The Price Of Education: What Local Control Is Costing American Children., Debra L. Ireland
The Price Of Education: What Local Control Is Costing American Children., Debra L. Ireland
The Scholar: St. Mary's Law Review on Race and Social Justice
Wealth and property are not equally distributed in America, and these inequities are exacerbated by the American school system. The current school system is community-centered, meaning children living in poorer districts do not have access to the same level of education as children living in wealthier districts. The comment discusses the impact that budgeting decisions have on community perceptions and expectations, as well as how community favoritism plays a role in the education financing equation. Finally, the author proposes eliminating what is essentially an “educational caste system,” and discusses how to change the attitudes of society and alter the ways …
Mind Your Own Business: The Trouble With Justice In Plato's Republic, John Patrick Coby
Mind Your Own Business: The Trouble With Justice In Plato's Republic, John Patrick Coby
Government: Faculty Publications
The Republic’s paradoxical definition of justice—minding one’s own business—comes mainly from Socrates’ examination of the arts. The definition applies well to artisans who specialize in single trades, but poorly to warriors who meddle in everyone’s affairs. Are the warriors then unjust? Rather than conclude that they are, the paper maintains that justice is conditioned by class and that the justice practiced by warriors (self-sacrificing and homogenizing) differs from the justice practiced by workers (self-serving and differentiating). But because the formal definition never changes, despite the awkwardness of fit, the paper further suggests that something is askew with justice, with its …
The Evolution Of Warning Signals As Reliable Indicators Of Prey Defense, Thomas N. Sherratt, Christopher D. Beatty
The Evolution Of Warning Signals As Reliable Indicators Of Prey Defense, Thomas N. Sherratt, Christopher D. Beatty
Biology
It is widely argued that defended prey have tended to evolve conspicuous traits because predators more readily learn to avoid defended prey when they are conspicuous. However, a rival theory proposes that defended prey have evolved such characters because it allows them to be distinguished from undefended prey. Here we investigated how the attributes of defended (unprofitable) and undefended (profitable) computer-generated prey species tended to evolve when they were subject to selection by foraging humans. When cryptic forms of defended and undefended species were similar in appearance but their conspicuous forms were not, defended prey became conspicuous while undefended prey …

Pay Secrecy/ Confidentiality Rules And The National Labor Relations Act, Rafael Gely, Leonard Bierman

This article seeks to provide a comprehensive account of doctrinal issues related to the use of pay secrecy/confidentiality rules (“PSC rules”) under the NLRA. In Part II, we describe what pay secrecy/confidentiality is and discuss recent survey evidence of their presence in workplaces across the United States. In Part III, we describe the current legal framework under which PSC rules are evaluated under the NLRA, while in Parts IV and V, we explore various doctrinal issues related to these rules in more detail. This leads us to Part VI, where we ponder the future of PSC rules under the NLRA …
Executing The Laws Or Executing An Agenda: Usurpation Of Statutory And Constitutional Rights By The Department Of Justice, Christopher C. Sabis
Executing The Laws Or Executing An Agenda: Usurpation Of Statutory And Constitutional Rights By The Department Of Justice, Christopher C. Sabis
University of Michigan Journal of Law Reform
The Department ofJustice (DOJ) can compel individuals and entities to sacrifice their constitutional or statutory rights. The DOJ can do so through brute political force, settlements and consent decrees, selective statutory enforcement, and prosecutions that coerce future actors not to pursue goals contrary to the policy desires of the executive branch. The current regime provides few constraints on the DOJ's ability to abuse its legal authority to achieve political objectives. This unbridled power jeopardizes the rights of both opposing and third parties.
This Note examines, in a bipartisan manner, the methods the Justice Department employs that deprive opponents or third …

In these affairs, no gun is needed. The victims do it all themselves. And the bullets never miss.--Bruce Jackson, CounterPunch , May 2003 Libraries play an important role in community building by supporting the public sphere to provide a commons environment that addresses the need for people to meet and interact with others. (1) Additionally, the library preserves historical and cultural memory and maintains resources for discourse and decision-making. However, since the tragic events of September 11, 2001, and the passage of the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT) Act, …

Avoid Bald Men And People With Green Socks? Other Ways To Improve The Voir Dire Process In Jury Selection, Valerie P. Hans, Alayna Jehle
Avoid Bald Men And People With Green Socks? Other Ways To Improve The Voir Dire Process In Jury Selection, Valerie P. Hans, Alayna Jehle
Chicago-Kent Law Review
During jury selection, many courts adopt a minimal approach to voir dire questioning, asking a small number of close-ended questions to groups of prospective jurors and requiring prospective jurors to volunteer their biases. The Article describes research evidence showing that limited voir dire questioning is often ineffective in detecting juror bias. To improve the effectiveness of voir dire, the authors make four recommendations: (1) increase the use of juror questionnaires; (2) incorporate some open-ended questions; (3) expand the types of questions that are asked; and (4) allow attorneys to participate in voir dire.

This Land Is My Land: The Need For A Feasibility Test In Evaluation Of Takings For Public Necessity, Thomas J. Posey
Chicago-Kent Law Review
Federal and state governments, through the use of eminent domain, may condemn the property of a private landowner and use that property to meet a public necessity. If the landowner challenges the condemnation, the courts generally perform an extremely narrow review of the government's decision to take the land. In order to prevail, the landowner must show either that the taking was in violation of constitutional or statutory provisions, or that some gross impropriety such as fraud or abuse of discretion occurred. However, landowners generally may not base their challenges on the grounds that the proposed project is unfeasible or …

Creation, Liberation, And Property: Virtues And Values Toward A Theocentric Earth Ethic, W. Wade Berryhill

Religion continues to play a significant role in shaping our attitudes toward nature.2 Time-honored principles of stewardship of the land demand that we owe a duty to future generations to allow them to inherit a healthy environment. Essential to this obligation is spiritual faith, not the trendy brand of secular humanism espoused by ecodogmatists seeking environmental justice through means unmoored from centuries-old principles of creation. What secular humanism ignores-and what religious traditions the world over have recognizedis the reality that we are a "creative expression of the earth's own evolution."3 Thus, in light of our duty to posterity, mere emphasis …

Meeting The Challenge: Training An Aging Population To Use Computers, Carol Bean
The Southeastern Librarian
Older adults present a special challenge to libraries offering computer training. Many of those seeking training have little, if any, prior experience with the concepts and skills necessary to use computers, yet their ability to learn those concepts and skills is hampered by the aging process. This article summarizes the factors in aging which most affect learning computer skills, and how those factors can be mitigated.

How Safe Do Individuals Feel In Clayton County?, Scott M. Clemens
How Safe Do Individuals Feel In Clayton County?, Scott M. Clemens
Theses and Dissertations
To determine if individuals feel safe in their communities, a self- administered questionnaire was distributed to six hundred residents of Clayton County, Georgia. In addition to overall safety, the survey sought to measure how being a victim of a burglary or rape and the level of income impacts the individuals' feeling of safety. The survey also sought to measure how safe those same individuals believed the community was for their children and how likely a terrorist attack was in the county. Non- probability sampling, specifically the accidental sample, was used for conducting the research. The results of the survey show …
