Marketing Ireland In The Face Of Adversity., Angela Wright

Theses

This study is an examination of the factors which influence the success or failure of the tourism industry in Ireland. This research incorporates the views, opinions, and commentaries of leading figures in each sector of importance for this key industry within the Irish economy. An examination of various bodies charged with the management of the Irish tourism industry, since its inception as a recognised commercial entity, is included in this study. This research highlights the confusion that has surrounded the constitution, mandate, and nomenclature of these national management bodies in recent times.

A significant finding of this study is that, …

A Mind To Blame: New Views On Involuntary Acts, Deborah W. Denno Jan 2003

A Mind To Blame: New Views On Involuntary Acts, Deborah W. Denno

Faculty Scholarship

This article examines the legal implications linked to recent scientific research on human consciousness. The article contends that groundbreaking revelations about consciousness expose the frailties of the criminal law's traditional dual dichotomies of conscious versus unconscious thought processes and voluntary versus involuntary acts. These binary doctrines have no valid scientific foundation and clash with other key criminal law defenses, primarily insanity. As a result, courts may adjudicate like individuals very differently based upon their (often unclear) understanding of these doctrines and the science that underlies them. This article proposes a compromise approach by recommending that the criminal law's concept of …

Toward Validation Of The Sports Behavior Checklist: A Comparison Of Attention-Deficit/Hyperactivity Disorder And Control Group Children In A Sports Environment, Aaron Clendenin

LSU Master's Theses

Data from participants (N = 124) was entered into a principal components analysis to test the factor structure of the Sports Behavior Checklist ([SBC] Johnson & Rosen, 2000). The subscales of the SBC were correlated with relevant subscales of the Conners'- Revised Parent Form ( Conners, 1997) and Social Skills Rating System (Gresham & Elliott, 1990). Both of these analyses were conducted to determine the construct validity of the instrument. Additionally, a subsample (N = 92) of low socioeconomic status individuals was used to compare groups of Attention-Deficit/Hyperactivity Disorder (n = 49) and non-clinical (n = 43) children on the …

To Denmark And Back An Excerpt From The Unpublished Memoirs Of John M. Jensen, Frederik V. Jensen, Peter L. Petersen

The Bridge

The "most influential individual in the United Evangelical Lutheran Church's final twenty-five years" is how synod President William Larsen once described John M. Jensen1, longtime editor of The Ansgar Lutheran, the church's English language periodical. Jensen served the UELC as pastor, translator, historian, and representative, but it was through the pages of The Ansgar Lutheran that he had his greatest impact. Week after week for nearly twenty-five years, he wrote about spiritual matters, church policies and politics, questions of social justice, and events throughout the world, all the while serving full time as a church pastor. During World War II …

Family Research Council And Roe V. Wade, Gerard V. Bradley Jan 2003

Family Research Council And Roe V. Wade, Gerard V. Bradley

Journal Articles

Thirty years ago in Roe v. Wade the Supreme Court launched what it hoped would be a cultural revolution. Here are the inaugural words: "The right of privacy...is broad enough to encompass a woman's decision whether or not to terminate a pregnancy".

The revolution has progressed rapidly. The counter-strategies tried so far have been ineffective: we are no closer to overruling Roe than in 1973; the abortion liberty occupies an organizing place in our culture and politics; the number of abortions annually has remained remarkably steady over three decades.

The Public-Use Question As A Takings Problem, Nicole Stelle Garnett Jan 2003

The Public-Use Question As A Takings Problem, Nicole Stelle Garnett

Journal Articles

Government officials regularly use the power of eminent domain to benefit private entities, and just as regularly justify their actions with assertions about the need to promote "economic development." Rather, the remarkable thing about these cases is that the courts questioned the government's right to do so. In Hawaii Housing Authority v. Midkiff, the United States Supreme Court reaffirmed that the Fifth Amendment demands broad deference to a government's decision to exercise the power of eminent domain. Midkiff makes clear that "public use" challenges are subject to rational-basis review. That is, so long as a taking can be justified by …

The Public-Use Question As A Takings Problem, Nicole Stelle Garnett

Journal Articles

Government officials regularly use the power of eminent domain to benefit private entities, and just as regularly justify their actions with post hoc assertions about the need to promote economic development. In Hawaii Housing Authority v. Midkiff, the Supreme Court reaffirmed that the Fifth Amendment demands broad deference to a government's decision to exercise the power of eminent domain. Midkiff makes clear that public use challenges are subject to rational basis review; so long as a taking can be justified by some conceivable public purpose, it will be upheld. Yet in recent years, a number of courts have put the …

The American Influence On International Arbitration, Roger P. Alford Jan 2003

The American Influence On International Arbitration, Roger P. Alford

Journal Articles

It is indisputable that the international arbitration world is an identifiable epistemic community that transcends national borders, and whose members are shaped by their own experience. Increasingly, that experience reflects an American influence, be it heritage, training, affiliation, or client base. In these remarks, Professor Alford addresses three issues related to the Americanization of international arbitration. The first is whether international arbitration has, in fact, only recently become Americanized. He posits instead that there is always an ebb and flow to the level of the United States' involvement in international arbitration. During the drafting and signing of the 1958 New …

Leadership Development: Continuous Improvement Through Character Assessment, Robert Scott Clark Edd Jan 2003

Leadership Development: Continuous Improvement Through Character Assessment, Robert Scott Clark Edd

Dissertations

One of the keys to personal development is self-awareness as assessed by instruments such as the Myers-Briggs Type Indicator (MBTI) and the NEO PI-R, both of which are widely accepted reliable and valid indicators and measures of personality type. However, assessing the part of personality known as character presents challenges that are not adequately addressed by today's popular instruments leaving information needed for development incomplete or unavailable. An instrument that provides a reliable and valid assessment of character for leadership and personal development purposes could be very valuable. Qualitative methods were used for this study to investigate leaders' perceptions of …

Enabling Performance Skills: Assessment In Engineering Education, Jenny K. Ferrone Edd Jan 2003

Enabling Performance Skills: Assessment In Engineering Education, Jenny K. Ferrone Edd

Dissertations

Current reform in engineering education is part of a national trend emphasizing student learning as well as accountability in instruction. Assessing student performance to demonstrate accountability has become a necessity in academia. In newly adopted criterion proposed by the Accreditation Board for Engineering and Technology (ABET), undergraduates are expected to demonstrate proficiency in outcomes considered essential for graduating engineers. The case study was designed as a formative evaluation of freshman engineering students to assess the perceived effectiveness of performance skills in a design laboratory environment. The mixed methodology used both quantitative and qualitative approaches to assess students' performance skills and …

Hosford-Abernethy Bicycle And Pedestrian Connections: An Alternative Routes Analysis Linking Se Clinton Street And The Eastbank Esplanade, Shannon Axtell, Evan Mackenzie, Brady Smith, Allison Wildman Jan 2003

Hosford-Abernethy Bicycle And Pedestrian Connections: An Alternative Routes Analysis Linking Se Clinton Street And The Eastbank Esplanade, Shannon Axtell, Evan Mackenzie, Brady Smith, Allison Wildman

Master of Urban and Regional Planning Workshop Projects

SE Clinton is a popular bicycle route for commuter, utilitarian and recreational bicyclists that fails to provide a safe and direct connection to the Eastbank Esplanade and downtown Portland. Furthermore, residents in the Hosford-Abernethy and Brooklyn neighborhoods do not have a safe bicycle and pedestrian connection to access the Eastbank Esplanade. This gap in the bicycle and pedestrian network must be removed to serve the needs of bicyclists and pedestrians.

This project presents four alternative bicycle and pedestrian routes that connect the Eastbank Esplanade and the SE Clinton bikeway through the Central Eastside Industrial District. Each alternative, with improvements, is …

On The Proper Motives Of Corporate Directors (Or, Why You Don't Want To Invite Homo Economicus To Join Your Board), Lynn A. Stout Jan 2003

On The Proper Motives Of Corporate Directors (Or, Why You Don't Want To Invite Homo Economicus To Join Your Board), Lynn A. Stout

Cornell Law Faculty Publications

One of the most important questions in corporate governance is how directors of public corporations can be motivated to serve the interests of the firm. Directors frequently hold only small stakes in the companies they manage. Moreover, a variety of legal rules and contractual arrangements insulate them from liability for business failures. Why then should we expect them to do a good job?

Conventional corporate scholarship has great difficulty wrestling with this question, in large part because conventional scholarship usually adopts the economist's assumption that directors are rational actors motivated purely by self-interest. This homo economicus model of behavior may …
