E-Mail and list servs have proven to be valuable assets in networking and encouragement for those seeking jobs. What was once a laborious and often relatively isolated activity has now developed into a national and even international support group of fellow professionals who will pray and provide assistance in the job search.

Are All Rivals Affected Equally By Bond Rating Downgrades?, Gary L. Caton, Jeremy Goh

We use revisions in analysts' earnings forecasts to examine how the bad news associated with a bond rating downgrade gets transferred from the downgraded company to its rivals. In general, we find that stock analysts revise their earnings expectations downward for rivals of companies with downgraded debt. However, the significance of the revision is limited to rivals of downgraded companies with non-investment grade debt only. For the rivals of companies with investment grade debt, we find no significant forecast revisions. We hypothesize that this differential impact is due to differing levels of market visibility. A New Node Centroid Algorithm For Bandwidth Minimization, Brian Rodrigues, F. Xiao, A. Lim

We propose a Node Centroid method with Hill-Climbing to solve the well-known matrix band-width minimization problem, which is to permute rows and columns of the matrix to minimize its bandwidth. Many heuristics have been developed for this NP-complete problem including the Cuthill-McKee (CM) and the Gibbs, Poole and Stockmeyer (GPS) algorithms. Recently, heuristics such as Simulated Annealing, Tabu Search and GRASP have been used, where Tabu Search and the GRASP with Path Relinking have achieved significantly better solution quality than the CM and GPS algorithms. Experimentation shows that the Node Centroid method achieves the best solution quality when compared with …

The article critically examines the Andrea Yates trial, arguing that it highlights significant flaws in the legal system, media coverage, and societal attitudes toward mental illness and gender roles. The trial underscores the ambiguity in legal definitions of insanity, the unequal treatment of mothers who commit infanticide, and the problematic intersection of law and media, which can undermine justice and perpetuate harmful stereotypes. The case serves as a cautionary tale about the failure of the legal system to address mental health adequately and the media's role in sensationalizing tragedy for public consumption.

The New Labor Market For Lawyers: Will Female Lawyers Still Earn Less?, Joni Hersch

The article examines the persistent gender pay gap in the legal profession, despite women's increased representation, and identifies key factors contributing to this disparity. It highlights how structural and societal factors, such as work hours, family responsibilities, and discrimination, play significant roles. The analysis suggests that while younger cohorts show signs of narrowing the gap, systemic barriers and biases continue to affect women's earnings and career advancement. The study underscores the need for policies addressing these inequities to ensure equal opportunities and pay.

Agricultural sustainability is enhanced by management practices that optimize the performance of multiple agroecosystem functions. The performance of western Corn Belt cropping systems was evaluated based on four agroecosystem functions: food production, raw materials production, nutrient cycling, and greenhouse gas regulation. A simple multiattribute ranking procedure was used to quantify agroecosystem performance using data from a long-term cropping systems experiment near Mead, NE. Treatments included in the procedure were continuous corn (Zea mays L.) (CC), corn–soybean [Glycine max (L.) Searching Large Collections Of Recorded Speech: A Preliminary Study, Jinmook Kim, Douglas W. Oard, Dagobert Soergel

This paper reports on an exploratory study of the criteria searchers use when judging the relevance of recorded speech from radio programs and the attributes of a recording on which those judgments are based. Five volunteers each performed three searches using two systems (NPR Online and SpeechBot) for three questions and judged the relevance of the results. Data were collected through observation and screen capture, think aloud, and interviews; coded; and analyzed by looking for patterns. Criteria used as a basis for selection were found to be similar to those observed in relevance studies with printed materials, but the attributes …

Sarah Willie asks: What's it like to be black on campus. For most Black students, attending predominantly white universities, it is a struggle. Do you try to blend in? Do you take a stand? Do you end up acting as the token representative for your whole race? And what about those students who attend predominantly black universities? How do their experiences differ? Trial lawyers and judges are quite accustomed to courtroom battles over the admissibility of hearsay. But relatively few have much experience at challenging the credibility of hearsay. Once hearsay is admitted in evidence, even the ablest advocates typically proceed as if the hearsay battle were over, at least until the appeal. Few lawyers take advantage of the opportunities available to impeach the hearsay declarant. Consider the perspective of one experienced trial judge: I sometimes wonder at what seems to me the passing up of golden opportunities by the able advocate. In sum, despite the efforts of the General Assembly, Virginia law remains stuck between the "rock" of antiquated theft crimes and the "hard place" of due process. Tinkering with procedural rules merely masks the real problem. My aim in this article is to suggest a different approach. It is time to address the substantive definition of theft crimes in Virginia: to consolidate the crimes of larceny, embezzlement, and false pretenses-as most other American jurisdictions have done into a single offense. By dealing with substance rather than procedure, we can eliminate historical distinctions which serve only to confound prosecutors and complicate …

Six decades ago, the U.S. Supreme Court decided Ex parte Quirin, in which the Justices determined that President Franklin Delano Roosevelt possessed the requisite constitutional authority to institute and use a military commission.
On November 13, 2001, President George W. Bush promulgated an Executive Order (Bush Order) that authorized the establishment and application of military commissions as well as purported to eliminate whatever jurisdiction federal courts might have by statute and to deny federal court access to individuals prosecuted or detained for terrorism. The Bush administration substantially premised that the Order and jurisdiction-stripping proviso on Ex parte Quirin. It has …

Laura Dickinson's recent article in this journal substantially improves appreciation of how the United States has detained suspects and instituted military commissions as well as of the roles played by the controversial procedure and tribunals when fighting terrorism. She meticulously traces how detentions and the commissions evolved, trenchantly criticizes them, and persuasively shows international tribunals' comparative advantage. Dickinson accords relevant domestic case precedent a somewhat laconic analysis, however. For example, she briefly mentions separation-of-powers concerns and Supreme Court opinions that detentions and military commissions implicate while rather tersely assessing Ex parte Quirin, the Second World War decision on which …

Justice Byron White exhibited acute sensitivity to process during his exceptional career on the Supreme Court. This essay affords several illustrations of that characteristic. One was his perceptive account of the Court's responsibility for amending the rules which mainly govern federal district court practice. The second was careful stewardship of a federal appellate court study authorized by Congress after the jurist had resigned. Another was his persistent dissents from denials of petitions for Supreme Court review. These examples relate to the three levels in the federal judicial hierarchy, and demonstrate Justice White's abiding concern for each constituent and the whole …

Today's reports of corporate villainy invite these questions: Restricting ourselves to what the profession knew in the last days of the late 1990s soaring stock market, what advice might attorneys have given-about the temptations of deceptive accounting and the defenses to erect against it-to young executives who were taking their companies public then? And, if attorneys did not always give that counsel in fulsome form, why was that so? What forces worked on lawyers to deter that advice? What does all this suggest for counseling today? What are the advantages and disadvantages of appellate review of trial court rulings on issues of foreign law? What exactly does judicial review of unsettled questions of foreign law accomplish? What is its price? These questions are of considerable theoretical interest and immense practical importance. Their resolution calls for inquiries into the allocation of judicial authority and in its production of outcomes in the real world. The discussion proceeds first by briefly describing in Part II some of the causes and effects of the steadily increasing caseloads in appellate courts. The Federal Gift Tax is designed to implement two competing policies: to tax gifts so as to prevent taxpayers from depleting their estates (and thus evading the estate tax) with tax-free lifetime transfers; but to tax gifts at a rate lower than testamentary transfers so as to encourage taxpayers to circulate wealth during life, thereby stimulating economic growth and income tax revenue. The gift tax has always been carefully crafted to balance these competing interests. That is, until now. The Economic Growth and Tax Relief Reconciliation Act of 2001 ("EGTRRA") completely perverted these two policies.' EGTRRA was sold to the …

For all practical purposes, the Constitution prescribes only one limit on the federal government's power to tax: the Uniformity Clause, which requires that indirect taxes, such as income and excise taxes, be "uniform throughout the United States ... " It is exceedingly rare for a federal tax law to violate the Uniformity Clause. The Internal Revenue Code does not fix different taxes for different states, as Congress has carefully crafted the tax laws to avoid geographical distinctions. Unfortunately, the Internal Revenue Service ("IRS") has not always been so careful. In recent years, the IRS has adopted a practice of applying …

The state of Wisconsin recently launched a Research-to-Practice Initiative. One aspect of the Wisconsin initiative was to survey Wisconsin-Certified Alcohol and other Drug Abuse Counselors (CADCs) to assess their attitudes, reported practices, and resources in regard to the integration of research and practice. The sample for the present study included 366 CADCs. Of the 366 respondents, 62 percent (n = 226) were female and 38 percent (n = 140) were male. The respondents were primarily Caucasian (90 percent) with the remaining respondents identifying as African American (4 percent), Native American (2 percent), Hispanic (1 percent), and Asian American …

Fibroblast growth factor (Fgf) and Retinoic acid (RA) are known to be involved in patterning the posterior embryo. Work has shown that Fgf can convert anterior tissue into posterior fates and that embryos deficient in Fgf signaling lack posterior trunk and tail structures. Likewise, studies performed on RA have shown that overexpression of RA posteriorizes anterior tissue, while disrupting …

Effects Of Social Interaction On The Electric Organ Discharge In A Mormyrid Fish, Gnathonemus Petersii (Mormyridae, Teleostei), Thomas A. Terleph, Peter Moller

African weakly discharging electric fish (Mormyridae) use their self-generated electric signals and electroreceptive abilities for orientation and communication in the context of courtship and territorial interactions. This paper documents socially mediated changes in the electric organ discharge (EOD) of subadult Gnathonemus petersii under non-breeding environmental conditions. Increases in EOD duration and changes in the relative phase amplitudes occurred in dominant fish during same-sex (male–male, female–female) and opposite-sex interactions. Similar changes were also observed in fish that were restricted in their physical interactions, suggesting that direct contact is not necessary to induce dominance-typical EOD waveforms. Response to Prof. John B. Oakley's writings comparing state court procedural rules with the Federal Rules of Civil procedure.
Professor Oakley's substantial contribution to the Nevada Law Journal dispute resolution symposium neither accords much treatment to how or why the earlier uniformity between state and federal procedural regimes changed so dramatically over such a brief period nor proffers very many suggestions for the future. My response aspires primarily to scrutinize how federal-state consistency deteriorated and secondarily to consider what, if any, measures should be instituted to change the present condition of state civil procedure in the fifty jurisdictions comprising the …

In late July 2002, a special session of the Nevada Legislature passed medical malpractice reform legislation. The expressly-stated purpose of this statute is remedying, or at least ameliorating, the "serious threat to the health, welfare and safety of [Nevada] residents" which is posed by the state's "extreme difficulties attracting and maintaining a sufficient network of physicians to meet [residents'] needs." Moreover, the measure emphasizes substantive reforms that are primarily intended to limit the potential liability of certain health care providers for negligent actions. However, the legislation encompasses numerous "procedural" provisions, which may be equally important as the substantive reforms that …
