After summarizing the main points of Kagan’s book, the review responds to Kagan’s perception of power using the assumptions of international law, contrasting his definition of power to that of several international legal scholars. It then places Kagan’s realist approach in a broader context of international relations and international legal theory, beginning with a discussion of challenges to realism, and concluding with an examination of the growing body of “integrationist” literature which posits that the fields of international law and international relations are merging. Cooperative Investments Induced By Contract Law, Urs Schweizer

This paper revisits the economic analysis of contract law for a setting of cooperative investments. While Che and Chung (1999) have shown that expectation damages perform rather poorly, the present paper argues that this negative result follows from their impicit assumption of unilateral expectation damages. Yet, the very nature of cooperative investments gives rise to the possibility that both parties may claim expectation damages. It is shown that such a regime of bilateral expectation damages provides the incentives for the first best solution even in a framework of binary choice where, for selfish investments, the traditional overreliance result would hold.

We develop a model to analyze and to compare the corporate leniency programs in the EU and the USA. Both programs are based on the idea that strategic interactions between the team members can be used to increase expected fines by reducing fines for self-reporting firms. This is in sharp contrast to the well-known literature on the single violator case where self-reporting schemes can never lead to higher deterrence. This dissertation did not attract much attention, and the author himself hardly did any further research on its topic. Taking in mind the development of law-and-economics some decades later, however, the book is highly remarkable. Public Finance Solutions to Vehicle Emissions Problems in California

All urban centers in California violate the Federal standard for ozone. So far, the State has addressed vehicle emission problems with a variety of mandates. In contrast, economic theory suggests that costs of achieving air quality can be minimized by the use of incentive policies such as permits, taxes, or subsidies. The purpose of the research described in this monograph is to explore incentive programs that might be added to the State’s repertoire of effective vehicle pollution reduction policies. The monograph is not very technical in nature, but it explains our theoretical approach, numerical simulation model, and statistical estimation.

The present article proposes two step-down multiple testing procedures for asymptotic control of the family-wise error rate (FWER): the first procedure is based on maxima of test statistics (step-down maxT), while the second relies on minima of unadjusted p-values (step-down minP). A key feature of our approach is the test statistics null distribution (rather than data generating null distribution) used to derive cut-offs (i.e., rejection regions) for these test statistics and the resulting adjusted p-values. For general null hypotheses, corresponding to submodels for the data generating distribution, we identify an asymptotic domination condition for a null distribution under which the …

A micro-machined drug delivery device and method of use for the delivery of labile drugs is disclosed. A micro-machined sensing device and method of use is also disclosed. A micro-machined drug delivery and sensing device and method of use is additionally disclosed. All three devices are intended to be inserted into a patient's body. The objective of this study was to identify differentially expressed genes in the anterior pituitary (AP) of sows selected for enhanced reproductive phenotypes. Selection in the Index (I) line was based on an index of ovulation rate and embryo survival, whereas random selection was used in the Control (C) line. Average numbers of fully formed piglets at birth were 12.5 ± 1.5 and 9.9 ± 2.0 for Line I and C sows used in this study, respectively. Litter (n = 8,424) and female performance records were collected in two breed-to-wean production units in order to evaluate genetic line differences for sow longevity and maternal performance over four parities. Lines evaluated were American Diamond Genetics, Danbred North America, Dekalb-Monsanto DK44, Dekalb-Monsanto GPK347, Newsham Hybrids, and National Swine Registry. Females within a line were derived from a minimum of 65 sires, 197 dams (three dams per sire), and a maximum of three daughters per dam, except in the GPK347, which were produced using semen from 12 Nebraska Index boars mated with Dekalb-Monsanto Line 34 females.
