Molecular And Culture-Based Analyses Of Aerobic Carbon Monoxide Oxidizer Diversity, Gary M. King

Isolates belonging to six genera not previously known to oxidize CO were obtained from enrichments with aquatic and terrestrial plants. DNA from these and other isolates was used in PCR assays of the gene for the large subunit of carbon monoxide dehydrogenase (coxL). CoxL and putative coxL fragments were amplified from known CO oxidizers (e.g., Oligotropha carboxidovorans and Bradyrhizobium japonicum), from novel CO-oxidizing isolates (e.g., Aminobacter sp. strain COX, Burkholderia sp. strain LUP, Mesorhizobium sp. strain NMB1, Stappia strains M4 and M8, Stenotrophomonas sp. strain LUP, and Xanthobacter sp. strain COX), and from several well-known isolates for which the capacity …

Beginning with establishment of a 4-H professional research and knowledge base in 1986, to the recent launch of an on-line master's degree in youth development by a consortium of land-grant universities, to the implementation of the U.S. Department of Labor's certificate in youth development, youth development has attained recognition as a discipline with an identified academic base. Land-grant universities should join the effort to enhance the scholarship of 4-H youth development professionals, not stifle it. Enabling Work For People With Disabilities: A Post-Integrationist Revision Of Underutilized Tax Incentives, Francine J. Lipman

American University Law Review

Federal employment strategies for people with disabilities do not seem to be working. Scholars argue that the Americans with Disabilities Act and similar legislation that exemplify the disability theory of integrationism with the goal of integrating people with disabilities into mainstream employment cannot succeed. Society cannot eradicate barriers to employment for people with disabilities simply by the integrationist modest approach of reasonable accommodation. A post-integrationist approach may be required to provide legitimate equal employment opportunities for people with disabilities.

Ponderomotive Shearing For Spectral Interferometry Of Extreme-Ultraviolet Pulses, Johan Mauritsson, Rodrigo López-Martens, Anne L'Huillier, Kenneth J. Schafer

We propose a novel method for completely characterizing ultrashort pulses at extreme-ultraviolet (XUV) wavelengths by adapting the technique of spectral phase interferometry for direct electric-field reconstruction to this spectral region. Two-electron wave packets are coherently produced by photoionizing atoms with two time-delayed replicas of the XUV pulse. For one of the XUV pulses, photoionization occurs in the presence of a strong infrared pulse that ponderomotively shifts the binding energy, thereby providing the spectral shear needed for reconstruction of the spectral phase of the XUV pulse. © 2003 Optical Society of America.

The sister of a manslaughter victim, on her mother’s behalf, brought an action against the felon, who wrote a book regarding the killing of the victim, seeking to recover the felon’s book proceeds under the Nevada “Son of Sam” law. The district court found the applicable Nevada statute to be unconstitutional and dismissed the plaintiff’s action. Plaintiff appealed.

The Effects Of Individual And Group Incentives On High And Low Performance, Heather M. Mcgee

This study examined the effects of individual and group monetary incentives on the performance of high and low performers. Participants were six college students who performed a computerized work task called SYNWIN. Participants earned points for correct responses and lost points for incorrect responses. The primary dependent variables were the total number of points earned per session and the percent correct per session. An ABAC within-subject reversal design was used, where A= individual incentives, B = group incentives (either high or low performance), and C = hourly pay.

Excavations at the Neolithic site of Abu Ghosh in the Jerusalem Hills uncovered two periods: the Pre-Pottery Neolithic B (PPNB) and the Pottery Neolithic (PN). This volume documents the results of the excavations of villages of these two consecutive periods, including architecture, lithics, groundstone, pottery, small finds and fauna. The PPNB village comprised domestic structures, courtyards, plaster floors and enclosing fences. Domestic activities took place in the courtyards. The PN village layout is less clear, as it was dug into the earlier remains. The faunal analysis reveals evidence of incipient domestication of wild goats in the PPNB assemblage, and by …

The Federal Highway Administration (FHWA) requires state transportation agencies to submit a biennial report on local highway finances. The purpose of these reports is to provide FHWA with the data it needs to capture the financing of highway activities at the local level. Based on this information, it can identify trends in revenue, expenditures, investments, and program development, and in turn make decisions about future investments. The U.S. government maintains a vast amount of personally-identifiable information on millions of American citizens. Much of this information is contained in electronic databases maintained by federal agencies. Various Freedom of Information Act (FOIA) requesters, such as journalists, marketers, and union organizers seek this information for different purposes including investigative reporting and targeted solicitations. These kinds of uses are known as "derivative uses" because this government-compiled information is requested for purposes other than the official purposes for which the information was originally gathered. These and other derivative uses of personally-identifiable information often implicate privacy concerns. Conversely, restrictions on public access …

This Article presents more evidence of the inequality that persists in legal education for students. Based on a survey of University of Florida law students conducted in 2001, this study reaffirms the existence of differential experience and an inegalitarian culture in legal education. However, it also demonstrates the importance of diversity and the recognition by a significant majority of students of the value of race and gender pluralism. These competing findings provide a clear guide to the future direction of legal education.

Lamb Shift Of Laser-Dressed Atomic States, Ulrich D. Jentschura, Jorg Evers, Martin K. Haas, Christoph H. Keitel

We discuss radiative corrections to an atomic two-level system subject to an intense driving laser field. It is shown that the Lamb shift of the laser-dressed states, which are the natural state basis of the combined atom-laser system, cannot be explained in terms of the Lamb shift received by the atomic bare states which is usually observed in spectroscopic experiments. In the final part, we propose an experimental scheme to measure these corrections based on the incoherent resonance fluorescence spectrum of the driven atom.

The article argues that the president does not require congressional authorization under the Declare War Clause to engage in hostile acts, as the Constitution's sparse language on war powers intentionally allows flexibility in foreign affairs. It contends that the Declare War Clause is a juridical act, not a prerequisite for initiating hostilities, and that the war powers are fundamentally political rather than legal in nature.

Ethical Issues In Defending A Terrorism Case: How Secrecy And Security Impair The Defense Of A Terrorism Case, Joshua L. Dratel

The article discusses the unique ethical and legal challenges faced by criminal defense attorneys in terrorism cases, particularly highlighting the impact of Special Administrative Measures (SAMs), the Foreign Intelligence Surveillance Act (FISA), and the Classified Information Procedures Act (CIPA). The article argues that post-9/11 laws, particularly the Antiterrorism and Effective Death Penalty Act (AEDPA) and the USA PATRIOT Act (USAPA), have dangerously expanded governmental power at the expense of civil liberties. These laws, through provisions like material support for terrorism and the designation of Foreign Terrorist Organizations (FTOs), enable prosecutions that often violate due process and First Amendment rights. The article contends that sacrificing civil liberties for national security is both unnecessary and harmful, part of a historical pattern that undermines democracy and the rule of law.

This publication reports the performance of entries in the 2003 South Dakota corn hybrid performance trials for both non-Roundup-Ready and Roundup-Ready hybrids. Information includes both the most recent 2-year and 1-year grain yields in bushels per acre; and 1-year bushel weight, moisture percentages of shelled corn at harvest, acre harvest population, and stalk lodging percentages. These performance trials are conducted by the South Dakota Crop Performance Testing ( CPT) program at South Dakota State University.
