It is 2003 and I am doing some research at the Library of Congress, the de facto national library for the United States and the largest library in the world. Next to me sit some articles I've printed off of online journals on the Defense Advanced Research Project Agency's Total Information Awareness Project, a plan, still in its formative stage, to throw a panopticon net of surveillance across the United States through a combination of language translation technologies, data search and pattern recognition technologies, and advanced collaborative and decision support tools (DARPA). An edited transcription of the 1879 to 1887 diaries of Mary Lois Walker Morris (1835-1919). Mary Lois, a plural wife in 19th century Utah, went in and out of hiding between 1885 and 1887 to protect her husband Elias Morris from prosecution for illegal cohabitation. Her daily diaries culminate with the court trial of her husband for illegal cohabitation in September 1887. At the trial, she testified falsely, stating that she had been separated from her husband since the beginning of 1883, when in fact the couple did not separate until May of 1885. As a result, her husband was …

A Holistic Model Of The Interplay Of Parent-Adolescent Interaction Varialbes: Outcomes As A Result Of Conflictual Processes, Cliff Blake Mckinney

Many variables have been analyzed in order to understand parent-adolescent interactions and outcomes for adolescents. These variables must be integrated into a model that demonstrates the holistic interplay of parent-adolescent interaction variables so that a more comprehensive understanding of parent-adolescent interactions is achieved. Variables included in the model proposed here were parenting, family environment, expectations, conflict, and outcomes. Parenting, family environment, and conflict were associated with outcomes for adolescents. When the variables were analyzed simultaneously with structural equation modeling, however, the relationship of parenting and adolescent outcomes was mediated wholly for male-father, male-mother, and female-father relationships but remained significant for …

Intertribal Conflicts And Customary Law Regimes In North Africa: A Comparison Of Haratin And Ait 'Atta Indigenous Legal Systems, Anna Natividad Martinez

The Haratin people of North Africa are subjects in crisis; they are people whose origins are debated and whose social status is scorned. As an indigenous population in the midst of regional turmoil, they have been subject to removal, forced labor and economic deprivation. Their exploitation by both French colonial forces and other indigenous populations (namely Arabs and Berbers) has displaced the Haratin way of life and has subsumed their legal culture.

Diné Bi Beenahaz'Áanii: Codifying Indigenous Consuetudinary Law In The 21st Century, Kenneth Bobroff

The fundamental laws of the Diné, "the People" in the Navajo language, were placed by the Holy People long before Spaniards arrived in the New World. Since Coronado first traveled to Navajo Country almost five centuries ago, Diné have resisted European assaults on Navajo Law. On November 1, 2002, the Navajo Nation Council acknowledged the survival of the fundamental laws of the Diné, recognizing four specific constituent elements — traditional law, customary law, natural law, and common law – and explaining the principles of each.

The cultural groups among the Aboriginal peoples of Northern Canada correspond to climatic latitudinal divides. Above the tree line, where the boreal forest meets the tundra, are the Inuit whose territory stretches far into the arctic. South of the tree line are the Dene, and below them are the Cree nations of the prairies. The goal of this paper is to concentrate on the nature of the particular culture of the Dene People.

During the decade preceding the height of the civil rights movement, a small population of Hondurans established residence in the New Orleans area. This Honduran migration was largely due to the trade relationship that existed between Honduras and New Orleans. Honduras was also experiencing political unrest and economic instability due to military coups, fruit company strikes and floods during the late 1950s. In response, the advent of the 1960s brought with it the first wave of Hondurans. It was a completely uncharted field, so it was an exciting challenge when, in 1996, I was asked to give a paper on the subject at an international conference in Gothenburg. The Appropriation Of The Prospect Of Taking Medication For Psychological Complaints: An Empirical-Phenomenological Investigation, Daniel R. Mangine

The purpose of this investigation was to describe the lived experience of being confronted with the prospect of taking medications for a psychological complaint, namely a depressive disorder. Descriptions of such experiences were obtained from adult participants and were analyzed qualitatively in order to explicate the themes and meanings that were most significant to forming the experience as such.
The findings of this study were dialogued with literature on medication taking, the doctor-patient relationship, dialogic psychology and the construction of the self, and theories of willing, motivation and identity. This analysis contributes to the current literature by illuminating the lived …

Internet Dwelling, Cyborgs, And The Matrix Of Modernity: An Empirical Inquiry With Critical-Hermeneutic Features, Andrew Felder

Amidst modernity's expanding electronic social matrix, this cultural-historical inquiry explores the technological construction of human being (e.g., cyborgs) and sociality in the America Online cyberscape. A two-tiered critical-hermeneutic method enables exploration of the broad rationalizing historical narrative and the localized play of virtual discursive practices impacting human meaning construction, selfhood, and social practice. A third and fourth tier of inquiry occasions integration of "psychological" meanings found in research participant experiential descriptions and interviews. This four-tier interplay reveals a bodily ethic enabling participants to modify subjectifying Internet practices toward meaningful social ends. Otherwise, eclipsed interpretive bodily powers contribute to "undecidability" about …

This Article is largely an argument that the pervasive sense of cultural resistance in the African American community must be considered by criminal theorists as, at least, a partial explanation of “criminality” within the African American community. Woven into the fabric of African American culture is a vital oppositional element. This element, spoken of in many circles as “oppositional culture” constitutes a bold and calculated rejection of destructive mainstream values that have perpetuated social inequalities and power imbalances. Hate is a normative part of the human experience. Look at history. Almost ten years ago, I began teaching a course on hate crimes. This course was originally created as an upper division elective for undergraduate Criminal Justice majors. In the years since, the course has been adapted slightly so that it now serves to satisfy our General Education “Multicultural” requirement. The course is a popular one—in the fall of 2003, I had 62 students—and one I enjoy teaching. However, teaching this course has also presented several challenges. I am discovering that to teach about the history of Nazism, the Holocaust, and genocide is to enter into a profoundly spiritual experience. By this I mean that in engaging with these subjects, students of history must come to terms with some of the most elemental, existential qualities of the human potential for radical destruction and limitless hatred.
