Snapshots: Holistice Images Of Female Offenders In The Criminal Justice System, Jennifer Ward
Fordham Urban Law Journal
This Essay attempts to pull together the various threads of thought regarding the relationships between gender, race, and class within the justice system, and suggests possible patterns that could be used to create holistic images of female offenders. Part I provides a brief overview of the various explanations used over time to account for criminal behavior by women. Part II details the ways in which gender can affect the processes of the criminal justice system. Part III discusses the impact that race can have on the female offender's experience in the system. Part IV briefly overviews the types of influences …

Is The Experimental Use Exemption For Patent Infringement Still Needed?, 3 J. Marshall Rev. Intell. Prop. L. 103 (2003), Melanie K. Kitzan Haindfield
UIC Review of Intellectual Property Law
The judicially created experimental use exemption has traditionally been a limitation on a patent holder’s rights because it allows patent infringing activities involving research for mere curiosity or amusement. This exemption was later modified to further protect any research performed by institutions not having a profit motive for the patent infringement, resulting in many institutions freely infringing patented inventions, knowing that broad protection was available under the experimental use exemption. However, in 2002 the Federal Circuit effectively ended the experimental use exemption as a defense for academic institutions, by recognizing that academic institutions can be held liable for infringement for …

Historical Research In Music Education And The Historiography Of Kant, Spengler And Foucault, George N. Heller
Historical Research In Music Education And The Historiography Of Kant, Spengler And Foucault, George N. Heller
Research & Issues in Music Education
This essay examines historical research in music education in connection with historiography and the writing of history, using the works of three exemplary writers recently reviewed in book-length studies. Immanuel Kant (1724-1804) representing classic, enlightenment philosophy as it pertains to historiography was primarily a philosopher who wrote tangentially on history. Oswald Spengler (1880-1936), a modernist German historian and philosopher famous for his pessimistic tome, The Decline of the West (1924-26), was primarily a historian with an interest in philosophy. Michel Foucault (1926-1984), who stated the case for post-modern historiography from a French perspective, seems to have been interested in history …
Cultural Contexts Of Exclusion: Women College Band Directors, Elizabeth S. Gould
Cultural Contexts Of Exclusion: Women College Band Directors, Elizabeth S. Gould
Research & Issues in Music Education
Despite gender affirmative employment practices, women constitute little more than 5% of all U.S. college band directors. Researchers have investigated this situation in terms of historical precedent, traditional socialization, discrimination, segregation, professional identity, and lack of role models. They have not, however, addressed the culture of conducting college bands. Cultural analysis is essential because the percentage of women conducting college bands in the U.S. has remained virtually static during the past thirty years. It is appropriate because it provides a multi-layered, broader view of the problem which make possible explanations that may be more appropriately generalized and less subject to …

Between Reality And Rhetoric: The Epistemic Schism In The Recognition Of Traditional Medicine In International Law, Chidi Oguamanam
Between Reality And Rhetoric: The Epistemic Schism In The Recognition Of Traditional Medicine In International Law, Chidi Oguamanam
St. Thomas Law Review
This article is divided into five parts. The foregoing Part I, a brief introduction, highlights a few contemporary policy issues in the discourse about TM in international law and public health arenas. It identifies the epistemic schism between TM and the allopathic system as being at the root of the grandiose policy of integrating TM into national health systems. Premised on a multi-juridical framework, Part II examines select international legal and quasi-legal instruments, and probes the extent to which they make provisions for the protection of TM. Part III evaluates the international policy regime on TM, specifically as championed by …

Fire Climate Interactions And Predicting Fire Season Severity In The Mediterranean Climate Areas Of California, Southern Oregon, And Western Nevada, Alan H. Taylor, Carl N. Skinner, Andrew M. Carleton, Scott L. Stephens, Valerie Trouet, Bernd Haupt, Andrew Pierce
Joint Fire Science Program Research Project Reports
• We identified annual area burned for 37 National Forests in Washington, Oregon, and California between 1929 and 2004 from annual fire reports. Variation in area burned each year on National Forest lands is strongly related (r2 = 0.87) to total area burned in California. This indicates area burned in National Forests is a good indicator of total area burned in a state. • Four large groups of National Forests were identified that had similar temporal patterns of fire extent. Three of these groups were spatially coherent and included mainly: 1) Washington and northern Oregon; 2) northern California and California …

Zoonoses are of increasing importance to wildlife conservation and human health. It has become increasingly recognized that wildlife ecology plays a key role in disease transmission in wildlife populations. In domestic populations, contacts among individuals are controlled by humans and disease transmission is often density dependent. Unlike domestic animals, wildlife populations often have complex social systems in whch contacts among individuals are not solely density dependent, and can play an important role in the transmission and maintenance of disease.

New EPA Rules Targeting Livestock and Poultry Industry Congress passed the Clean Water Act (CWA) in 1972 to "restore and maintain the chemical, physical, and biological integrity of the Nation's waters." Among its core provisions, it prohibits the discharge of pollutants from a point source to waters of the United States except as authorized by an NPDES permit. EPA's regulation of concentrated animal feeding operations (CAFOs) under the CWA dates to the 1970s. EPA established effluent guidelines for feedlots in 1974 based on the best available technology that was economically achievable for the industry. CAFO regulations issued in 1976 determined …

Avhrr-Based Spectral Vegetation Index For Quantitative Assessment Of Vegetation State And Productivity: Calibration And Validation, Felix Kogan, Anatoly A. Gitelson, Edige Zakarin, Lev Spivak, Lubov Lebed
School of Natural Resources: Faculty Publications
The goal of the work was to estimate, quantitatively, vegetation state and productivity using AVHRR-based Vegetation Condition Index (VCI). The VCI algorithm includes application of post-launch calibration to visible channels, calculation of NDVI from channels’ reflectance, removal of high-frequency noise from NDVI’s annual time series, stratification of ecosystem resources, and separation of ecosystem and weather components in the NDVI value. The weather component was calculated by normalizing the NDVI to the difference of the extreme NDVI fluctuations (maximum and minimum), derived from multi-year data for each week and land pixel. The VCI was compared with wheat density measured in Kazakhstan. …

Cloning And Expression Of Dazl In Rana Pipiens, Jamie Boorech
Cloning And Expression Of Dazl In Rana Pipiens, Jamie Boorech
Electronic Theses and Dissertations
The DAZ gene on the human Y chromosome has been implicated in male fertility. Humans and other animals possess an autosomal version of this gene, referred to as DAZ-like or Dazl, which functions in gametogenesis and fertility. In order to expand our knowledge of Dazl, I cloned Dazl from the northern leopard frog Rana pipiens. To obtain the clone, I screened a R. pipiens ovary cDNA library with a RpDazl-specific PCR-generated radioactive probe. RpDazl, as determined by sequencing, is 3.5kb in length, with an 843 nucleotide open reading frame (ORF) and a 3' untranslated region (UTR) of 2635 nucleotides. At …

Transformation Of Arsenic Oxyanions In Bacterial And Model Systems, Ganna Polshyna
Electronic Theses and Dissertations
The HPLC-UV-Vis method with 7.5 mM sulfuric acid as a mobile phase and 195 nm wavelength detection was used for the separation and quantification of As(III) and As(V) in bacterial media used for growing of Clostridium sp. Strain OhILAs bacteria. In this method, the arsenic species were eluted in order As(V) > As(III), and the retention time were not affected by bacteria media matrix. It has been shown that the shape of the curve of increasing of the As(III) concentration is similar to that of bacteria growing. The main disadvantage of the present method is its failure to separate As(III) ions …
Using Pc12 Cells And Rat Cortical Neurons To Evaluate Poly(Caprolactone) And Collagenous Microcarriers For Applications In Nerve Guide Fabrication, Rebecca Waddell
Using Pc12 Cells And Rat Cortical Neurons To Evaluate Poly(Caprolactone) And Collagenous Microcarriers For Applications In Nerve Guide Fabrication, Rebecca Waddell
Electronic Theses and Dissertations
Tissue-engineered nerve guides can provide mechanical support as well as biochemical stimulation for nerve regeneration. PC12 cells and rat cortical neurons were used to test poly(caprolactone) (PCL), collagenous microcarriers (CultiSphers), and a novel composite of the two materials as an initial step in the fabrication of multi-channeled nerve guides. PC12 cells were found to attach, proliferate and differentiate on laminin-coated PCL and on CultiSphers. When the initial concentration of PC12 cells was increased, the percentage of CultiSphers with cells attached increased as well. Changing the cell culture conditions from static to dynamic, however, had the opposite effect on cell attachment. …

Oxonitriles: Cyclizations In Total Synthesis, Pravin Iyer
Oxonitriles: Cyclizations In Total Synthesis, Pravin Iyer
Electronic Theses and Dissertations
Oxonitriles are versatile synthetic intermediates. The thesis provides a survey of the synthesis and reactions of cyclic oxonitriles followed by an approach to Kuehneromycin A that features oxonitrile chemistry. The discussion presents a synthetic route to the sesquiterpenoid, Kuehneromycin A, using oxonitrile-based methodology. A key feature is a new oxidative cyclization reaction that has been developed as a method for assembling functionalized trans-decalins. The mechanism of this reaction is presented to explain the excellent stereoselectivity. Similarly, a mechanistic analysis of a novel isomerization of quarternary centers is presented in detail.

The Economic Potential Of Methane Recovery: Projected Impacts Of Various Public-Policy Scenarios, Richard R. Stowell, Christopher G. Henry
The Economic Potential Of Methane Recovery: Projected Impacts Of Various Public-Policy Scenarios, Richard R. Stowell, Christopher G. Henry
Nebraska Swine Reports
Economic analyses were performed on anaerobic digestion of manure from swine finishing operations. The main factors considered were facility size (1,000 head; 3,500 head; and 10,000 head) and method of financial support provided (cost-share program, no-interest loans, tax subsidies, and subsidized electrical sales). Installation of a digester system is a significant investment that is currently very difficult to justify economically to Nebraska producers based upon consideration of currently available income and expense estimates, regardless of facility size. Swine finishing operations looking to invest in this technology would benefit most from a no-interest loan or cost-share program – policies that relate …
