No Badges, No Bars: A Conspicuous Oversight In The Development Of An International Criminal Court, Mary Margaret Penrose
No Badges, No Bars: A Conspicuous Oversight In The Development Of An International Criminal Court, Mary Margaret Penrose
Faculty Scholarship
If the ICC is truly to become a world criminal court, then this body should begin to clothe itself with all the traditional components of a criminal justice system. A successful international criminal court cannot be dependent on the political will of so-called cooperating states. Crimes that fall within the jurisdiction of the ICC should be subject to prosecution by the court, which requires that there exist some body or agency capable of enforcing indictments and arresting suspected individuals. A court is but one piece of a greater body of criminal justice. In addition to the need for contemporaneous and …

International Drug Trafficking: Police Corruption On The Us/Mexico Border, John Jacob Rodriguez
International Drug Trafficking: Police Corruption On The Us/Mexico Border, John Jacob Rodriguez
Theses and Dissertations - UTB/UTPA
The purpose of this thesis was to examine contemporary extralegal factors for the causation of drug-specific police corruption, particularly drug trafficking on the US/Mexico Border. Police included only those officers who were commissioned by municipalities. The researcher focused on a particular geographical area of the US border region consisting of a quad-county area, which includes Willacy, Starr, Hidalgo, and Cameron Counties. This region was ideal for its unique demographic composition and location. This is qualitative research based on grounded theory, which consisted of purposive and snowball sampling. There was no hypothesis due to the inductive nature of this research. The …
The Tangled Web--Complexities, Fallacies And Misconceptions Regarding The Decision To Release Treated Sexual Offenders From Civil Commitment To Society, Leroy L. Kondo
Northern Illinois University Law Review
"When should a treated rapist, child molester or other sexual offender, convicted under a sexually violent predator statute, be released to society?" This question is fraught with multiple levels of complexity in a tangled web of misconceptions, fallacies, myths, and pitfalls reflected in the scientific and legal literature. Several excellent scientific reviews have documented tremendous progress in sexual recidivism research over the past few decades. However, decision-makers (e.g., psychiatrists, psychologists, social workers, judges, juries, district attorneys, public defenders, parole officers, and administrators of both correctional facilities and hospitals) remain confronted with a plethora of conceptual landmines and a morass of …

Proof Beyond A Reasonable Doubt: Shifting Sands Of A Bedrock?, Azhar J. Minhas
Proof Beyond A Reasonable Doubt: Shifting Sands Of A Bedrock?, Azhar J. Minhas
Northern Illinois University Law Review
It is a "bedrock" principle of our criminal jurisprudence, that the state has the burden of proving the guilt of the defendant beyond a reasonable doubt. A standard jury instruction to this effect is read out to the prospective jurors, prior to jury selection process, hinted upon (to put it mildly) during voir dire, and then again given to the selected jury panel at the close of all the evidence in a trial. In Illinois, however, at no point is the phrase "proof beyond a reasonable doubt" ever defined. In this state, it is assumed as a matter of law, …
The Good, Bad, And Unintended: American Lessons For Cambodia's Effort Against Domestic Violence, Sonja K. Hardenbrook
The Good, Bad, And Unintended: American Lessons For Cambodia's Effort Against Domestic Violence, Sonja K. Hardenbrook
Washington International Law Journal
Despite numerous laws that guarantee women equal rights and prohibit violence, the current Cambodian legal system has proven inadequate to combat spousal abuse. In response, the Royal Government of Cambodia has proposed a draft-law specifically aimed at domestic violence. However, if enforcement of current Cambodian law in domestic violence situations is any indication, the proposed law has little hope of implementation. Current cultural paradigms make the Cambodian police and the public at large view domestic violence as a private matter rather than a crime. Thus, Cambodia is in need of new strategies to reduce domestic violence. Cambodia is not alone …

Taint Teams And Firewalls: Thin Armor For Attorney-Client Privilege, Heidi Boghosian
Taint Teams And Firewalls: Thin Armor For Attorney-Client Privilege, Heidi Boghosian
Cardozo Public Law, Policy & Ethics Journal
The article argues that post-9/11 U.S. government policies, particularly the monitoring of attorney-client communications and the indictment of Lynne Stewart, significantly erode the attorney-client privilege and the Sixth Amendment right to effective counsel. These actions, justified under national security, undermine constitutional protections and set a dangerous precedent for legal representation, especially for controversial or politically sensitive cases.
Children As Chattel: Invoking The Thirteenth Amendment To Reform Child Welfare, Kurt Mundorff
Children As Chattel: Invoking The Thirteenth Amendment To Reform Child Welfare, Kurt Mundorff
Cardozo Public Law, Policy & Ethics Journal
The note argues that the child welfare system perpetuates systemic oppression and commodification of children, particularly targeting African American and poor families, mirroring the exploitation of slavery. The author contends that the Thirteenth Amendment, which prohibits slavery and involuntary servitude, should be invoked to reform this system. The current system prioritizes intervention and removal over support, leading to harm and perpetuating racial and economic disparities. The author advocates for a balanced approach that protects children while addressing the systemic exploitation and racial control embedded in the foster care system.

The Effect Of Prior Consensual Sex Between The Victim And The Offender On The Prosecutor's Decision To File Charges In Sexual Assault Cases., Kimberly Brooke Hollifield
Electronic Theses and Dissertations
Research has shown that both legal and extra-legal factors are used by the prosecutor in a sexual assault case when making the decision to file charges in the case. However, no study on sexual assault prosecutorial discretion, at this time, has examined the effect of prior consensual sex between the victim and the offender and the affect that it has on the prosecutor’s decision to file charges. Using data from a National Institute of Justice Study on sexual assault case processing, this study tests whether evidence of prior consensual sex between the victim and the offender plays a role in …
Community Correlates Of Rural Youth Violence, D. Wayne Osgood, Jeff M. Chambers
Community Correlates Of Rural Youth Violence, D. Wayne Osgood, Jeff M. Chambers
Center on Children, Families, and the Law: Faculty Publications
Rates of crime and delinquency vary widely across communities, and research going back many decades provides a good understanding of the nature, correlates, and probable causes of these community differences. Unfortunately, previous studies have been limited in an important way. Virtually all studies of communities and crime are based on large urban areas, almost totally excluding nonmetropolitan areas—that is, rural areas and smaller cities and towns. The findings in this Bulletin help to fill some gaps in the research by examining variations in rates of juvenile violence across nonmetropolitan communities in Florida, Georgia, Nebraska, and South Carolina.
Social disorganization is …

The Difference Between Truth And Truthfulness: Objective Versus Subjective Standards In Applying Rule 5c1.2, Molly N. Van Etten
The Difference Between Truth And Truthfulness: Objective Versus Subjective Standards In Applying Rule 5c1.2, Molly N. Van Etten
Vanderbilt Law Review
The drafters of the Violent Crime Control and Law Enforcement Act of 19941 sought to mitigate the effects of harsh mandatory minimum sentences for defendants who play minor roles in nonviolent drug crimes by creating a "safety valve" provision. This provision offers first-time offenders a way out of mandatory minimum sentences based on their minor participation in drug-related federal crimes. Typically, these first-time offenders are "mules," people asked or hired by drug dealers to transport drugs. According to the provision, defendants are eligible for relief if, among other requirements, they "truthfully provid[e] to the government all information and evidence the …

Individual Vulnerability And Cultural Transformation, Eric J. Mitnick
Individual Vulnerability And Cultural Transformation, Eric J. Mitnick
Michigan Law Review
Perhaps the most pressing problem in multicultural theory and practice today is the problem of individual vulnerability. Most interested theorists and multicultural states now accept the basic premise that some degree of state accommodation of minority cultural practice is required as a matter of justice. Debate then shifts to the best justifications for, and the appropriate extent of, such groupdifferentiated policy. Too often lost amid these discussions is the plight of vulnerable members of accommodated cultural groups: individuals subject to repression within their cultural groups, but who lose a critical aspect of their identities upon exit; individuals who would retain …
Essays On Political Constraints, Incentives, And Individual Economic Behavior, Steven F. Kreft
Essays On Political Constraints, Incentives, And Individual Economic Behavior, Steven F. Kreft
Graduate Theses, Dissertations, and Problem Reports (ETD)
This dissertation is a collection of papers that features applications of public choice theory to the relationship between political constraints, incentives, and individual economic behavior. The first chapter introduces the two meanings of political constraints---(i) constraints self-imposed on the political process and (ii) constraints created by the political process; reviews the public choice literature on political constraints and incentives; and outlines the research agenda for the dissertation. Chapter 2 examines the possible inefficiencies that may be produced by politicians pursuing their own self interests by comparing two forms of city government. More specifically, comparisons are made between professionally trained city …
The Effects Of U.S. Legislation On Acts Of Terrorism Against Americans Abroad, James Myles Casey
The Effects Of U.S. Legislation On Acts Of Terrorism Against Americans Abroad, James Myles Casey
All-Inclusive List of Electronic Theses and Dissertations
Historically, acts of international terrorism against Americans, even acts that have been conducted outside the territorial jurisdiction of the United States, have been handled with a diplomatic, intelligence and/or military response. In 1985, the United States began using a law enforcement or prosecutive model of responding to such acts of international terrorism. In this study, a review of the recent criminal and civil legislation against international terrorism was conducted. Further, a quantitative analysis of Americans killed overseas in acts of international terrorism, both prior to and after the initiation of U.S. legislation, was conducted in an attempt to discern if …
Life After Death Row: Preventing Wrongful Capital Convictions And Restoring Innocence After Exoneration, Jean C. Blackerby
Life After Death Row: Preventing Wrongful Capital Convictions And Restoring Innocence After Exoneration, Jean C. Blackerby
Vanderbilt Law Review
In Gregg v. Georgia, the Supreme Court overturned its ruling in Furman v. Georgia and held that the death penalty, as administered by the states, was not per se "cruel and unusual punishment" in violation of the Eighth Amendment.' Yet errors continue to occur at an alarming rate in the capital punishment system-over one hundred death row inmates have been released pursuant to evidence of actual innocence since 1973. Indeed, the number of death row exonerations has been steadily increasing in recent years.
Of those exonerations, DNA testing played a substantial role in twelve. Many more have benefited from the …

Tendencies In The Portrayal Of The National Civilian Police Of El Salvador By The Salvadoran Press, Carlos Ponce
All-Inclusive List of Electronic Theses and Dissertations
El Salvador, located in Central America, is a country that experienced a civil war during which its government fought for the prevalence of democracy and the rebel groups for a communist regime. The armed conflict ended in 1992 with a peace treaty signed by the two sides. After the end of the civil war, El Salvador was no longer a focus of international attention. As a result of the agreements reached in 1992, national security forces were abolished and a new national law enforcement agency was created: the National Civilian Police. Since the end of the civil war, El Salvador's …
