A Guide For Buying Electronic Resources In A Consortial Environment: Using Georef As An Example, Adonna Fleming Jan 2003

A Guide For Buying Electronic Resources In A Consortial Environment: Using Georef As An Example, Adonna Fleming

University of Nebraska-Lincoln Libraries: Faculty Publications

Two cultural phenomena have greatly impacted library purchasing trends in the last few years. One, the Internet and its ability to provide instant access to electronic information, which in tum has created a huge demand for libraries to provide their information resources in electronic format; and two, the spiraling downward oflibrary budgets ITom which to pay for these electronic resources. In other words, the "perfect storm" has struck libraries at hurricane force. In order to survive, libraries have formed consortia to increase their purchasing power while offsetting costs. This in tum creates a "one package fits all" purchasing environment with …

John Noonan On Marriage And The Family: Continuity And Change In Doctrine, William J. Wagner Jan 2003

John Noonan On Marriage And The Family: Continuity And Change In Doctrine, William J. Wagner

Scholarly Articles

In support of its critique, this article first analyzes Judge Noonan's general methodological vantage and shows how he proceeds, within that vantage, to formulate general moral norms. Next, it compares Judge Noonan's work with trends in the reasoning of the United States Supreme Court between 1965 and the present to suggest that some of Noonan's assumptions about the longer-term consequences of his own methodology for stability and continuity in moral theology may be unwarranted. Finally, it argues that Noonan is not justified in assuming that adjudicative reasoning, without more, suffices for the formulation of general moral norms, or that transcendent …

A Performance Analysis Of Distributed Algorithms In Javaspaces, Corba Services And Web Services, Suresh Sunku Jan 2003

A Performance Analysis Of Distributed Algorithms In Javaspaces, Corba Services And Web Services, Suresh Sunku

UNF Graduate Theses and Dissertations

Implementation of distributed parallel algorithms on networked computers has always been very difficult until the introduction of service-oriented architectures (SOA) like JavaSpaces service, CORBA services and Web Services. Algorithms of the type Master/Worker pattern are implemented with relative ease using the SOAs. This project analyzes the performance of such algorithms on three contemporary SOAs namely JavaSpaces service, CORBA services and Web Services. These architectures make the implementations of distributed algorithms reasonably fault tolerant and highly and dynamically scalable. Also, the systems built on these architectures are generally loosely coupled and operate asynchronously.

In this project we measure and analyze the …

An Architectural Pattern For Adaptable Middleware Infrastructure, Jason J. Mitchell Jan 2003

An Architectural Pattern For Adaptable Middleware Infrastructure, Jason J. Mitchell

UNF Graduate Theses and Dissertations

Middleware technologies change so rapidly that designers must adapt existing software architectures to incorporate new emerging ones. This project proposes an architectural pattern and guidelines to abstract the communication barrier whereby allowing the developer to concentrate on the application logic.

We demonstrate our approach and the feasibility of easily upgrading the middleware infrastructure by implementing a sample project and three case studies using three different middlewares on the .NET framework.

J2ee Vs. Microsoft Dot Net: A Qualitative And Quantitative Comparison For Building Enterprises Supporting Xml-Based Web Services, Raquel V. Clark Jan 2003

J2ee Vs. Microsoft Dot Net: A Qualitative And Quantitative Comparison For Building Enterprises Supporting Xml-Based Web Services, Raquel V. Clark

UNF Graduate Theses and Dissertations

Increasing speed of networks and worldwide availability has made the World Wide Web the most significant medium for information exchange. Web technologies have become more and more important as large and small businesses continue to make their presence on the web. Today's businesses have more than just a "face" on the worldwide web. The use of a web browser is no longer restricted to viewing static pages. Browsers are becoming more and more a standard interface to a multifaceted reign of programs that live on the worldwide web. Two main technologies stand out for the implementation of web applications, Sun …

Comparison Of Javaspace And Corba Technologies, Anjani Kumar Jha Jan 2003

Comparison Of Javaspace And Corba Technologies, Anjani Kumar Jha

UNF Graduate Theses and Dissertations

With computer industry increasingly moving towards network-centric systems, particularly the Internet, competing technologies that help design and develop such systems are fast emerging in the marketplace. The fundamental characteristics of a networked environment are heterogeneity, partial failure, latency and difficulty of "gluing together" multiple, independent processes into a robust, scalable application. JavaSpaces, a shared memory paradigm, provides high-level coordination mechanism for Java easing the burden of creating distributed systems. Large class of distributed problems can be approached using Javaspaces' simple framework. JavaSpaces allows processes to communicate even if each was wholly ignorant of the others. CORBA on the other hand …

Dbunifier: A Framework For Automated Unification Of Textual Data In Multiple Remote Data Sources, John S. Dembowski Jan 2003

Dbunifier: A Framework For Automated Unification Of Textual Data In Multiple Remote Data Sources, John S. Dembowski

UNF Graduate Theses and Dissertations

Over time, advances in database technology and utilization have resulted in a rapid increase in the number and types of data sources. Simultaneously, numerous methods of unifying these various data sources have emerged. Research has shown that a more comprehensive set of data attribute matches between multiple schemas can be detected by combining a number of the unification methodologies as opposed to using a single method. In this research project, a unification framework, dbUNiFier, has been proposed as an approach to allow for easy integration of both existing and future unification methods and data sources.

Leasing Consumer Goods: The Spotlight Shifts To The Uniform Consumer Leases Act, Ralph J. Rohner Jan 2003

Leasing Consumer Goods: The Spotlight Shifts To The Uniform Consumer Leases Act, Ralph J. Rohner

Scholarly Articles

As a participant throughout the drafting process for the Uniform Consumer Leases Act ("U.C.L.A." or "the Act"), I believe that the Act deserves serious consideration in the state legislatures to fill gaps in existing consumer protections for consumer lessees. The Act complements the Uniform Commercial Code ("U.C.C.") Article 2A (Leases), which creates a basic legal framework for all leases of goods, commercial and consumer alike, and the federal Consumer Leasing Act, which prescribes advertising and disclosure rules for consumer leases. The U.C.L.A. is also intended to reinforce, or be reinforced by, certain existing state laws, such as those prohibiting unfair …

Three-Dimensional Reconstruction Algorithm For A Reverse-Geometry Volumetric Ct System With A Large-Array Scanned Source, Taly Gilat Schmidt, Rebecca Fahrig, Norbert J. Pelc Jan 2003

Three-Dimensional Reconstruction Algorithm For A Reverse-Geometry Volumetric Ct System With A Large-Array Scanned Source, Taly Gilat Schmidt, Rebecca Fahrig, Norbert J. Pelc

Biomedical Engineering Faculty Research and Publications

We have proposed a CT system design to rapidly produce volumetric images with negligible cone beam artifacts. The investigated system uses a large array scanned source with a smaller array of fast detectors. The x-ray source is electronically steered across a 2D target every few milliseconds as the system rotates. The proposed reconstruction algorithm for this system is a modified 3D filtered backprojection method. The data are rebinned into 2D parallel ray projections, most of which are tilted with respect to the axis of rotation. Each projection is filtered with a 2D kernel and backprojected onto the desired image matrix. …

Tolstoy And The Christian Lawyer, Raymond B. Marcin Jan 2003

Tolstoy And The Christian Lawyer, Raymond B. Marcin

Scholarly Articles

It may be that there is no literate person alive in the Western world who has not heard of Count Lyof Nikolaevich Tolstoi (Tolstoy), author of what some have called the quintessential novel among all recorded literature: War and Peace. It may also be that most literate persons are aware that Tolstoy was a moralist of some renown-of great renown in his day-whose pacifist thought presaged and influenced Mohandas K. Gandhi, the great and saintly Mahatma of India. One doubts, however, whether many are aware that Tolstoy penned what is perhaps the most devastating attack in all religious literature on …

Childhood Depression And Resiliency : An Evaluation Of The Devereux Early Childhood Assessment Program, Sarah Carroll Jones Jan 2003

Childhood Depression And Resiliency : An Evaluation Of The Devereux Early Childhood Assessment Program, Sarah Carroll Jones

Dissertations and Theses @ UNI

Some researchers have investigated the use of resiliency-building programs to prevent childhood depression in at risk populations (Comer, 1985; Gladstone & Beardslee, 2000; Seligman, 1995). The following study investigates the Devereux Early Childhood Assessment Program (DECA). The DECA Program is designed to build resiliency in preschool children by increasing factors that have been found to be related to resiliency: initiative, self-control, and attachment. The study evaluated the short-term effectiveness of the DECA Program. Two Head Start Centers participated in the study. Pretest DECA rating scales were completed by the classroom teachers. For the next three months the experimental classrooms used …

Young Children’S Responses To Conflictual Adult Conversation, Jessica A. Cartozian Jan 2003

Young Children’S Responses To Conflictual Adult Conversation, Jessica A. Cartozian

UNF Graduate Theses and Dissertations

The current study evaluated relationships among children's cognitions following exposure to scripted conflictual interactions between adults. Thirty- five mother-child dyads were assessed using self-report measures, and continuous measures of behavioral and physiological distress (cardiac function, skin conductance). Four hypotheses were investigated: Exposure to conflict would be related to greater distress following the conflictual script; attributional errors would be related to greater distress; child distress would be positively correlated with parental conflict at home; maternal psychopathology would be positively related with distress responses to the stimulus. All hypotheses were found to be non-significant. Explanations for non-significance include the normative sample, the …

The United Student-Athletes Of America: Should College Athletes Organize In Order To Protect Their Rights And Address The Ills Of Intercollgiate Athletics?, Marc Jenkins Jan 2003

The United Student-Athletes Of America: Should College Athletes Organize In Order To Protect Their Rights And Address The Ills Of Intercollgiate Athletics?, Marc Jenkins

Vanderbilt Journal of Entertainment & Technology Law

This note will focus on the legal feasibility and practicality of forming a student-athlete players association or union. It assumes that a strike is a possible avenue the CAC may take in the future. Unlike the professional sports unions, the make-up of athletes on college campuses is in constant flux. This will obviously make it harder to initiate a strike. Part I of the note will concentrate on the realities of major college sports and the athletes that play them. This background will establish why student-athletes may want to form a players association. Part II will analyze the NCAA governing …

Pop Goes The Commercial: The Evolution Of The Relationship Between Popular Music And Television Commercials, Nora Miles Jan 2003

Pop Goes The Commercial: The Evolution Of The Relationship Between Popular Music And Television Commercials, Nora Miles

Vanderbilt Journal of Entertainment & Technology Law

Although the use of new pop songs in commercials is a recent development, the fact that music plays an important role in advertising is certainly not news. Music is and has always been an integral part in nearly all commercial advertising campaigns. Since the advent of radio and television the consumer public has been exposed to marketing through music. In order to understand the implications of the trends in music advertising, this note examines the more traditional schemes of music in advertising. To that end, there are several different routes an advertiser can choose when selecting music for a particular …

Lack Of Copyright Term Harmony With The European Union Strikes A Sour Chord For Performing Artists And Labels, Alisa Roberts Jan 2003

Lack Of Copyright Term Harmony With The European Union Strikes A Sour Chord For Performing Artists And Labels, Alisa Roberts

Vanderbilt Journal of Entertainment & Technology Law

Everyday, more performing artists and labels in the United States lose a valuable revenue stream as their sound recordings fall into the public domain in the European Union (E.U.). While the rights of authors, composers, visual artists, and even film directors are protected under the E.U.'s copyright scheme for the life of the author plus seventy years, "related rights"--which include sound recordings--receive protection for a term of only fifty years. The fifty-year term, established by a 1993 European Union Council Directive ("Directive"), is not only lacking synchrony with author's rights within the E.U., but also puts the term of protection …

Making A Mountain Out Of A Mogul: Jeremy Bloom V. Ncaa And Unjustified Denial Of Compensation Under Ncaa Amateurism Rules, Gordon G. Gouveia Jan 2003

Making A Mountain Out Of A Mogul: Jeremy Bloom V. Ncaa And Unjustified Denial Of Compensation Under Ncaa Amateurism Rules, Gordon G. Gouveia

Vanderbilt Journal of Entertainment & Technology Law

This Note argues that the NCAA's interpretation of the amateurism provisions of the NCAA Division I Manual, with respect to Jeremy Bloom, is unreasonable, particularly in light of the NCAA's treatment of other dual-sport professional athletes. Consequently, the NCAA should create an exception to its amateurism provisions allowing Bloom and similarly-situated student-athletes to earn income from sources unrelated to the amateur sport in which they compete. Furthermore, since the NCAA Bylaws constitute a contract to which student-athletes are third-party beneficiaries, courts should provide a forum to ensure the consistent and equitable application of the provisions of that contract. Part I …

Major League Baseball's Answer To Salary Disputes And The Strike:, Brien M. Wassner Jan 2003

Major League Baseball's Answer To Salary Disputes And The Strike:, Brien M. Wassner

Vanderbilt Journal of Entertainment & Technology Law

Initially, this paper will briefly consider arbitration in general and then discuss the evolution of FOA and its implementation into MLB salary disputes. This paper will thereafter analyze the praises and criticisms of FOA, and establish that FOA is a superior mechanism for resolving salary disputes in professional sports because the FOA system is designed to facilitate negotiation and settlement rather than to resolve the dispute subsequent to adversarial hearings.

Almost Famous: Reality Television Participants As Limited-Purpose Public Figures, Darby Green Jan 2003

Almost Famous: Reality Television Participants As Limited-Purpose Public Figures, Darby Green

Vanderbilt Journal of Entertainment & Technology Law

This Note begins with an overview of the basic facets of privacy law, focusing on the tort of the public disclosure of private facts and its interaction with the First Amendment. Next, this Note explores the differences in rules for public, private, and involuntary public figures. The law of defamation is offered as a model for privacy law to emulate, specifically, the limited-purpose public figure created under Gertz and its progeny. Then, the issue of whether one's status as a public figure may diminish over the passage of time is considered. This Note posits that limited-purpose public figures should exist …

New Video Game: Japan's Video Game Producers Lose At The Litigation Game, Dan Rosen Jan 2003

New Video Game: Japan's Video Game Producers Lose At The Litigation Game, Dan Rosen

Vanderbilt Journal of Entertainment & Technology Law

Video games present a legal problem that may be more difficult for courts to solve than the games themselves. In Japan, each court took a somewhat different approach. In its opinion, the Tokyo District Court tried to differentiate between movies and video games by focusing on the role of the audience. That court emphasized the fact that while movie audiences are passive and have no effect on the course of the movie, video game audiences actively affect the progression of the storyline. To illustrate the difference that the Tokyo Court emphasized, consider the Pokemon cast. They were originally characters in …

Beliefs About The Appropriate Degree Of Directiveness In The Management Relationship, As Related To Demographic Characteristics, Educational Background, And Organizational Position, Janet L. Pershing Jan 2003

Beliefs About The Appropriate Degree Of Directiveness In The Management Relationship, As Related To Demographic Characteristics, Educational Background, And Organizational Position, Janet L. Pershing

Harold L. Hodgkinson Award for Outstanding Dissertation

Correlations between beliefs about management and age, gender, nationality, level of education, education field, functional area, and hierarchical level were examined. Analyses were conducted at the ecological level and focused on beliefs regarding appropriate degree of directiveness in the managerial relationship. Two thousand staff members of an international intergovernmental organization received an electronically distributed written survey. Factor analysis was used to develop summated rating scales for each independent variables. Differences between subgroup means were then examined using ANOVA or t tests. The strength of the association between the independent variables and a common scale was assessed using eta squared. Directiveness …

Fiduciary Duty: Can It Help Calm The Fears Of Underpaid Artists?, Wendy Bartholomew Jan 2003

Fiduciary Duty: Can It Help Calm The Fears Of Underpaid Artists?, Wendy Bartholomew

Vanderbilt Journal of Entertainment & Technology Law

The purpose of this note is to examine the legal causes and consequences of what many consider poor label accounting practices, and to propose a solution: imposing a duty on record labels to correctly and transparently collect and distribute artist royalties. If labels operate under a fiduciary duty to their artists when receiving and paying royalties, artists will get paid what they are due. If they are not, artists will have viable remedies available to them--remedies that create an incentive for labels to make positive changes in the way they handle royalty accounting. This will, in turn, work to repair …

Is There Judicial Recourse To Attack Spammers?, Ashley L. Rogers Jan 2003

Is There Judicial Recourse To Attack Spammers?, Ashley L. Rogers

Vanderbilt Journal of Entertainment & Technology Law

This Note will discuss the issue of non-commercial spam through the prism of a case recently decided by the California Supreme Court, Intel v. Hamidi. Until recently there was no federal regulation for unwanted electronic communication and common law was the only potential solution. Part I of this Note will discuss the nature of spam, focusing on the distinction between commercial e-mail and bulk e-mail and the importance therein. Part II will detail the history and the legal doctrine of trespass as it applies to the Internet. Part III will summarize the case of Intel v. Hamidi as it struggled …
