"Are You Beginning To See A Pattern Here?" Family And Medical Discourses Shape The Story Of Black Infant Mortality, Elaine R. Cleeton
The Journal of Sociology & Social Welfare
Postmodern and poststructuralist theorizations of the interrelations of the particular and the universal have identified women's bodies to be the last frontier for scientific discovery leading to and satisfying the modern compulsion to stabilize and control life from birth to death. This institutional ethnography of one city's response to an elevated infant mortality rate among the babies of African American urban, impoverished women explores their discursive transformation from single mothers who cannot begin prenatal care before the second trimester because too few physicians will treat Medicaid patients, into sexually-immoral, illegaldrug- using women who deliberately harm their babies. The study locates …
Cleansing Moments And Retrospective Justice, Margaret M. Russell
Cleansing Moments And Retrospective Justice, Margaret M. Russell
Michigan Law Review
We live in an era of questioning and requestioning long-held assumptions about the role of race in law, both in criminal prosecutions specifically and in the legal process generally. Certainly, the foundational framework is not new; for decades, both legal literature and jurisprudence have explored in great detail the realities of racism in the legal system. Even among those who might prefer to ignore the role of race discrimination in more than two centuries of American law, denial is no longer a viable or intellectually defensible option. Rather, debate now centers upon whether or not the extensive history of American …

The Case For Jury Sentencing, Morris B. Hoffman
The Case For Jury Sentencing, Morris B. Hoffman
Duke Law Journal
There are powerful historical, constitutional, empirical, and policy justifications for a return to the practice of having juries, not judges, impose sentences in criminal cases. The fact that Americans inherited from the English a mild preference for judge sentencing was more a historical accident than a case of thoughtful policy. Jury sentencing became quite widespread in the colonial and postcolonial eras as a reflection of deep-seated mistrust of the judiciary. The gradual drift away from jury sentencing was driven not by a new-found faith in the judiciary, but rather by the now discredited paradigm of rehabilitationism. Now that that paradigm …

Challenging Forensic Evidence? Observations Of The Use Of Dna In Certain Criminal Trials, Mark Findlay, Julia Grix
Challenging Forensic Evidence? Observations Of The Use Of Dna In Certain Criminal Trials, Mark Findlay, Julia Grix
Research Collection Yong Pung How School Of Law
Our interest in forensic evidence, and in the use of DNA within criminal trials in particular, arises out of our recent responsibility to review the Crimes (Forensic Procedures) Act 2000 in New South Wales. This review engaged various methodologies to enable an understanding of forensic evidence procedures, from investigation through to courtroom practice. Crucially, the review explored the significance of DNA evidence within criminal trials in order to speculate on ways in which such evidence may be received by the trial 'fact-finders' in an appropriate and enlightening manner.

Fishing For Clarity In A Post-Hubbell World: The Need For A Bright-Line Rule In The Self-Incrimination Clause's Act Of Production Doctrine, Thomas Kiefer Wedeles
Vanderbilt Law Review
Americans have always taken particular pride in the right to be free from government intrusion into their homes and, metaphysically speaking, their minds. The authors of the Bill of Rights carved out this protective zone in the Fourth and Fifth Amendments to the United States Constitution.' While modern Fourth Amendment protection has most often been interpreted as a privacy-based protection, the Fifth Amendment's Self-Incrimination Clause protects against government compulsion to implicate oneself in the commission of a crime. The development of the Fifth Amendment privilege reflects many of this nation's "fundamental values and most noble aspirations." These values and aspirations …
Information Sharing And Interoperability In Law Enforcement: An Investigation Of Federal Criminal Justice Information Systems Use By State/Local Law Enforcement Organizations, David R. Dethlefs
Theses and Dissertations
This thesis investigates the frequency of use and perceptions of usefulness of federal criminal justice information systems among state and local law enforcement personnel and certain IS environmental factors that affect usage. The study is predicated by a demonstrated need for increased information sharing, interoperability, and collaboration among the three tiers of law enforcement as public safety threats within U.S. borders increase in complexity; e.g., the Murrah Federal Building bombing, Columbine High School shooting, 9/11 terrorist attacks, and D.C. sniper case. The results of this research indicate high usage and perceived usefulness of the National Crime Information Center Network (NCIC …
Text Manipulation Judgment Accuracy: An Exploratory Study, Randy S. Wardak
Text Manipulation Judgment Accuracy: An Exploratory Study, Randy S. Wardak
Theses and Dissertations
Deception aims to affect a decision-making process in a way that somehow benefits the deceiver. More knowledge is desired in the area of purely text-based scenarios. Thirty-seven graduate students at the Air Force Institute of Technology participated in an experiment in order to gain an initial understanding of how people determine whether text has been manipulated, and to identify specific areas that may be more closely investigated in future research. Excerpts were drawn from editions of a current-events newsletter that the participants receive on a weekly basis as part of their enrollment in the graduate program. Some of the excerpts …

Foreword: Why Retry? Reviving Dormant Racial Justice Claims, Martha Minow
Foreword: Why Retry? Reviving Dormant Racial Justice Claims, Martha Minow
Michigan Law Review
Two familiar arguments oppose lawsuits and legislative efforts to address racial injustices from our national past, and a third tacit argument can be discerned. "Why open old wounds?": this question animates the first argument. The evidence is stale - this expresses the second argument. The third, less explicit objection reflects worries that exposing some gross and unremedied racial injustices from the past will reveal the scale of imperfections in the systems of justice and government and thereby undermine the legitimacy of those systems. To introduce the meticulous and passionate essays in this Colloquium, I elaborate and respond to each of …

Retrying Race, Anthony V. Alfieri
Retrying Race, Anthony V. Alfieri
Michigan Law Review
This Essay investigates the renewed prosecution of long-dormant criminal and civil rights cases of white-on-black racial violence arising out of the 1950s and 1960s. The study is part of an ongoing project on race, lawyers, and ethics within the criminal-justice system. Framed by this larger project, the Essay explores the normative and sociolegal meaning of that resurgent prosecution. My hope in pursuing this inquiry is to better understand, and perhaps begin to refashion, the prosecutor's redemptive role in cases of racial violence. Both descriptive and prescriptive in nature, the inquiry addresses race in relation to law and community. Grappling with …

American Racial Jusice On Trial - Again: African American Reparations, Human Rights, And The War On Terror, Eric K. Yamamoto, Susan K. Serrano, Michelle Natividad Rodriguez
Michigan Law Review
Much has been written recently on African American reparations and reparations movements worldwide, both in the popular press and scholarly publications. Indeed, the expanding volume of writing underscores the impact on the public psyche of movements for reparations for historic injustice. Some of that writing has highlighted the legal obstacles faced by proponents of reparations lawsuits, particularly a judicial system that focuses on individual (and not group-based) claims and tends to squeeze even major social controversies into the narrow litigative paradigm of a two-person auto collision (requiring proof of standing, duty, breach, causation, and direct injury). Other writings detail the …
