Morals-Based Justifications For Lawmaking: Before And After Lawrence V. Texas, Suzanne B. Goldberg May 2004

Morals-Based Justifications For Lawmaking: Before And After Lawrence V. Texas, Suzanne B. Goldberg

Rutgers Law School (Newark) Faculty Papers

Morals-Based Justifications for Lawmaking: Before and After Lawrence v. Texas looks in depth at the dissonance between the Supreme Court’s rhetorical support for morals-based lawmaking and the Court’s jurisprudence. In taking this approach, the article responds to a central post-Lawrence question regarding the sufficiency of a government’s moral agenda as a justification for restricting individual rights. It turns out, on close review of the cases going back to the mid-1800s, that the Court has almost never relied explicitly on a morals rationale to sustain an allegedly rights-infringing government action.

The article develops several explanations for this avoidance of explicit morals …

Identification Of A Novel Bovine Herpesvirus 1 Transcript Containing A Small Open Reading Frame That Is Expressed In Trigeminal Ganglia Of Latently Infected Cattle, Melissa Inman, Joe Zhou, Heather Webb, Clinton J. Jones May 2004

Jones

School of Veterinary and Biomedical Sciences: Faculty Publications

Bovine herpesvirus 1 (BHV-1), like other Alphaherpesvirinae subfamily members, establishes latency in sensory neurons. The latency-related (LR) RNA is abundantly expressed during latency, and expression of an LR protein is required for the latency reactivation cycle in cattle. Within LR promoter sequences, a 135-aminoacid open reading frame (ORF) was identified, ORF-E, that is antisense to the LR RNA. ORF-E is also downstream of the gene encoding the major viral transcriptional activator, bICP0. Strand-specific reverse transcription-PCR demonstrated that a transcript containing ORF-E was consistently expressed in trigeminal ganglia (TG) of latently infected calves, productively infected cultured cells, and acutely infected calves. …

Restoration And Management Of Gray Wolves In Central Idaho - Progress Report 2003, Curt Mack, Jim Holyan May 2004

Restoration And Management Of Gray Wolves In Central Idaho - Progress Report 2003, Curt Mack, Jim Holyan

Rocky Mountain Wolf Recovery: Annual Reports

The U.S. Fish and Wildlife Service (USFWS) is restoring endangered gray wolves to the northern Rocky Mountains including ongoing efforts in 3 restoration areas: Northwest Montana, the Greater Yellowstone Area, and Central Idaho. Gray wolves naturally recolonized northwest Montana and were down-listed to threatened status under the Endangered Species Act (ESA) in 2003. Nonessential experimental population areas were established for the Greater Yellowstone and Central Idaho Areas where wolves were actively reintroduced under the ESA. This special designation allows for management flexibility to address public concerns such as wolf-livestock conflicts.

In 2003 the USFWS reclassified gray wolves across the lower …

Psychological Stress During Exercise : Stress Hormone Responses And Immune Function, Michael Weldy May 2004

Psychological Stress During Exercise : Stress Hormone Responses And Immune Function, Michael Weldy

Electronic Theses and Dissertations

Certain professions involve duties that are physically and psychologically stressful. Physical stress alone and psychological stress alone are associated with increases in cardiorespiratory and stress hormone levels. Elevations in stress hormones, catecholamines and cortisol, are related to changes in blood lymphocyte populations. In particular, elevations in cortisol are related to reductions in helper T cells, helper T cell to cytotoxic T cell ratio, and natural killer cells. While numerous studies have investigated effects of physical and psychological stress alone, the effects of psychological stress during exercise has not been investigated. The purpose of this study was to describe catecholamine and …

Emergency Preparedness: A Manual For Homeless Service Providers, Kelly Tobin, Phyllis Freeman May 2004

Emergency Preparedness: A Manual For Homeless Service Providers, Kelly Tobin, Phyllis Freeman

Center for Social Policy Publications

Public attention to "emergency planning" has increased dramatically since 9/11/2001. Out of concern that the population of homeless individuals and families may not have been considered adequately in planning thus far, the Center for Social Policy reviewed what has occurred, sought advice about what would be useful to add to existing material and resources, and proceeded to prepare this Manual. It seemed all too likely that under the already considerable pressure for cities and towns to prepare for threats caused by terrorism, including bioterrorism, that the special characteristics of homeless families and individuals, and of community organizations serving homeless people, …

Empowering Women? Engaging A Technology Grant For Social Change, Erica Meiners, Laurie Fuller May 2004

Empowering Women? Engaging A Technology Grant For Social Change, Erica Meiners, Laurie Fuller

Journal of International Women's Studies

This paper examines and exposes the writing and implementation of a project, funded by a federal government grant that worked to increase the technological literacy levels of women at an urban working-class university in the Midwest. This three-year study/intervention clearly reveals that disrupting the ‘digital divide’ for working-class women at our university, particularly women of color, requires engagements with the material and practical realities of their everyday lives. In addition to findings in relation to gender, race, low-income communities and technology, participation in this study/intervention illuminated for the authors—anti-racist, feminist academics and organizers—the consequences and costs of moving epistemological frameworks …

Microcomputers have become a vital tool in business, industry, and education. The level and the amount of education that students in West Virginia receive in secondary agricultural classes on microcomputers can affect their ability to compete for jobs and in college curriculums. For agriculture programs to produce quality graduates ready to meet the demands of today's work place, they must have up-to-date microcomputing hardware and software. This study examined the accessibility to computers by teachers of agriculture education in West Virginia. A survey was sent to 74 agriculture education departments in West Virginia. The results showed that most departments are …

Brook Trout Bioenergetics And The Use Of Bioelectrical Impedance Analysis For Proximate Composition, Marlin Keith Cox Ii May 2004

Brook Trout Bioenergetics And The Use Of Bioelectrical Impedance Analysis For Proximate Composition, Marlin Keith Cox Ii

Graduate Theses, Dissertations, and Problem Reports (ETD)

Three aspects of a bioenergetics model were examined for brook trout (Salvelinus fontinalis) in the laboratory: (1) refinement of the metabolism parameter estimations, (2) calculation of activity rates and (3) subsequent validation of the brook trout model. An integral part of bioenergetics modeling is the initial inputs of predator and prey energy density from body composition estimations. We present bioelectrical impedance analysis (BIA) as a means of rapidly estimating body composition in fish and then adjusted variables that may affect these predictions. We also used this tool and applied it to a compensatory growth study. Brook trout (Salvelinus fontinalis) were …

Screen-Scraping And Harmful Cybertrespass After Intel, George H. Fibbe May 2004

Screen-Scraping And Harmful Cybertrespass After Intel, George H. Fibbe

Mercer Law Review

The topic for this Symposium, "The Internet: Place, Property, or Thing-All or None of the Above," touches on a debate that has existed since the early days of the Internet. There is no question that people commonly understand their experience using the Internet with the help of spatial metaphor--e.g., "sites" and "addresses" that we "visit," and programs called "robots," "crawlers," and "spiders." Leaving metaphor aside, many of the constituent parts of the Internet, especially computer servers, are items of private personal property.

Indeed, the debate over metaphor is reminiscent of the scene from the movie Field of Dreams in which …

Music Technology In The Classroom, John A. Manseau Jr. May 2004

Music Technology In The Classroom, John A. Manseau Jr.

Theses and Dissertations

The last twenty years have exhibited unprecedented growth of music technology in the fields of commercial music, professional recording studios, personal home studios, and music education in the public school music classroom. With the establishment of school district programs providing students with access to computer technology from state lottery monies, music classrooms are now receiving their own computers and music software. Music software in the marketplace provides challenges to teachers and their efforts to integrate technology to their classroom instruction. How music educators determine what software is needed, what is appropriate, effective, and within their music budget is still a …

Gothic Opera In Britain And France: Genre, Nationalism, And Trans-Cultural Angst, Diane Hoeveler, Sarah Davies Cordova May 2004

Gothic Opera In Britain And France: Genre, Nationalism, And Trans-Cultural Angst, Diane Hoeveler, Sarah Davies Cordova

English Faculty Research and Publications

Rescue operas developed along two somewhat different lines: “tyrant” operas and “humanitarian” operas within the general category of “opera semiseria,” or “opéra comique.” The first type corresponds to the conservative British “loyalty gothic,” with its focus on the trials and tribulations of the aristocracy, while the second type draws upon the Sentimental “virtue in distress” or “woman in jeopardy” genre, with its focus on middle class characters or women as the captured or besieged. The first category emphasized political injustice or abstract questions of law and embodied the threat of tyranny in an evil man who imprisons unjustly a noble …

Role Of Iron In The Mechanism Of Asbestos-Induced Apoptosis In Human Lung And Pleural Target Cells, Aleksander Baldys May 2004

Role Of Iron In The Mechanism Of Asbestos-Induced Apoptosis In Human Lung And Pleural Target Cells, Aleksander Baldys

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Occupational exposure to asbestos has been associated with increased incidence of pulmonary interstitial fibrosis, mesothelioma of the pleura, and bronchogenic carcinoma. Although the mechanism by which asbestos causes cancer remains unknown, iron associated with asbestos is thought to play a role in the pathogenic effects of fibers.

The aim of this research was to examine and compare the asbestos-induced signaling phenomena in relevant human lung and pleural target cells, and to determine the role of iron from asbestos fibers in these events. Exposure of human airway epithelial (A549) cells, human pleural mesothelial (MET5A) cells, and normal human small airway epithelial …

The Descent Of Darwin—A Theological Understanding Of Charles Darwin, David Kummer May 2004

The Descent Of Darwin—A Theological Understanding Of Charles Darwin, David Kummer

Master of Sacred Theology Thesis

In the process of seeking to understand Charles Darwin and his ideas that have come to dominate much of the modern/postmodern, western worldview, it is essential to elucidate the historical context in which both are developed is essential to elucidate. This approach asserts a reciprocity between Darwin the man (son, explorer, naturalist, husband, father, controversialist)and his ideas that not only derive from his life experiences but also contribute to them. An obvious place to start in this regard is the relationship he has with his mother. Although seemingly Freudian in tone, the purpose for this analysis does not include a …

Contemporary Visions Of Progress In Ecology And Thoughts For The Future, Brian M. Starzomski, Bradley J. Cardinale, Jennifer A. Dunne, Melinda J. Hillery, Carrie A. Holt, Meg A. Krawchuk, Melissa Lage, Sean Mcmahon, Michael C. Melnychuk

Research outputs pre 2011

Although ecological research is progressing rapidly, the answers to certain key questions continue to elude us. This paper considers several of the contemporary challenges facing ecology. (1) Terminology is voluminous and often poorly defined, resulting in inefficient communication. (2) The concept of scale affects our inferences about system structure and function, requiring us to continue an almost heuristic investigation of breaks, domains, and integration. New tools that more explicitly incorporate scalar issues will need to be developed for progress to take place in the field of ecology. (3) Increasingly, it is expected that applied questions will be solved in less …
