Lives, Life-Years, And Willingness To Pay, Cass R. Sunstein Jun 2003

Lives, Life-Years, And Willingness To Pay, Cass R. Sunstein

Coase-Sandor Institute for Law & Economics Research Paper Series

In protecting safety, health, and the environment, government has increasingly relied on cost-benefit analysis. In undertaking cost-benefit analysis, the government has monetized risks of death through the idea of "value of a statistical life" (VSL), currently assessed at about $6.1 million. Many analysts, however, have suggested that the government should rely instead on the "value of a statistical life year" (VSLY), in a way that would likely result in significantly lower benefits calculations for elderly people, and significantly higher benefits calculations for children. I urge that the government should indeed focus on statistical life-years rather than statistical lives. A program …

Mariella Batista approached the family court building in Riverside, California, 9- year-old son in tow, ready for her hearing. Her family law attorney, who had little domestic violence experience, had no time to meet with Mariella before the court date and arranged to meet her outside the courthouse before the hearing. Mariella, a Cuban immigrant, had a history of years of abuse at the hands of her partner and was attempting to gain control of her life by instituting legal action to gain custody of her son. Suddenly her estranged partner approached her and grabbed the boy. In fear, Mariella …

The State Of Domestic Violence Protective Orders In Hidalgo County, Texas, Cindy Noel Berner Jun 2003

The State Of Domestic Violence Protective Orders In Hidalgo County, Texas, Cindy Noel Berner

Theses and Dissertations - UTB/UTPA

Domestic violence has long been an issue for the criminal justice system and society. Despite decades of research, activism, and intervention programs, much remains to be accomplished. There are many facets to studying domestic violence. However, there are few studies that specifically deal with protective orders and what, if any, effect they have on the occurrence of domestic violence. The goal of this researcher was to discover whether there were any relationships between variables such as age, gender, and employment status and the decision to not issue a protective order. The data used in this study were obtained from the …

The New Imperialism: Violence, Norms, And The "Rule Of Law", Rosa Ehrenreich Brooks Jun 2003

The New Imperialism: Violence, Norms, And The "Rule Of Law", Rosa Ehrenreich Brooks

Michigan Law Review

The past decade has seen a surge in American and international efforts to promote "the rule of law" around the globe, especially in postcrisis and transitional societies. The World Bank and multinational corporations want the rule of law, since the sanctity of private property and the enforcement of contracts are critical to modern conceptions of the free market. Human-rights advocates want the rule of law since due process and judicial checks on executive power are regarded as essential prerequisites to the protection of substantive human rights. In the wake of September 11, international and national-security experts also want to promote …

The Social Construction Of Formal And Informal Expectations Of Army Officers' Wives, Lauren C. O'Donnell May 2003

The Social Construction Of Formal And Informal Expectations Of Army Officers' Wives, Lauren C. O'Donnell

Communication

This research study utilizes qualitative narrative analysis to better understand the lived experience of United States Army officers' wives, particularly in regard to the socially constructed expectations for officers' wives to assume traditional women's roles. The study is undertaken from the epistemology of Constructionism and the theoretical perspective of the social construction of reality. Narrative interviews with eight Army officers' wives revealed one principal emergent theme, labeled "Noblesse Oblige," as well as several sub-themes encompassing aspects of officer's rank and position as social status, perceived expectations of officers' wives and the resulting reactions and actions, and role preservation of officers' …
