Amends Constitution to provide that, except for medical emergency, or when waiver of notification has been obtained pursuant to state law, no abortion shall be performed upon an unemancipated minor until the physician notifies minor's parent or legal guardian. Statute provides definitions and authorizes monetary penalty and damages for violation. Statute permits minor to confidentially petition juvenile court for notification waiver based upon evidence of sufficient maturity, physical or sexual abuse by parent or guardian, or that notification is not in minor's best interests. …

Establishes optional, alternative school system for grades kindergarten through twelve under which privately operated schools would be licensed and regulated by the Department of Consumer Affairs. These schools would not be subject to regulation by the Superintendent of Public Instruction. Requires state funding of these schools equal to public schools based upon enrollment. Schools could develop curricula and methodologies and deliver educational services subject to standards applicable to private schools. They would be prohibited from engaging in sectarian or denominational instruction and would be subject to all state and federal nondiscrimination laws. Summary …

In the past, courts generally deferred to legislatures when determining whether a law constitutes a regulatory taking. However, not all regulations are treated equal, and different tests apply to different types of regulations. Types of land use actions with a lower threshold of constitutionally include exactions, and regulations that apply fixed fee schedules to private landowners. This article combs both federal and New York law to come to the clear determination that universal standards exist for each type of regulation.

The Role Of Mammalian Herbivores In Primary Succession On The Tanana River Floodplain, Interior Alaska, Lemuel Gordon Butler

Biological Sciences

I compared willow (Salix) communities along the Tanana River exposed to varying levels of herbivory to examine how herbivory influences the landscape distribution of vegetation. Moose (Alces alces) and snowshoe hare (Lepus americanus) herbivory decreased plant biomass and canopy height and increased the proportion of dead stems in willow communities. Herbivory also shifted the age distribution of plants in willow communities towards younger age classes, and also decreased the number of communities dominated by willow on the landscape. A frame-based simulation model was built to incorporate the effects of herbivory and river fluvial dynamics on plant succession. My results show …

Reindeer herding throughout the circumpolar North is in decline. Investigating this decline, this dissertation takes a comparative approach with a focus on four case studies: the Chukchi of Chukotskii Peninsula, the Iñupiat of the Seward Peninsula, the Saami of the Kola Peninsula, and the Saami of Finnmark. Because various rates and types of decline are occurring in these different cases, a comparative method leads to a systematic analysis of how patterns develop in the practice of contemporary reindeer herding, both locally and globally. Comparing and contrasting the trajectories of declines in reindeer herding identifies and explains the dimensions of specific …

Movements and habitat use of golden king crabs (GKC), Lithodes aequispinus, were investigated with a manned submersible and ultrasonic telemetry in Frederick Sound, Alaska. Crabs were collected with commercial crab pots and ultrasonic transmitters were attached to the carapaces of 26 crabs; movements and depth distribution of male and female crabs were monitored bi- monthly from May 11, 2000 to April 12, 2001. Crabs preferred steep, complex habitat with hard substrate; few were on flat, soft substrate. Male and female GKC were not segregated by depth in mid-May. This thesis reviews the constitutional rights of service members and how they are limited by the military. These affected rights include the First Amendment's rights to free speech, religious exercise and the ability to petition the government for redress of grievances; the Fifth Amendment's due process clause; and the Sixth Amendment's right to a jury of one's peers. The discussion section of this thesis argues two justifications used by the military for limiting service members' rights. The first justification is in support of good order, discipline and morale. Seasonal Abundance And Diversity Of Nearshore Fishes Around Steller Sea Lion Haulouts Of Kodiak Island, Catherine L. Hegwer

Nearshore fishes around haulouts are potential prey for Steller sea lions, especially pups, as they learn to forage and supplement their milk diets during weaning. Visual surveys in July and November 2001, and March, May and July 2002 were used to quantify spatial and temporal variation in fish diversity and abundance around two Steller haulouts and two control sites. SCUBA divers sampled depths of 9, 15, 21, 27, and 33 m. Concurrent habitat surveys were used to quantify substrate, macroalga and benthic invertebrate cover. Steller haulout sites had fewer fish than control sites, but similar species richness and species composition …

After summarizing the main points of Kagan’s book, the review responds to Kagan’s perception of power using the assumptions of international law, contrasting his definition of power to that of several international legal scholars. It then places Kagan’s realist approach in a broader context of international relations and international legal theory, beginning with a discussion of challenges to realism, and concluding with an examination of the growing body of “integrationist” literature which posits that the fields of international law and international relations are merging. The present study attempts to provide a more thorough understanding of public attitudes toward capital punishment. Two theories are tested toward this end, utilizing a random sample taken from the jury pool in Hillsborough County, Florida.

First, An indirect test of reference group theory demonstrates the degree to which faith group, religiosity, and race affect public attitudes toward the death penalty. Surprisingly, there is little, albeit mixed, support for reference group theory as it attempts to explain attitudes toward capital punishment. Using the relationships between religion and capital punishment attitudes that we presumed would emerge from the test of reference …

Previous heat capacity estimators used in path integral simulations either have large variances that grow to infinity with the number of path variables or require the evaluation of first- and second-order derivatives of the potential. In the present paper, we show that the evaluation of the total energy by the T-method estimator and of the heat capacity by the TT-method estimator can be implemented by a finite difference scheme in a stable fashion. As such, the variances of the resulting estimators are finite and the evaluation of the estimators requires the potential function only. By comparison with the task of …

In this paper, a novel approach based on the trigonometric equation solving technique is developed to solve the classical problem of celestial navigation. It is shown that this approach, namely, the simultaneous equal-altitude equations method (SEEM), can directly calculate the astronomical vessel position (AVP) without an additional graphical procedure. It is also found that the SEEM is not only simpler than the matrix method but is also more straightforward as compared with the spherical triangle method. The influence of tricalcium silicate content of cement on concrete durability has long been a topic of discussion in the literature. The objective of this investigation was to determine whether increasing tricalcium silicate content of cement has a negative effect on concrete sulfate durability. Several mill certificates were reviewed to select cements with similar tricalcium aluminate content and variable tricalcium silicate contents. Cements selected for this study were randomly labeled as cements C, D, D2, E, and P.

Over the last few years, our group has been working on applications of secure coprocessors---but has been frustrated by the limited computational environment and high expense of such devices. Over the last few years, the TCPA (now TCG) has produced a specification for a trusted platform module (TPM)---a small hardware addition intended to improve the overall security of a larger machine (and tied up with a still-murky vision of Windows-based trusted computing).
