Why (And How) Fairness Matters At The Ip/Antitrust Interface, Daniel A. Farber, Brett Mcdonnell
Why (And How) Fairness Matters At The Ip/Antitrust Interface, Daniel A. Farber, Brett Mcdonnell
Articles
This Article questions the widespread scholarly view that maximizing economic efficiency should be the sole goal of the intellectual property and antitrust laws. We propose that the law should also encourage a fair division of the economic surplus, at least by considering it as a tiebreaker when the dictates of economic efficiency are ambiguous or controversial. We begin by surveying some challenges that have been made to the theoretical underpinnings of exclusive reliance on economic efficiency, but go on to argue that, even on the terms of welfarism, some regard for distributive fairness is appropriate. First, since fairness is a …

Human Trafficking: Data and Documents
Trafficking in persons is modern day slavery. The trafficking of women, children, and men for sexual exploitation, sweatshop labor, involuntary domestic servitude, and migrant agricultural labor violations is estimated to affect hundreds of thousands of people worldwide annually – and tens of thousands in the United States alone. The practice of trafficking in persons is not only an affront to human dignity but also flouts the laws of legitimate commerce.

Girls’ Literacy In The Progressive Era: Female And American Indian Identity At The Genoa Indian School, Amy M. Goodburn
Girls’ Literacy In The Progressive Era: Female And American Indian Identity At The Genoa Indian School, Amy M. Goodburn
Department of English: Faculty Publications
The Progressive Era (1870–1930) is marked by several forces that shaped U.S. girls’ literacies, including the success of the common school movement (and coeducational high schools in particular), the progressive reform movement (especially in terms of progressive educators), new technologies of literacy and print media, women’s leadership in social welfare legislation, and the proliferation of women’s clubs and civic groups. All these forces shaped girls’ reading and writ ing practices in both constraining and empowering ways. In this chapter, I examine girls’ literacy experiences in the Progressive Era within the context of one group of American Indian girls who attended …

G03-1525 Coping In Stressful Times During Drought, Linda S. Boeckner, Kathy Bosch, Catherine E. Johnston
University of Nebraska-Lincoln Extension: Historical Materials
Families are affected by drought in many ways, including financially, emotionally, and physically. Although additional research is needed to learn how families cope with personal and work lives during drought, reliable information is available to understand how families react and cope with economic hardship, stressful times and difficult situations.
This NebGuide will address financial, emotional, and physical issues that families may experience during stressful times in addition to providing help on how families may access resources.
Students And Service Staff Learning And Researching Together On A College Campus, Diane Downer Anderson
Students And Service Staff Learning And Researching Together On A College Campus, Diane Downer Anderson
Educational Studies Faculty Works
Describes the preliminary study of a service learning program at Swarthmore College that paired students and college service staff in learning partnerships and as researchers of the program. Three primary questions were answered: How does service within a college campus count as service learning? How was the program community-shaping as well as personally enriching for students and staff? What place does participatory research have in service learning projects?

Rosalie Wahl's Vision For Legal Education: Clinics At The Heart, Ann Juergens
Rosalie Wahl's Vision For Legal Education: Clinics At The Heart, Ann Juergens
Faculty Scholarship
Rosalie Wahl holds a special place in the hearts of Minnesota lawyers. Many women and girls, especially, were gratified when Governor Rudy Perpich appointed her the first woman on the Minnesota Supreme Court in 1977. There were no more than nine other women on supreme courts around the country at the time, and none on the U.S. Supreme Court. She served on the court until 1994, when the law mandating judges’ retirement at age seventy caused her to step down from the bench. This essay highlights the significance of Wahl’s work as a clinical legal educator and activist for legal …
Propensity To Trust, Purchase Experience, And Trusting Beliefs Of Unfamiliar E-Commerce Ventures, Gregory B. Murphy
Propensity To Trust, Purchase Experience, And Trusting Beliefs Of Unfamiliar E-Commerce Ventures, Gregory B. Murphy
New England Journal of Entrepreneurship
Trust has become a major issue among online shoppers. This underresearched subject will predictably determine the success or failure of e-commerce vendors. The lack of face-to-face interaction, the inability to inspect goods and services prior to purchase, and the asynchronous exchange of goods and money all contribute to the perceived risk of purchasing online and the resulting need for trust. Trust is particularly critical for small and new Internet ventures confronted by the liability of newness (Stinchcombe 1965). Lacking, among other things, a name that is readily recognized in the marketplace, entrepreneurial Internet ventures require trust if they are to …
