Legal Services In The Doha Round, Sydney M. Cone Iii. Jan 2003

Legal Services In The Doha Round, Sydney M. Cone Iii.

Articles & Chapters

As a subcategory of professional services and a sub-subcategory of business services, legal services, when supplied transnationally, are the subject of negotiation in the current round of multilateral trade negotiation known as the Doha Round. The negotiations on legal services that take place in the Doha Round have considerable potential for affecting the economics and activities of lawyers and law firms, and for influencing the content of local professional rules governing the practice of law. This article examines that potential.

Legal Services And The Doha Round Dilemma, Sydney M. Cone Iii. Jan 2003

Legal Services And The Doha Round Dilemma, Sydney M. Cone Iii.

Articles & Chapters

This article examines the nexus between two international topics, namely, trade negotiations, and regulation of the cross-border practice of law. Admittedly, this nexus is not found at a conventional crossroads. Legal services lie somewhat at the periphery of international trade measured in terms of the global value of goods, services and investment used to define major international economic relationships, or to define priorities in the formulation of national and transnational economic policies. Moreover, trade negotiators hardly figure amongst the principal regulators having responsibility for the professional conduct of individuals and firms engaged in the practice of law.

Notwithstanding the somewhat …

Grandparent Visitation Claims: Assessing The Multiple Harms Of Litigation To Families And Children, Stephen A. Newman

Articles & Chapters

This article provides a detailed appraisal of the negative consequences of grandparent visitation lawsuits, and of the harms caused by state-coerced grandparent visitation, in the context of the malfunctioning extended family. I suggest that the special weight afforded a fit parent's decision should be very substantial, and that it should be dispositive of the case unless the grandparent can produce convincing evidence showing that extraordinary circumstances, involving clear harm to the child, justify court ordered visitation. This high degree of deference to parents derives from two features of grandparent visitation cases that deserve more attention than they have received so …

The Shape Of The Universe: The Impact Of Unpublished Opinions On The Process Of Legal Research, William R. Mills Jan 2003

The Shape Of The Universe: The Impact Of Unpublished Opinions On The Process Of Legal Research, William R. Mills

Articles & Chapters

Unpublished appellate judicial opinions present formidable challenges for modern legal researchers, from both practical and ethical points of view. The practice of selective publication of court opinions, and attendant court rules that restrict citation of unpublished opinions, have long been the subject of debate within legal profession. The recent case of Anastasoff v. United States, 223 F.3d 898 (8th Cir. 2000), vacated as moot 235 F.3d 1054 (8th Cir. 2000), has rekindled this debate, giving it a new constitutional dimension, and placing it squarely within the context of judicial accountability and the appropriate separation of powers among our branches of …

Two Colored Women's Conversation About The Relevance Of Feminist Law Journals In The Twenty-First Century, Taunya Lovell Banks, Penelope Andrews

Articles & Chapters

This is a critique by two non-white law professors in the form of a conversation about the relevance offeminist law journals on their lives and scholarship. We conclude that the impression that feministscholarship now is accepted in mainstream law reviews may be illusory and thus there is a continuing need for feminist law journals. In the past rather than creating a new type of journal, feminist law journals tend to replicate the traditional law journal model. Only the focus is different. Twenty years later not only do race and sexuality continue to separate us, but increasingly, careerism as well. The …

Heterogeneous Photocatalytic Reduction Of Ferrate(Vi) In Uv-Irradiated Titania Suspensions: Role In Enhancing Destruction Of Nitrogen-Containing Pollutants, Virender K. Sharma, Kurt Winkelmann, Yekaterina Krasnova, Changyoul Lee, Mary Sohn Jan 2003

Heterogeneous Photocatalytic Reduction Of Ferrate(Vi) In Uv-Irradiated Titania Suspensions: Role In Enhancing Destruction Of Nitrogen-Containing Pollutants, Virender K. Sharma, Kurt Winkelmann, Yekaterina Krasnova, Changyoul Lee, Mary Sohn

Chemistry and Chemical Engineering Faculty Publications

The results of the heterogeneous photocatalytic reduction of Fe(VI) in UV-irradiated TiO2 suspensions are presented and suggest indirect observation of the formation of Fe(V) by the photoreduction of Fe(VI) with ecb- at TiO2 surfaces. Because Fe(V) selectively and rapidly oxidizes low reactivity pollutants with the production of the non-toxic by-product, Fe(III), the photocatalytic reduction of Fe(VI) has a role in pollution remediation processes. The experiments were conducted as a function of TiO2 suspension concentrations, Fe(VI) concentrations, and pH in basic media. The initial rate of Fe(VI) reduction gave a fractional order with respect to initial Fe(VI) concentrations and adheres to …

Multiphoton Detachment Of A Negative Ion By An Elliptically Polarized, Monochromatic Laser Field, N. L. Manakov, M. V. Frolov, Bogdan Borca, Anthony F. Starace Jan 2003

Multiphoton Detachment Of A Negative Ion By An Elliptically Polarized, Monochromatic Laser Field, N. L. Manakov, M. V. Frolov, Bogdan Borca, Anthony F. Starace

Anthony F. Starace Publications

The quasistationary quasienergy state approach (QQES) is applied to the analysis of partial (n-photon) decay rates and angular distributions (ADs) of photoelectrons produced by an elliptically polarized laser field. The problem is formulated for a weakly bound electron with an energy E0 in the three-dimensional δ-model potential (which approximates the short-range potential of a negative ion) interacting with a strong monochromatic laser field having an electric vector F(ωt).The results presented cover weak (perturbative), strong (nonperturbative), and superstrong field regimes as well as a wide interval of frequencies ω extending from the tunnelling (ħω << |E0 …

Spin-Dependent Tunneling In Magnetic Tunnel Junctions, Evgeny Y. Tsymbal, O. N. Mryasov, Patrick R. Leclair Jan 2003

Spin-Dependent Tunneling In Magnetic Tunnel Junctions, Evgeny Y. Tsymbal, O. N. Mryasov, Patrick R. Leclair

Evgeny Tsymbal Publications

The phenomenon of electron tunneling has been known since the advent of quantum mechanics, but continues to enrich our understanding of many fields of physics, as well as creating sub-fields on its own. Spin-dependent tunneling in magnetic tunnel junctions (MTJs) has recently aroused enormous interest and has developed in a vigorous field of research. The large tunneling magnetoresistance (TMR) observed in MTJs garnered much attention due to possible applications in non-volatile random access memories and next-generation magnetic field sensors. This led to a number of fundamental questions regarding the phenomenon of spindependent tunneling. In this review article we present an …

Alteration Of Soil Water Content Consequent To Root-Pruning At A Windbreak/Crop Interface In Nebraska, Usa, Qingjiang Hou, James R. Brandle, Kenneth Hubbard, Michele Schoneberger, Carlos Nieto, Charles A. Francis Jan 2003

Alteration Of Soil Water Content Consequent To Root-Pruning At A Windbreak/Crop Interface In Nebraska, Usa, Qingjiang Hou, James R. Brandle, Kenneth Hubbard, Michele Schoneberger, Carlos Nieto, Charles A. Francis

United States Department of Agriculture, Forest Service / University of Nebraska-Lincoln: Faculty Publications

Root-pruning is generally recommended as an appropriate treatment to reduce competition for soil water and/or nutrients and suppression of crop yield in areas adjacent to windbreaks. Several recent studies suggest, however, that factors other than soil water might be causing yield reduction at the interface. For two consecutive years, we evaluated root-pruning effects on soil water at the windbreak/crop interface under both cropped (soybean [Glycine max (L) Merr.] variety ‘Iroquois’, 1997) and non-cropped (1998) conditions in Mead, Nebraska, USA. Volumetric soil water content near the windbreaks was systematically measured at various soil depths, distances from the windbreak, …

Duration Of Infection And Proportion Of Pigs Persistently Infected With Porcine Reproductive And Respiratory Syndrome Virus, Robert W. Wills, Alan R. Doster, Judith A. Galeota, Jung-Hyang Sur, Fernando A. Osorio Jan 2003

Duration Of Infection And Proportion Of Pigs Persistently Infected With Porcine Reproductive And Respiratory Syndrome Virus, Robert W. Wills, Alan R. Doster, Judith A. Galeota, Jung-Hyang Sur, Fernando A. Osorio

Nebraska Center for Virology: Faculty Publications

Understanding the dynamics of porcine reproductive and respiratory syndrome virus (PRRSV) persistence in individual pigs is essential to the development of successful control programs. The objectives of this study were to investigate the proportion of inoculated pigs that become persistently infected with PRRSV and the duration of their infection. Additionally, different diagnostic techniques that detect persistent infections were compared. Twenty-eight 35-day-old pigs were inoculated with PRRSV. Serum and tonsil biopsy samples were collected on days 0, 7, 14, and 28 and then approximately monthly thereafter until day 251 post-inoculation (p.i.). Tonsil, lymph node, and lung samples were collected following euthanasia …

Native Weeds And Exotic Plants: Relationships To Disturbance In Mixed-Grass Prairie, Diane L. Larson Jan 2003

Native Weeds And Exotic Plants: Relationships To Disturbance In Mixed-Grass Prairie, Diane L. Larson

United States Geological Survey, Northern Prairie Wildlife Research Center: Publications

Disturbance frequently is implicated in the spread of invasive exotic plants. Disturbances may be broadly categorized as endogenous (e.g., digging by fossorial animals) or exogenous (e.g., construction and maintenance of roads and trails), just as weedy species may be native or exotic in origin. The objective of this study was to characterize and compare exotic and native weedy plant occurrence in and near three classes of disturbance – digging by prairie dogs (an endogenous disturbance to which native plants have had the opportunity to adapt), paved or gravel roads (an exogenous disturbance without natural precedent), and constructed trails (an exogenous …

Effects Of Ungulates And Prairie Dogs On Seed Banks And Vegetation In A North American Mixed-Grass Prairie, Jace T. Fahnestock, Diane L. Larson, Glenn E. Plumb, James K. Detling Jan 2003

Effects Of Ungulates And Prairie Dogs On Seed Banks And Vegetation In A North American Mixed-Grass Prairie, Jace T. Fahnestock, Diane L. Larson, Glenn E. Plumb, James K. Detling

United States Geological Survey, Northern Prairie Wildlife Research Center: Publications

The relationship between vegetation cover and soil seed banks was studied in five different ungulate herbivoreprairie dog treatment combinations at three northern mixed-grass prairie sites in Badlands National Park, South Dakota. There were distinct differences in both the seed bank composition and the aboveground vegetation between the off-prairie dog colony treatments and the on-colony treatments. The three on-colony treatments were similar to each other at all three sites with vegetation dominated by the forbs Dyssodia papposa, Hedeoma spp., Sphaeralcea coccinea, Conyza canadensis, and Plantago patagonica and seed banks dominated by the forbs Verbena bracteata and Dyssodia papposa. The …

Socialization Of Boys And Girls In Natural Contexts, Carolyn P. Edwards, Lisa Knoche, Asiye Kumru Jan 2003

Socialization Of Boys And Girls In Natural Contexts, Carolyn P. Edwards, Lisa Knoche, Asiye Kumru

Department of Psychology: Faculty Publications

Socialization is the general process by which the members of a cultural community or society pass on their language, rules, roles, and customary ways of thinking and behaving to the next generation. Sex role socialization is one important aspect of this general process. The goals of earlier work were to understand how, why, and at what age girls and boys begin to vary behaviorally along such dimensions as "nurturance," "aggression," and "dependency," including determination of how sex-typical dispositions are influenced by cultural factors. This chapter presents a new approach seeking to answer such questions as the following. How are different …

Administrative Support And Challenges In Nebraska Public School Early Childhood Programs: Preliminary Study, Christine Marvin, Barbara Lacost, Marilyn Grady, Paul Mooney Jan 2003

Administrative Support And Challenges In Nebraska Public School Early Childhood Programs: Preliminary Study, Christine Marvin, Barbara Lacost, Marilyn Grady, Paul Mooney

Department of Special Education and Communication Disorders: Faculty Publications

One hundred seventy-six teachers employed in prekindergarten programs in Nebraska’s public schools were surveyed regarding their perceptions of the administrative supports and challenges associated with their programs. Both early childhood and early childhood special education teachers participated. Overall findings suggest that most administrators of early childhood programs advocate for quality programs and support teachers’ unique budgetary requests and work-hour schedules. Consistent with the findings from reports by Brotherson et al. (2001) and Lieber et al. (1997), teachers indicated that their supervisor (principal or other type of administrator) relied on them for knowledge about recommended practices in early childhood programs. Teachers …

A Shape-Based Approach To Change Detection Of Lakes Using Time Series Remote Sensing Images, Jiang Li, Ram M. Narayanan Jan 2003

A Shape-Based Approach To Change Detection Of Lakes Using Time Series Remote Sensing Images, Jiang Li, Ram M. Narayanan

Department of Electrical and Computer Engineering: Faculty Publications

Shape analysis has not been considered in remote sensing as extensively as in other pattern recognition applications. However, shapes such as those of geometric patterns in agriculture and irregular boundaries of lakes can be extracted from the remotely sensed imagery even at relatively coarse spatial resolutions. This paper presents a procedure for efficiently retrieving and representing shapes of interesting features in remotely sensed imagery using supervised classification, object recognition, parametric contour tracing, and proposed piecewise linear polygonal approximation techniques. In addition, shape similarity can be measured by means of a computationally efficient metric. The study was conducted on a time …
