On Protecting Children From Speech, Amitai Etzioni Apr 2004

On Protecting Children From Speech, Amitai Etzioni

Chicago-Kent Law Review

Are children entitled to the same First Amendment rights as adults? This Article explores the constitutionality of limiting children's access to objectionable materials assuming that both free speech rights and the protection of children are two core values that, like all other social values, must be balanced. When used to assess specific court cases and public policies, the balancing principle is a helpful guide in determining whether voluntary or incentives-based programs are sufficient to remedy the problems at hand or whether government regulation of free speech is necessary. The Article analyzes five court cases involving Internet filters in libraries, the …

Cognitive Tool: Learning Forces For Beginners / Kamarul Naemi Kamarudin, Kamarudin Kamarul Naemi

Student Works (2000-2009)

Many subjects taught in school are supported by CAI software. Learning about forces is difficult if it is learned theoretically. Students fail to understand the basic concept of forces, therefore they generalize that learning physics is difficult. The purpose of this research is to develop a prototype that can make learning physics fun and easy. The tool guides students to identify and draw forces acting on objects and visualize the motions. Lessons, questions and learning activities are provided, supported with animated examples. Students are guided through problem so as to relate the ideas to be learnt to those acquired earlier. …

The Undiscovered Country: Northern Views Of The Defeated South And The Political Background Of The Fourteenth Amendment, Garrett Epps Apr 2004

The Undiscovered Country: Northern Views Of The Defeated South And The Political Background Of The Fourteenth Amendment, Garrett Epps

All Faculty Scholarship

In 1866, Harper's Weekly announced a new series of woodcuts of Southern life with the remark, "[t]o us the late Slave States seem almost like a newly discovered country." It is difficult for Americans in the Twenty-First Century, in a culture of cable news coverage and national newspapers, to appreciate just how mysterious the former Confederacy seemed to Northerners in the months after Appomattox. It was not simply that four years of war had made communication between the two halves of the nation difficult - though that was true, and both Northern and Southern society had changed during the searing …

Attunement To The Creating Process In Teaching & Learning, Margaret A. Macintyre Latta Apr 2004

Attunement To The Creating Process In Teaching & Learning, Margaret A. Macintyre Latta

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Aesthetic play requires all participants to remain faithful to the intricacies and intensities of human experience. Teachers and students continually improvised within relations, adapting, building, and changing meaning. The indeterminate nature of aesthetic play assumes teaching/learning is complex and individual. All oriented toward sensitivity to the many relations present in teaching/learning situations deliberately seek out fragility’s presence, in order to honor the existing complexity and individuality. Eliot Eisner explains, “What is mediated through thought are qualities, what is managed in process are qualities, and what terminates at the end is a qualitative whole. . . .” Discerning between these qualitative …

Factors Influencing Seagrass Recovery In Feather Sound, Tampa Bay, Florida, Feather Sound Seagrass Recovery Workgroup

Reports

This document is a summary of the findings and recommendations of the Feather Sound Seagrass Recovery Workgroup.

In response to nutrient load reductions and resulting clearer water, seagrasses have expanded significantly in many areas of Tampa Bay since the mid-1980s. However, the recovery rate and expansion of seagrasses in several areas, especially in the Feather Sound region of Old Tampa Bay, have been much slower. This project was designed to examine factors that may be affecting seagrass recovery and growth in the Feather Sound region compared to three other areas of Old Tampa Bay.

Simple, Pure, And True: An Emergent Vision Of Liberal Learning At The Research University, Peter Sederberg Apr 2004

Simple, Pure, And True: An Emergent Vision Of Liberal Learning At The Research University, Peter Sederberg

Journal of the National Collegiate Honors Council Online Archive

Epiphanies, presumably, strike suddenly. This vision, however, was not like Saul’s on the road to Damascus; rather, it emerged over 25 years of incremental involvement in creating one of the stronger Honors Colleges in the country at the University of South Carolina. Over the past five years, in particular, my evolutionary experience has been shaped by a growing recognition of an underlying problem confronting the contemporary research university.

In general, the demands faced by research universities have not changed since World War II, though some have fluctuated in intensity. The essential problem, I believe, arises less from external demands and …

Rangers, Mounties, And The Subjugation Of Indigenous Peoples, 1870 .. 1885, Andrew R. Graybill Apr 2004

Rangers, Mounties, And The Subjugation Of Indigenous Peoples, 1870 .. 1885, Andrew R. Graybill

Great Plains Quarterly (through 2013)

During the 1840s and 1850s, more than 300,000 traders and overland emigrants followed the Platte and Arkansas rivers westward across the Central Plains, the winter habitat of the bison. The rapid environmental degradation of this area had the ·effect of driving the bison to the extreme Northern and Southern Plains, where white hide-hunters slaughtered the animals.1 By the mid-1870s indigenous peoples at both ends of the grasslands, in places such as the Texas Panhandle and the upper Missouri River valley, fiercely defended the dwindling herds in an attempt to avoid starvation.2

The Indians' predicament was not theirs alone, …

Review Of Ranching West Of The Iooth Meridian: Culture, Ecology, And Economics Edited By Richard L. Knight, Wendell C. Gilgert, And Ed Marston, Ann Hild Apr 2004

Review Of Ranching West Of The Iooth Meridian: Culture, Ecology, And Economics Edited By Richard L. Knight, Wendell C. Gilgert, And Ed Marston, Ann Hild

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Ranching West of the l00th Meridian provides a diverse array of perceptions of ranching in western states. The authors of its seventeen essays describe ranching culture, ecology, and economics, while omitting extremist approaches to western land management. Intentionally absent are the preservationists who suggest removing ranching from western rangelands and those who would remove all land from the public domain. This selection attempts to unite concerned users of western lands and to present in a fair way less vocal western land stewards, the "radical center." What remains is a refreshing variety of authors committed to sustainable rangeland use that includes …

The Effects Of Competition And Perceived Pressure On Performance Of A Visual Scanning Task: A Test Of Cognitive Evaluation Theory, Tanya R. Adkins Apr 2004

The Effects Of Competition And Perceived Pressure On Performance Of A Visual Scanning Task: A Test Of Cognitive Evaluation Theory, Tanya R. Adkins

Master's Theses - Daytona Beach

Cognitive Evaluation Theory was developed by Deci & Ryan, (1985) to explain factors that affect intrinsic motivation. This study was done to test this theory by having volunteers engage in direct and indirect competition while working on a simple task in a time-pressured environment. Specifically, it was predicted that task performance would be adversely affected in competition because participants would be focused on the outcome (winning versus losing), while being faced with a deadline for task completion. In addition, a reduction in intrinsic motivation toward the activity was expected. While these hypotheses were not supported, a proposal was made that …

Canada's Campaign For Immigrants And The Images In Canada West Magazine, Laura A. Detre Apr 2004

Canada's Campaign For Immigrants And The Images In Canada West Magazine, Laura A. Detre

Great Plains Quarterly (through 2013)

One of the major challenges that Canadian government officials felt they faced at the end of the nineteenth century was the development of the prairie West. By this time there were large urban centers in eastern Canada, but many Canadians worried that they had not truly ensured the future existence of their country. They hoped that filling the middle, the province of Manitoba and the region that would become the provinces of Saskatchewan and Alberta, with prosperous, white, family farmers would support the industrialized cities of the East. To do this the government engaged in a systematic program to encourage …

"This Strange White World" Race And Place In Era Bell Thompson's American Daughter, Michael K. Johnson Apr 2004

"This Strange White World" Race And Place In Era Bell Thompson's American Daughter, Michael K. Johnson

Great Plains Quarterly (through 2013)

Aboard a train heading out of Minneapolis toward frontier North Dakota, Era Bell Thompson in her autobiography American Daughter (1946) describes a landscape that grows steadily bleaker with each mile farther west: "Suddenly there was snow-miles and miles of dull, white snow, stretching out to meet the heavy, gray sky; deep banks of snow drifted against wooden snow fences .... All day long we rode through the silent fields of snow, a cold depression spreading over us." Thompson's realistic winter landscape descriptions also allegorically represent the social situation of herself and her family. The phrase "this strange white world," which …

When Nice Guys Finish First: The Evolution Of Cooperation, The Study Of Law, And The Ordering Of Legal Regimes, Neel P. Parekh Apr 2004

When Nice Guys Finish First: The Evolution Of Cooperation, The Study Of Law, And The Ordering Of Legal Regimes, Neel P. Parekh

University of Michigan Journal of Law Reform

This Note adds to the scholarship in the area of Evolutionary Analysis and the Law (EA). EA is a paradigm that comments on the implications of evolution on the law. EA recognizes that many complex human behaviors that the law seeks to regulate have evolutionary origins that remain relevant today. This Note details how an understanding of the evolutionary basis of cooperation can bring about favorable revisions and reforms in the law.

Following a review of the scientific foundation of EA, this Note sets forth the proposition that humans have an evolutionarily developed tendency to cooperate, an idea that contrasts …

Liberty Versus Property? Cracks In The Foundations Of Copyright Law, Richard A. Epstein Apr 2004

Liberty Versus Property? Cracks In The Foundations Of Copyright Law, Richard A. Epstein

Coase-Sandor Institute for Law & Economics Research Paper Series

Many modern intellectual property scholars have argued that the creation of patents and copyrights, for inventions and writings, respectively, should be resisted on the ground that these forms of property necessarily infringe ordinary forms of liberty, in contrast to property that is found in tangible things. This article rejects that claim by showing how property conflicts with liberty in both settings, but that the different configurations of rights observed in these various areas is defensible on the ground that the loss of liberty for all persons is, to the extent that human institutions can make it, compensated by the increased …
