Lizard, Peter Goodrich

Michigan Law Review

In Part I, I expand on the distinction between the Horatian and the Menippean forms of satire and then suggest that a similarly bold division can be used to map satirical legal studies. In support of that argument, I use the example of the earliest surviving satirical legal poem within the Western tradition. My analysis of this exemplary satirical legal artifact delineates four principal modes of legal satire that will organize the ensuing discussion of more contemporary examples of the genre. In Part II, I will address the currently popular and yet somewhat novel mode of ad hominem or nominate …

Trade Liberalization, Food Security And The Environment: The Neoliberal Threat To Sustainable Rural Development, Carmen G. Gonzalez Jan 2004

Trade Liberalization, Food Security And The Environment: The Neoliberal Threat To Sustainable Rural Development, Carmen G. Gonzalez

Faculty Articles

This article examines the historic and contemporary roots of chronic malnutrition and environmental degradation in the developing world. It chronicles the patterns of trade and production that contribute to this problem from the colonial period until the present, and analyzes the role of contemporary trade, aid and development practices in ameliorating or exacerbating the problem. The article argues that the neoliberal economic reforms imposed on developing countries through the International Monetary Fund (IMF), the World Bank, and the World Trade Organization (WTO) exacerbate hunger and environmental degradation by reinforcing pre-existing inequities in the global trading system that relegate many developing …

Tamil Asylees And U.S. Social Workers : Intercultural Communication In The Context Of Refugee Services, Emily Josephine Hagadorn Jan 2004

Tamil Asylees And U.S. Social Workers : Intercultural Communication In The Context Of Refugee Services, Emily Josephine Hagadorn

University of the Pacific Theses and Dissertations

This research study explored how intercultural communication factors such as values and communication styles might affect the interaction between Tamil asylees and their U.S. social workers. For this qualitative study, I interviewed 11 Tamil asylees and conducted a focus group with 3 U.S. social workers at an agency serving the Tamil participants. Based on the findings of this research as well as the literature review, this thesis reveals culture-specific information about Tamil asylees and highlights the implications of the research to the fields of intercultural communication, refugee studies, and social work. Findings revealed the following: culture general assumptions overshadow the …

Families And The Moral Economy Of Incarceration, Donald Braman Jan 2004

Families And The Moral Economy Of Incarceration, Donald Braman

GW Law Faculty Publications & Other Works

This chapter examines the moral economy of incarceration from the perspective of one family. Derrick and Londa's story, neither one of flagrant injustice nor triumph against the odds, shows a family facing addiction, the criminal justice system's response to it, and the mixture of hardship and relief that incarceration brings to many families of drug offenders. Stories like theirs are almost entirely absent from current debates over incarceration rates and accountability. Indeed, the historical lack of the familial and community perspective of those most affected by incarceration can help to explain the willingness of states to accept mass-incarceration as a …

The Biological Basis Of Commitment: Does One Size Fit All?, Naomi R. Cahn, June Carbone Jan 2004

The Biological Basis Of Commitment: Does One Size Fit All?, Naomi R. Cahn, June Carbone

GW Law Faculty Publications & Other Works

Understanding the biological roots of intimate behavior is a complex undertaking that involves the integration of evolutionary biology, evolutionary psychology, neuroscience, anthropology and sociology. Evolutionary biology describes theories that explain the persistence of certain types of behavior in terms of presumed evolutionary pressures or advantages, focusing on the human mind. Evolutionary biologists assume that behavior that maximizes the presence of associated genes in the next generation is the behavior most likely to persist. In this paper, we take the growing insights that arise from the study of the biology of attachment to frame the emerging policy choices underlying the governance …

The Daughter’S Struggle For Definition Both With And Against The Mother In Achieving Selfhood In Five Contemporary American Novels, Camille Leigh Comer Jan 2004

The Daughter’S Struggle For Definition Both With And Against The Mother In Achieving Selfhood In Five Contemporary American Novels, Camille Leigh Comer

Honors Theses

The following thesis analyzes the mother-daughter relationships in Rebecca Wells’ Little Altars Everywhere and Divine Secrets of the Ya~Ya Sisterhood, Janet Fitch’s White Oleander and Sue Monk Kidd’s The Secret Life of Bees. Attempting to illustrate the central significance of relations between mothers and daughters in everyday life, I chose the four novels based on their recent popularity in mainstream society. For instance, both Divine Secrets and White Oleander have been made into films within the past few years. In gathering data for my thesis, I focused on information explaining why the relationships between mothers and daughters are especially potent …

This bibliography covers law review articles and supplemental A.L.R. entries published after 1997. We also include a handful of especially interesting pieces published in or before 1997, which we believe are just too good to pass up. A.L.R. entries, whose titles are usually self-explanatory, are cited, but not annotated. Similarly, articles that concern only a single case or a single state are cited, but not annotated.

The Process For Becoming A Law School Professor In The United States, Daniel H. Foote Jan 2004

The Process For Becoming A Law School Professor In The United States, Daniel H. Foote

Articles

As the process of legal education reform in Japan, centered on the establishment of a new tier of professional graduate schools in law, moves forward, one issue that has arisen is how law professors will be trained in coming years. In that connection, I am frequently asked what the typical route is for training law school professors in the US. Based in part on an examination of the backgrounds prior to entering law teaching for over 500 law professors at eight US law schools and on personal experiences (including serving for three years on the appointments committee at the University …
