Morphology, mitochondrial DNA (mtDNA) restriction fragment polymorphisms (RFLPs) and nuclear DNA (nDNA) fingerprinting were used to clarify relationships among the morphologically similar Ophiostoma and Leptographium species associated with mycangia of three Dendroctonus bark beetles (Ophiostoma clavigerum associated with both D. ponderosae and D. jeffreyi, and L. pyrinum associated with D. adjunctus), as well as a closely related nonmycangial bark beetle associate (L. terebrantis). Most isolates of O. clavigerum form long (40-70 μm), septate conidia, while all isolates of L. terebrantis and L. pyrinum form conidia less than 17.0 μm in length. Foam fractionation is an adsorptive-bubble separation method that, according to researchers, is a feasible technique for the separation and/or concentration of proteins. The foam fractionation of bovine serum albumin (BSA) in laboratory-scale foam fractionation columns (750 and 1250 mL) and the relationship between the two laboratory-scale columns and a pilot-scale column (5000 mL) were investigated. Recovery, enrichment, and performance factor values were experimentally determined with three different column volumes with varying pore sizes, gas superficial velocities, and, in the case of the 750 mL column, foam column height. Coping With Cafos: How Much Notice Must A Citizen Give - Community Ass'n For Restoration Of The Environment V. Henry Bosma Dairy, Martin A. Miller

In the context of reviewing Community Ass’n for Restoration of the Environment v. Henry Bosma Dairy, this Note focuses on what constitutes sufficient notice and suggests how citizen groups should handle additional violations discovered after suit has been filed. Although the Ninth Circuit had previously taken a fairly strict approach in interpreting notice requirement, Bosma Dairy indicates a shift toward a more forgiving approach by allowing the plaintiff to include certain non-noticed violations in its lawsuit. This urges the continued movement away from a rigid and formalistic approach.

Redshift-Distance Survey Of Early-Type Galaxies: Spectroscopic Data, G. Wegner, M. Bernardi, C. N. A. Willmer, L. N. Da Costa

We present central velocity dispersions and Mg2 line indices for an all-sky sample of ~1178 elliptical and S0 galaxies, of which 984 had no previous measures. This sample contains the largest set of homogeneous spectroscopic data for a uniform sample of elliptical galaxies in the nearby universe. These galaxies were observed as part of the ENEAR project, designed to study the peculiar motions and internal properties of the local early-type galaxies. Using 523 repeated observations of 317 galaxies obtained during different runs, the data are brought to a common zero point. These multiple observations, taken during the many runs …

Personal jurisdiction standards outlined in International Shoe Co. v. Washington have proven to be inadequate. This Article begins in Part II with an examination of the origins of the International Shoe minimum contacts test, and then in Part III analyzes and critiques the opinion and the test. Part IV looks at later Supreme Court cases that attempt to refine and apply the test, and Part V looks at the same pattern for other federal courts and state courts. After examining the North Carolina v. Alford decision in detail, this Article will first look at the broad arguments in favor of this type of plea. This Article will then focus on the body of case law dealing with the Alford plea and its effect on sentencing, probation and parole. While examining these cases this Article will also focus on the variety of arguments offered by criminal defendants who contend that it is impermissible to require an Alford-type defendant to express remorse for the offense or admit to the offense in any other context. Class Actions And Ex Parte Communications: Can We Talk, Douglas R. Richmond

The subject of ex parte communications with class members is a murky one. Here the rules of civil procedure and professional responsibility overlap as in no other area, and case law is relatively scarce. Insofar as class actions are litigated in federal courts, another problem is that many of the decisions on this subject are district court decisions, which lack precedential force. In sum, lawyers’ need for guidance in this area is significant and seems destined to grow in importance as class action litigation continues to spread.

Understanding The Difference Between The Right To Subrogation And Assignment Of An Inusrance Claim - Keisker V. Farmer, Jennifer A. Bueler

Trinity Universal Insurance Company wrote a policy that did not expressly create an assignment of its policyholder’s future claims and, as a result, recovered only a fraction of the amount it paid to the policyholder. Had Trinity carefully drafted its policy to create an assignment of the insured’s claims, it might have recovered the entire amount from those responsible for the damages. For this reason, insurance companies need to understand the difference between assignment and subrogation. Furthermore, insured individuals need to understand this distinction so that they are aware of their own rights and obligations.

We Didn't Know Any Better Defense: The Eighth Circuit's View Of Qualified Immunity For Jail Officers Who Detain Arrestees - Hill V. Mckinley, The, William E. Roberts

The Supreme Court has imparted the old common-law immunity to law-enforcement officers in actions for violations of constitutional rights. Defendants no longer have to stand trial on a federal claim for damages based on their unconstitutional actions unless a court has previously established with sufficient clarity and particularity that such actions are indeed a constitutional violation. Through examination of Hill v. McKinley, this Note argues that "qualified immunity" is beginning to be extended beyond its intended use.

The 2002 Supreme Court Decisions: Did They Leave Enough Of Apprendi To Effectively Protect Criminal Defendants?, Charlotte Leclercq

This comment explores the true impact of the 2000 landmark decision, Apprendi v. New Jersey, in which the United States Supreme Court determined that any fact that increases a criminal defendant's sentence beyond the statutory maximum has to be submitted to a jury and proven beyond a reasonable doubt. At the time, the decision appeared to be a triumph for the procedural due process rights of defendants. However the opinion of the majority, as well as those of the concurrence and dissents, left the actual effect of the decision subject to considerable debate among courts and commentators. Theoretical Investigation Of The Surface Vibrational Modes In Germanium Nanocrystals, Shang-Fen Ren, Wei Cheng, Peter Y. Yu

We have used a microscopic lattice dynamical model to study phonon modes in germanium (Ge) NC with size varying between 47 to 7289 atoms (diametersimilar to6.8 nm). By separating these atoms into bulk and surface atoms we have found that surface modes can exist in Ge NC both at low frequencies (<50>cm(-1)) and at high frequency (similar to260 cm(-1)). The latter mode is a resonant mode which occurs in the "pseudogap" between the acoustic and optical phonon branches in bulk Ge. Purpose: To explore texture features in two-dimensional images to differentiate seborrheic keratosis from melanoma.
Methods: A systematic approach to consistent classification of skin tumors is described. Texture features, based on the second-order histogram, were used to identify the features or a combination of features that could consistently differentiate a malignant skin tumor (melanoma) from a benign one (seborrheic keratosis). Two hundred and seventy-one skin tumor images were separated into training and test sets for accuracy and consistency. Automatic induction was applied to generate classification rules. Data analysis and modeling tools were used to gain further insight into the feature space. …

Credit History And The Performance Of Prime And Nonprime Mortgages, Anthony Pennington-Cross

Although nonprime lending has experienced steady or even explosive growth over the last decade very little is known about the performance characteristics of these mortgages. Using data from national secondary market institutions, this paper estimates a competing risks proportional hazard model, which includes unobserved heterogeneity. The analysis examines the performance of 30-year fixed rate owner occupied home purchase mortgages from February 1995 to the end of 1999 and compares nonprime and prime loan default and prepayment behavior. Nonprime loans are identified by mortgage interest rates that are substantially higher than the prevailing prime rate. Results indicate that nonprime mortgages differ …

Viewers of local television newscasts across the United States are regularly exposed to crime news stories. Crime coverage by local television stations is studied with an interest in how live reporting, dramatic video, and timeliness influence perceptions of race in the United States. Crime coverage did not always identify the race of a suspect because that information often was not available from police. However, when violent criminals or suspects were identified, race normally was shown through a mug shot, photograph, or video from the scene. When an African-American suspect was shown in police custody, the images tended to reinforce existing …

In last month's column, I wrote about the presence of Spanish in Omaha, attested by its occasional appearances in the broader English-speaking market. I also mentioned the phenomenon of people speaking two or more languages, called bilingualism. When a person has command of two languages, then that person is considered bilingual.
Considering that one language (like Swahili) might be called a code, and another language (Arabic) is another code, and a third language (like English) is another code, then conceivably a person who lives in Tanzania might carry on a conversation with another speaker from Tanzania in three different languages …
