Attempting To Discuss Race In Business And Corporate Law Courses And Seminars, Cheryl L. Wade Jan 2003

Attempting To Discuss Race In Business And Corporate Law Courses And Seminars, Cheryl L. Wade

St. John's Law Review

(Excerpt)

The challenges of teaching corporate social responsibility and good corporate citizenship have shifted as political and social climates have changed in New York, the United States, and around the world. I discuss some of those challenges in this Article. My primary focus, however, is the challenge of talking about race in business and corporate law courses and seminars.

Sovereignty - Modern: A New Approach To An Outdated Concept, John H. Jackson Jan 2003

Sovereignty - Modern: A New Approach To An Outdated Concept, John H. Jackson

Georgetown Law Faculty Publications and Other Works

This article, however, does not purport to cover all possible dimensions of sovereignty but, instead, focuses primarily on what might be thought of as the core of sovereignty - the "monopoly of power" dimension - although it will be clear that even this focus inevitably entails certain linkages and "slop-over penumbra" of the other sovereignty dimensions. This "core" dimension is examined in the context of its roles with respect to international law and institutions generally, and international relations and related disciplines such as economics. National government leaders and politicians, as well as special interest representatives, too often invoke the term …

The Professional Professor, Kent D. Syverud Jan 2003

The Professional Professor, Kent D. Syverud

Vanderbilt Journal of Transnational Law

Welcome to the Vanderbilt Law School and to this happy occasion in which we reflect on the life and career of Jonathan Charney. I say this is a "happy" occasion deliberately. There have been two months and a lot of tears since Jonathan died, and I know for many people here including me the loss is still deeply felt in expected and unexpected ways. But we are celebrating today, and we should be happy as we reflect on the extraordinary career and accomplishments and life of Jonathan Charney.

Jonathan I. Charney: A Tribute, Richard B. Bilder Jan 2003

Jonathan I. Charney: A Tribute, Richard B. Bilder

Vanderbilt Journal of Transnational Law

I first met Jonathan in 1967 when he was a student in my international law class at the University of Wisconsin Law School. It was only my second year of teaching--I had just come to Wisconsin after some years with the State Department's Office of Legal Adviser. But Jonathan was a generous and forgiving, as well as excellent, student and somehow we both got through the course. Anyway, Jonathan became, first, the student of whom I was most fond; then, as his career developed, the student of whom I was most proud; and, eventually, as the years passed and our …

Patent First, Litigate Later! The Scramble For Speculative And Overly Broad Genetic Patents: Implications For Access To Health Care And Biomedical Research, Ikechi Mgbeoji, Byron Allen Jan 2003

Patent First, Litigate Later! The Scramble For Speculative And Overly Broad Genetic Patents: Implications For Access To Health Care And Biomedical Research, Ikechi Mgbeoji, Byron Allen

Articles & Book Chapters

One of the theoretical premises of the patent system is that it enhances the dissemination of valuable information by assuring creators of new inventions a limited monopoly for the exploitation of their inventions. As a tool of state policy, the patent system seeks to catalyze the industrialization of the state, disclosure of information by inventors, and ultimately, the enrichment of the public domain in a manner that benefits both the inventor and the Society. Consequently, the patent system is often characterized as a form of contract between the inventor and the state. As a consideration for disclosing the secret of …

Integrated Chiller System Reduce Building Operation And Maintenance Costs In Cold Climates, N. Sheets, Mingsheng Liu Jan 2003

Integrated Chiller System Reduce Building Operation And Maintenance Costs In Cold Climates, N. Sheets, Mingsheng Liu

Durham School of Architectural Engineering and Construction: Faculty Publications

Although water-cooled chillers are more energy efficient than air-cooled chillers, a majority of chilled water systems use air-cooled chillers. In cold weather climates, air-cooled chillers are capable of functioning in low ambient temperatures with few operational concerns, where as water-cooled chiller systems must be equipped to prevent cooling tower freezing. The integrated chiller system attempts to take advantage of each chiller’s strengths and eliminate any cold weather operational concerns. An integrated chiller system includes a cooling tower and air-cooled condenser. During the summer, both the cooling tower and air condenser can be operated. In cold weather, the cooling tower is …

Acoustic Communication In Panthera Tigris: A Study Of Tiger Vocalization And Auditory Receptivity, Edward J. Walsh, Lily M. Wang, Douglas L. Armstrong, Thomas Curro, Lee G. Simmons, Joann Mcgee Jan 2003

Acoustic Communication In Panthera Tigris: A Study Of Tiger Vocalization And Auditory Receptivity, Edward J. Walsh, Lily M. Wang, Douglas L. Armstrong, Thomas Curro, Lee G. Simmons, Joann Mcgee

Durham School of Architectural Engineering and Construction: Faculty Publications

To adults and children alike, tigers are one of the best-known members of the animal kingdom. It may be surprising, then, to learn that we have a lot to discover about their hearing and the acoustics of their vocalizations. To help fill in the gaps in our knowledge, we are in the midst of a study that is focused on the characterization of the vocal properties and hearing capabilities of a subset of surviving tiger subspecies, namely the Siberian, Bengal, Sumatran and the Indochinese tigers. We are hoping that our findings will not only add to a deeper understanding of …

You Have Discussed Lepers And Crooks. Sanism In Clinical Teaching, Michael L. Perlin Jan 2003

You Have Discussed Lepers And Crooks. Sanism In Clinical Teaching, Michael L. Perlin

Articles & Chapters

There is a robust clinical literature on how issues of race and gender may influence all aspects of the clinicalsetting: the relationship between student and client, the relationship between student and student, the relationship between student and clinical supervisor, the attitude of the fact-finder toward the clinical client. But there has been virtually no attention paid to the role of sanism in the clinical setting.

Sanism is an irrational prejudice of the same quality and character as other irrational prejudices that cause and are reflected in prevailing social attitudes of racism, sexism, homophobia and ethnic bigotry. It permeates all aspects …

What Happened To The Skeptical Environmentalist, David Schoenbrod, Christi Wilson Jan 2003

What Happened To The Skeptical Environmentalist, David Schoenbrod, Christi Wilson

Articles & Chapters

This essay focuses on the critical reaction to Bjorn Lomborg's book, The Skeptical Environmentalist. After the book was glowingly reviewed in the Washington Post, the Economist, and other influential publications, it was critically reviewed in Scientific American, Nature, and Science and criticized by environmental organizations. The criticism went beyond trying to show him wrong on environmental policy to claim that he should be disqualified as a participant in debates on environmental policy. The basis for the disqualification was that he does not understand the science or was disingenuous in his treatment of it. In analyzing this effort to disqualify him, …

Legal Services In The Doha Round, Sydney M. Cone Iii. Jan 2003

Legal Services In The Doha Round, Sydney M. Cone Iii.

Articles & Chapters

As a subcategory of professional services and a sub-subcategory of business services, legal services, when supplied transnationally, are the subject of negotiation in the current round of multilateral trade negotiation known as the Doha Round. The negotiations on legal services that take place in the Doha Round have considerable potential for affecting the economics and activities of lawyers and law firms, and for influencing the content of local professional rules governing the practice of law. This article examines that potential.

Legal Services And The Doha Round Dilemma, Sydney M. Cone Iii. Jan 2003

Legal Services And The Doha Round Dilemma, Sydney M. Cone Iii.

Articles & Chapters

This article examines the nexus between two international topics, namely, trade negotiations, and regulation of the cross-border practice of law. Admittedly, this nexus is not found at a conventional crossroads. Legal services lie somewhat at the periphery of international trade measured in terms of the global value of goods, services and investment used to define major international economic relationships, or to define priorities in the formulation of national and transnational economic policies. Moreover, trade negotiators hardly figure amongst the principal regulators having responsibility for the professional conduct of individuals and firms engaged in the practice of law.

Notwithstanding the somewhat …

Roots "Resolving The Death Penalty: Wisdom From The Ancients", Robert Blecker Jan 2003

Roots "Resolving The Death Penalty: Wisdom From The Ancients", Robert Blecker

Articles & Chapters

Lest it be cruel and unusual, the U.S. Supreme Court has held, capital punishment must be consistent with the evolving standards of decency of a maturing society. Although controversy swirls around our current sense of decency, this Society's changing standards are largely the product of deeply embedded traditions and an unchanging cultural core. Thus, virtually every heated death penalty debate today requires us not only to take the temperature of the people, but also to appreciate their temperament.

ROOTS: Resolving the Death Penalty: Wisdom from the Ancients reflects the current controversy back onto the core of Western Culture - the …
