Self-Regulation And Securities Markets, Adam C. Pritchard Jan 2003

Self-Regulation And Securities Markets, Adam C. Pritchard

Articles

Enron, Arthur Andersen, Tyco, ImClone, WorldCom, Adelphia - as American investors reel from accounting scandals and self-dealing by corporate insiders, the question of trust in the securities markets has taken on a new urgency. Securities markets cannot operate without trust. Markets known for fraud, insider trading, and manipulation risk a downward spiral as investors depart in search of safer investments. Today, many investors are rethinking the wisdom of entrusting their financial futures to the stock market. Absent trust in the integrity of the securities markets, individuals will hoard their money under the proverbial mattress.

Adr Without Borders, Theodore J. St. Antoine Jan 2003

Adr Without Borders, Theodore J. St. Antoine

Articles

My task is to assess the ways in which alternative dispute resolution procedures may be adapted to deal with international labor disputes. ADR refers to various methods by which neutral third parties assist persons engaged in a conflict to settle their differences without involving the decision-making power of the state or other sanction-imposing body. Both mediation and arbitration are included. In mediation the neutral seeks to get the parties to agree on a mutually acceptable solution. In arbitration the neutral imposes a solution after presentations by the contending parties. A third term, conciliation, is sometimes used and generally connotes a …

Learning To Trust: Thoughts From A Law Clinic, David A. Santacroce Jan 2003

Learning To Trust: Thoughts From A Law Clinic, David A. Santacroce

Articles

The State Bar Legal Education Committee is now the Legal Education and Professional Standards Committee. This marriage seems an apt occasion to raise, through the prism of students, the issue of trust in client relations, though not in the traditional sense of "getting the client to trust me." Rather, the more ignored "getting me to trust the client" is the focus.

The Station Nightclub Fire And Federal Jurisdictional Reach: The Multidistrict, Multiparty, Multiforum Jurisdiction Act Of 2002, Peter Adomeit Jan 2003

The Station Nightclub Fire And Federal Jurisdictional Reach: The Multidistrict, Multiparty, Multiforum Jurisdiction Act Of 2002, Peter Adomeit

Faculty Scholarship

The Multidistrict, Multiparty, Multiforum Jurisdiction Act of 2002 has great potential for expediting The Station fire cases. The object of the Act is to place all of the cases from a mass disaster before a single judge, who can supervise discovery, then try the issue of liability, and either try or remand the issue of damages. How this new procedural tool will function is uncertain. The Act consolidates the power in one court to either urge the parties to accept a global settlement, or send the unresolved cases to trial. There are many unanswered questions. It is up to judges …

Perception Of Health, Hiv Clinical Disease Status, And The Use Of Complementary And Alternative Medicines Among A Cohort Of Hiv-Positive Women, Isis S. Mikhail Jan 2003

Perception Of Health, Hiv Clinical Disease Status, And The Use Of Complementary And Alternative Medicines Among A Cohort Of Hiv-Positive Women, Isis S. Mikhail

All ETDs from UAB

The objectives of this study are two-fold: (a) to assess the association between use of CAM and HIV clinical disease indicators; and (b) to assess the association between patient's self-perceived health status (POH) and clinical disease indicators. Clinical disease indicators were measured per CD4+ T-cell count, viral load, number of infections, CDC stage, and Karnofsky Performance Scores (KPS). This was a cross-sectional study including 391 HIV-positive women ages 18–50 years, living in Alabama and Georgia. Participants included 84% African Americans ( n = 327), 15% Caucasians ( n = 58), and 1% other races ( n = 6). A written …

Concealing And Confounding Adverse Signals: Insider Wealth-Maximizing Behavior In The Ipo Process, James S. Ang, James C. Brau Jan 2003

Concealing And Confounding Adverse Signals: Insider Wealth-Maximizing Behavior In The Ipo Process, James S. Ang, James C. Brau

Faculty Publications

We study a known negative signal, the sale of insider shares in an IPO and find that insiders adopt two concealment strategies consistent with wealth-maximizing behavior. First, insiders underreport the number of personally owned shares in the prominent original prospectus and use an obscure amendment to communicate the true higher level of shares to be offered. Second, when insiders increase shares in a later amendment, they tend to either increase secondary shares disproportional to primary share increases, or to reduce primary shares to wholly or partly conceal the increase in secondary shares offered. Insiders confound the negative secondary share signal …

Effect Of Triticum Turgidum Cytoplasm On Test Weight Of Soft Red Winter Wheat, Juan Mayta, Robert Bacon, John Kelly, Edward Gbur Jan 2003

Effect Of Triticum Turgidum Cytoplasm On Test Weight Of Soft Red Winter Wheat, Juan Mayta, Robert Bacon, John Kelly, Edward Gbur

Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences

The effect of Triticum turgidum cytoplasm on soft red winter wheat (T. aestivum) was studied relative to test weight (bushel weight) and agronomic traits such as heading date, resistance to leaf rust, and plant color. The cytoplasmic effects were studied in three genetic backgrounds by crossing the cultivars Jackson, Pioneer 2684, and Wakefield with a plant introduction PI590277 that carried T. turgidum cytoplasm. Twelve alloplasmic and euplasmic populations were developed through a backcrossing procedure. The study used a micro test weight procedure to compare F4 lines within the populations for test weight. The data for other agronomic traits were taken …

Storage Of Architectural Materials At The Syracuse University Library, Peter D. Verheyen, Carolyn Davis, Debra Olson Jan 2003

Storage Of Architectural Materials At The Syracuse University Library, Peter D. Verheyen, Carolyn Davis, Debra Olson

Librarian Publications

When the Department of Special Collections at the Syracuse University Library acquired the papers of Werner Seligmann, an architect and former Dean of the Syracuse University School of Architecture, the opportunity presented itself to develop a model storage system that could be applied to the other architectural drawings in the Department. While not large in comparison to these other collections, the Seligmann Papers were sizable enough to give us a better understanding of the storage issues involved if we decided to undertake the task of re-housing our other drawings. If such a task were to be undertaken, a new storage …

Global Changes In Scholarly Communication, Suzanne E. Thorin Jan 2003

Global Changes In Scholarly Communication, Suzanne E. Thorin

Librarian Publications

For more than a decade, the cost of print and electronic journals, particularly in the sciences, has increased rapidly at the same time that the amount of research being reported via published articles has grown exponentially. With academic libraries being less and less able to purchase the journals needed for their communities, the use of the term scholarly communication has evolved to illustrate the breakdown of the process of traditional scholarly publication; that is, as a means to disseminate research results, the present system of scholarly communication can no longer meet the needs of the scholarly community at large.

When …

The Springback: Account Book Binding, Peter D. Verheyen, Donia Conn Jan 2003

The Springback: Account Book Binding, Peter D. Verheyen, Donia Conn

Librarian Publications

These instructions for making a springback account book are derived from my notes as an apprentice at the Kunstbuchbinderei Klein, with adaptations over time. While my training is in the German tradition, the steps outlined should not be radically different from the English tradition. Although the technique was originally patented in Great Britain in 1799 by John and Joseph Williams,) the authors have found very few descriptions of this method in contemporary English language texts. Alex J. Vaughan describes the technique with great detail in Section II, 'Stationery Binding' of Modern Bookbinding. There is also an historical mention in Bernard …
