Rethinking The Prohibition Of Death Row Prisoners As Organ Donors: A Possible Lifeline To Those On Organ Donor Waiting Lists., Donny J. Perales Jan 2003

Rethinking The Prohibition Of Death Row Prisoners As Organ Donors: A Possible Lifeline To Those On Organ Donor Waiting Lists., Donny J. Perales

St. Mary's Law Journal

Organ transplantation continually brings hope and new life to thousands of patients suffering from a myriad of diseases. Despite the advances in medical science and the increased survival rates of organ recipients, many are unable to receive an organ transplant because the demand for organs drastically exceeds the available supply. Much of the organ deficit lies in the current system of organ procurement. The altruism-based organ system leaves the donative decision to the individual; however, it is this system which hinders effective organ procurement. Under this system, the donor must give prior consent before a doctor can remove any organ. …

Determining The Retroactive Effect Of Laws Altering The Consequences Of Criminal Convictions, Nancy Morawetz Jan 2003

Determining The Retroactive Effect Of Laws Altering The Consequences Of Criminal Convictions, Nancy Morawetz

Faculty Articles

This Article traces the roots of the current emphasis on plea agreements to confusion about indicia of retroactivity in cases involving quasi-economic transactions and those involving laws that are targeted at wrongful conduct. Although economic transactions are properly evaluated in terms of standards such as reliance, reliance has no proper application with respect to laws that govern wrongful conduct. Instead, when wrongful conduct is at issue, the proper question is whether the person had fair notice of the degree of consequences.

Reaching For Justice: An Analysis Of Self-Help Prosecution For Animal Crimes, Jennifer H. Rackstraw Jan 2003

Reaching For Justice: An Analysis Of Self-Help Prosecution For Animal Crimes, Jennifer H. Rackstraw

Animal Law Review

Although prosecutorial discretion is a firmly entrenched legal doctrine in the United States, such unbridled discretion impedes the vigorous and consistent prosecution of animal crimes. With an overwhelming incidence of animal cruelty and neglect crimes perpetrated in the United States every year, documented cases should not be passed over for prosecution due to a lack of empathy on the part of the prosecutor, a misplaced understanding of the seriousness of animal cruelty crimes, or a dearth of resources. To ensure that animal crimes are more vigorously and consistently prosecuted, citizens should take advantage of existing mechanisms that allow for public …

Bête Noire: How Race-Based Policing Threatens National Security, Lenese C. Herbert Jan 2003

Bête Noire: How Race-Based Policing Threatens National Security, Lenese C. Herbert

Michigan Journal of Race and Law

This Article asserts that race-based policing, enabled and exacerbated by race-blind judicial review, creates an ire with a purpose that promises, especially after September 11, to make us all less safe. The illegitimate marginalization of American citizens aggravates an already alienated population and primes them for cooperation with those who seek to harm the United States. Race-based policing guts the expectation of fair-dealing, legitimacy, and justice in the criminal justice system, creating marginalized populations, especially of African Americans. Lack of judicial redress in the face of such policing irrevocably stains already beleaguered African Americans (and others so policed) as inferior …

The Accounts That Defendants Give For Crime: Relationship Between Accounts Given And The Perceived Seriousness Of The Crime, Danielle Bree Trammell Jan 2003

The Accounts That Defendants Give For Crime: Relationship Between Accounts Given And The Perceived Seriousness Of The Crime, Danielle Bree Trammell

Masters Theses

The present study examined whether the accounts that defendants give (i.e., apology, excuse, or justification) would have an effect on the perceived seriousness of the crime and assigned penalty. The study focused specifically on burglary, a non-violent crime. It also examined how participant characteristics, such as age, gender, political ideology, and history of victimization, affected the perceived seriousness and assigned penalty. This is a growing area of interest, given the societal impact of crime. There is significant disparity in sentencing that exists for perpetrators who are convicted of similar crimes. It is important to examine the possible explanations for this …
