There is a striking incongruence between the discussions of negligence in the legal literature, including the American Law Institute's Restatement of Torts, and the understandings of ordinary people and the actual practice of the courts. The legal literature generally assumes that an aggregate-risk-utility test is employed to determine whether conduct was reasonable or negligent. This test was invented by legal academics and inserted in the first Restatement during the first part of the twentieth century, although, as recent studies all conclude, it had almost no support in the cases prior to its adoption in the Restatement and for several decades …

This article identifies and discusses the three principal limitations on the extent of legal responsibility for tortiously caused harm and explains and justifies them by reference to the principle of interactive justice, which holds one legally responsible for causing (or being imminently about to cause) harm to another's person or property as a result of conduct that is inconsistent with others' right to equal freedom. The three principal limitations prevent liability for a tortiously caused harm when (1) the harm almost certainly would have occurred anyway in the absence of any tortious conduct or condition (the "no worse off" limitation), …

Defending Conventions As Functionally A Priori Knowledge, David J. Stump

Philosophy

Recent defenses of a priori knowledge can be applied to the idea of conventions in science in order to indicate one important sense in which conventionalism is correct—some elements of physical theory have a unique epistemological status as a functionally a priori part of our physical theory. I will argue that the former a priori should be treated as empirical in a very abstract sense, but still conventional. Though actually coming closer to the Quinean position than recent defenses of a priori knowledge, the picture of science developed here is very different from that developed in Quinean holism in that …

Field and laboratory studies were conducted in 2000 and 2001 to determine the feasibility of mass marking western corn rootworm adults, Diabrotica virgifera virgifera LeConte, with RbCl in the field. Results showed that application of rubidium (Rb) in solution to both the soil (1 g Rb/plant) and whorl (1 g Rb/plant) of corn plants was optimal for labeling western corn rootworm adults during larval development. Development of larvae on Rb-enriched corn with this technique did not significantly influence adult dry weight or survival. Rb was also highly mobile in the plant. The calorimetric properties of a CaEuZrO based sample, synthesized by a solid-state reaction process in the Electron Transport and Magnetic Properties of Materials (ETMPM) lab, are investigated by analyzing low temperature (2 -20 K) heat capacity data. The total heat capacity of a material may be expressed as C = Celec + Cph + Cnuc + Cmag + Ci. In mathematical terms, it may be expressed as C = yT + aT3 + An T-2 + Ci. Exceptional performances in Lawrence University’s recent production of Shakespeare’s “The Winter’s Tale” have earned students Brendan Marshall-Rashid and Matt Murphy invitations to the 2004 Irene Ryan Acting Scholarship Competition as part of the annual American College Theatre Festival.

Marshall-Rashid, a senior from Petoskey, Mich., and Murphy, a sophomore from Eagan, Minn., will be among 200 student actors participating in the five-state regional competition January 13-18, 2004 at Illinois State University in Normal, Ill.

This study examines the structure and operation of Medicaid and State Children's Health Insurance Program (SCHIP) health care access and quality monitoring systems for children enrolled in comprehensive managed care arrangements. As the single largest purchasers of pediatric health care in the U.S., Medicaid and SCHIP agencies play a potentially powerful role in pediatric health policy. How these agencies approach, design, and carry out health quality monitoring activities has the potential to have a major impact not only for poor and low-income children, but for the entire pediatric health system.
