Factors Affecting Plant Location Decisions Of U.S. Broiler Executives, Pramod Sambidi Jan 2003

Factors Affecting Plant Location Decisions Of U.S. Broiler Executives, Pramod Sambidi

LSU Master's Theses

The broiler operations in the United States, which are concentrated in the southeast and south central regions are unevenly distributed within those states. The major concern for Louisiana¡¯s broiler industry is that even though its production is increasing every year it is relatively low compared to many other southeastern states. This study analyzes the relative importance of factors that affect location decision of a broiler complex. A national survey of broiler industry executives is conducted to analyze site-specific factors related to the broiler-complex location problem. Conjoint analysis is used to measure the relative importance of each attribute in the location …

Augusto Boal's Theatre Of The Oppressed In The Public Speaking And Interpersonal Communication Classrooms, Jacqueline D. Burleson Jan 2003

Augusto Boal's Theatre Of The Oppressed In The Public Speaking And Interpersonal Communication Classrooms, Jacqueline D. Burleson

LSU Doctoral Dissertations

In this study, I document and analyze how I applied Boal's Theatre of the Oppressed (TO) techniques in introductory Public Speaking and Interpersonal Communication (IPC) courses. In the first chapter, Boal's democratic praxis is discussed in terms of critical performance pedagogy and Brecht's social aesthetics. I identify the qualitative social scientific method of data collection and analysis I used and base the significance of the study in my testing of TO in non-performance educational contexts and in the integrated communication studies curricula that resulted. In Chapter Two, I summarize Boal's career as an interactive theatre practitioner. My review includes synopses …

Law, Theory And Aboriginal Peoples, Gordon Christie Jan 2003

Law, Theory And Aboriginal Peoples, Gordon Christie

All Faculty Publications

Some Aboriginal people see domestic Canadian law as alien and oppressive. This paper explores one source of this perception. By examining the layers of theory and world-view upon which the law is based, it finds conflict with the sensibilities of Aboriginal peoples. The author argues that a liberal vision supports and enlivens the law, and because it is grounded in this vision, the law cannot protect the interests of Aboriginal peoples. In analyzing the current legal approach to the protection of Aboriginal interests, an alternative liberal argument based on group autonomy is also considered. By examining the debate between liberal …

Towards A Single Definition Of Armed Conflict In International Humanitarian Law: A Critique Of Internationalized Armed Conflict, James G. Stewart Jan 2003

Towards A Single Definition Of Armed Conflict In International Humanitarian Law: A Critique Of Internationalized Armed Conflict, James G. Stewart

All Faculty Publications

The strict division of international humanitarian law into rules applicable in international armed conflict and those relevant to armed conflicts not of an international nature is almost universally criticized. Even though attempts to abandon the distinction were made at every stage of negotiation of the Geneva Conventions and their Protocols, calls for a single body of international humanitarian law have since died out. This article revives those calls by highlighting the inadequacies of the current dichotomy’s treatment of internationalized armed conflicts, namely, armed conflicts that involve internal and international elements. It concludes that the law developed to determine this “internationalization” …

Environmental Management Systems And Public Authority In Canada: Rethinking Environmental Governance, Stepan Wood Jan 2003

Environmental Management Systems And Public Authority In Canada: Rethinking Environmental Governance, Stepan Wood

All Faculty Publications

Using the example of environmental management systems (EMS) and the ISO 14001 standard, I propose a typology of eight ways in which public authorities interact with voluntary environmental initiatives: 1. Steering (influencing the development, use or content of voluntary initiatives through official policy pronouncements, participation in standards development or creation of legal ground rules or backstops for voluntary initiatives), 2. Self-discipline (applying voluntary initiatives to government operations or agreeing to international trade rules that turn voluntary standards into constraints on regulatory authority), 3. Knowledge production (generating and disseminating ideas, information and expertise about the design, use or value of voluntary …

The Core Knowledge Sequence: An Alternative To Retention And Social Promotion, Bruce Allen Rodgers Jan 2003

The Core Knowledge Sequence: An Alternative To Retention And Social Promotion, Bruce Allen Rodgers

School of Education and Leadership Student Capstone Theses and Dissertations

Retention and social promotion have been the methods of dealing with most students in the public schools who are not making passing grades. Both of these options have been thoroughly discredited by research showing that neither option will help struggling students in the long run. In spite of this research, federal and state governments, and local school boards are proposing legislation mandating retention of students who are not performing to particular standards. Is there a more proactive approach to retention and social promotion that works?

The current research identifies several program characteristics that help students be more successful at the …

Old-Fashioned Pregnancy, Newly-Fashioned Paternity, Jeffrey A. Parness Jan 2003

Old-Fashioned Pregnancy, Newly-Fashioned Paternity, Jeffrey A. Parness

Faculty Articles, Papers, and Other Scholarship

This paper explores contemporary American laws on paternity as of the time of the live birth of a child conceived through sexual intercourse. In doing so it necessarily examines the roles of biological ties in all determinations of legal parenthood. It does not speak directly to legal paternity arising from the use of reproductive technology; to legal fatherhood arising long after birth for reasons unrelated to biology; or, to actual fatherhood, which remains unrecognized under law. It does assume that there can be no legal paternity of an unborn child, though there certainly may be prospective legal paternity that prompts …

Participation Of Unwed Biological Fathers In Newborn Adoptions: Achieving Substantive And Procedural Fairness, Jeffrey A. Parness Jan 2003

Participation Of Unwed Biological Fathers In Newborn Adoptions: Achieving Substantive And Procedural Fairness, Jeffrey A. Parness

Faculty Articles, Papers, and Other Scholarship

In newborn adoptions in the United States, the participation rights of too many unwed, fit biological fathers are unfairly considered. Some fathers have little or uncertain information about their children prior to or at birth through no fault of their own, yet are denied participation rights. Other fathers have little guidance on the steps necessary under law to prompt an opportunity to participate. Governments do little truly to inform and guide, though the parental opportunity interest involves "one of mankind's most important rights," often accorded federal constitutional protection. As a matter of public policy, American state governments should treat unwed …

Should It Take A Thief?: Rethinking The Admission Of Illegally Obtained Evidence In Civil Cases, David H. Taylor Jan 2003

Should It Take A Thief?: Rethinking The Admission Of Illegally Obtained Evidence In Civil Cases, David H. Taylor

Faculty Articles, Papers, and Other Scholarship

This article explores excluding evidence in civil cases. Part I introduces the article’s premise that civil courts should rethink the admission of illegally obtained evidence in civil cases. The article asserts that the present broad scope of civil discovery negates the need for illegally obtained evidence and society is less tolerant of the idea that illegally obtained evidence is necessary to expose a party’s wrongdoing. The article explores this premise through the lens of divorce cases. Part II examines the traditional doctrine behind admitting illegally obtained evidence and then discusses why this doctrine should be revisited. Part III provides three …

Civil Claim Settlement Talks Involving Third Parties And Insurance Company Adjusters: When Should Lawyer Conduct Standards Apply?, Jeffrey A. Parness Jan 2003

Civil Claim Settlement Talks Involving Third Parties And Insurance Company Adjusters: When Should Lawyer Conduct Standards Apply?, Jeffrey A. Parness

Faculty Articles, Papers, and Other Scholarship

Operating on behalf of insurance companies, adjusters have long facilitated settlements of civil claims. Adjusters work both before and during lawsuits to help resolve differences between the companies and company insureds, thus engaging in first-party adjusting. Adjusters also facilitate pre-lawsuit and post-lawsuit civil claim settlements between their companies and those harmed by company insureds. Such third-party adjusting and first-party adjusting are quite distinct. They raise different issues regarding the application of professional conduct or civil procedure standards governing lawyers to non-lawyer adjusters. Some important questions about applying lawyer standards to adjusters in third-party settings have been resolved, as in the …

Enforcing Settlements In Federal Civil Actions, Jeffrey A. Parness, Matthew Walker Jan 2003

Enforcing Settlements In Federal Civil Actions, Jeffrey A. Parness, Matthew Walker

Faculty Articles, Papers, and Other Scholarship

Settlements of federal civil actions may, but need not, be subject to later judicial enforcement. As recognized by the U.S. Supreme Court in Kokkonen v. Guardian Life Insurance Co., one significant limitation on enforcement proceedings is subject matter jurisdiciton because federal district courts are courts of limited jurisdiction. Under Kokkonen, enforcement jurisdiction may be independent, but usually is ancillary because state law claims typically are involved where there is no diversity of citizenship. Ancillary enforcement powers may be exercised by district courts either where claims were initially presented for adjudication and disputes arising from later settlements are factually interdependent, or …

Holding Liability Insurers Accountable For Bad Faith Litigation Tactics With The Tort Of Abuse Of Process, Francis J. Mootz Iii Jan 2003

Holding Liability Insurers Accountable For Bad Faith Litigation Tactics With The Tort Of Abuse Of Process, Francis J. Mootz Iii

Scholarly Works

Liability insurers generally do not owe any common law duties to injured third-party claimants who sue their insureds. After establishing (as a conceptual backdrop) the important and recognized public policies favoring prompt and fair payments by liability insurers to injured third-party claimants, this article analyzes whether claimants can effectively use the tort of abuse of process to hold liability insurers accountable when they engage in bad faith litigation tactics. The article identifies the problems that claimants may face in alleging abuse of process in the liability insurance setting, but also indicates that recent trends in this area of law suggest …

Of Child Welfare And Welfare Reform: The Implications For Children When Contradictory Policies Collide, Kay P. Kindred Jan 2003

Of Child Welfare And Welfare Reform: The Implications For Children When Contradictory Policies Collide, Kay P. Kindred

Scholarly Works

On August 22, 1996, President Bill Clinton signed into law the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (hereinafter, “PRWORA” or the “welfare reform law”), which replaced the Aid to Families and Dependent Children Program (“AFDC”), the nation’s primary cash-assistance program, with the Temporary Assistance to Needy Families Program (“TANF”), funded by block grants to states. PRWORA represented a dramatic change in social welfare policy in the United States. Among the many changes effected by the law in the nation’s social welfare programs were: (1) the increased authority of the states over cash-assistance programs for needy families, giving …

Ethics In Public Relations: Gauging Ethical Decision-Making Patterns Of Public Relations Practitioners, Paul Stuart Lieber Jan 2003

Ethics In Public Relations: Gauging Ethical Decision-Making Patterns Of Public Relations Practitioners, Paul Stuart Lieber

LSU Master's Theses

This study employed the Defining Issues Test (DIT) and a quantitative version of the five-factor TARES Test to gather data on the ethical decision-making patterns of public relations practitioners. The former is an instrument based on Kohlberg’s (1969) moral development theory, the latter self-enforced, ethical consideration statements derived from the research of Baker and Martinson (2001). Results show that levels of moral development in public relations differ based on job segment, and that age, education, gender and rank significantly affect levels of ethical consideration. The TARES test, it was discovered, is better suited for a three-factor configuration based on Day’s …

Experimental Predator Removal: A Response In Small Mammal Communities And Relations To Duck Nest Success, Jeremy Paul Adkins Jan 2003

Experimental Predator Removal: A Response In Small Mammal Communities And Relations To Duck Nest Success, Jeremy Paul Adkins

LSU Master's Theses

Reducing predator populations in the prairie pothole region can greatly increase nest success of both over water and upland nesting ducks. However, little is understood about impacts of predator removal on other wildlife within the same area. I conducted a field experiment to test whether small mammals, primarily mice (Peromyscus sp.) and voles (Microtus sp.), responded to seasonally reduced predator abundance. I compared small mammal abundance on 10 experimental (259 ha) sites in North Dakota during 2001 and 2002 with intensive, seasonal predator trapping with 10 control sites (259 ha) also monitored in both years. Small mammals were more abundant …

Is There Hope For Hope Vi?: Community Economic Development And Localism, Ngai Pindell Jan 2003

Is There Hope For Hope Vi?: Community Economic Development And Localism, Ngai Pindell

Scholarly Works

HOPE VI is a competitively funded, public housing redevelopment program with several competing goals. First, it seeks to revitalize deteriorated inner city communities. Second, the program attempts to transform dense, high-rise public housing that has housed the lowest income tenants into developments that are more integrated with surrounding communities in terms of architecture, economics, and aesthetics. Third, the program aspires to provide public housing residents opportunities for social and economic mobility through improvements in physical design and program offerings. The HOPE VI design encompasses demolishing existing "distressed" public housing developments, rebuilding these developments with fewer public housing units, and housing …

Media Ownership And Objectivity, Xinkun Wang Jan 2003

Media Ownership And Objectivity, Xinkun Wang

LSU Master's Theses

The purpose of this study is to examine whether the different type of ownership will affect the degree of objectivity of newspaper coverage of 2000 presidential election. It is predicted by Shoemaker’s news content theory that publicly-owned newspaper is more objective than privately-owned newspaper. The findings of this study support this theory. A content analysis of 238 news stories and eight editorials from publicly-owned the Boston Globe and privately-owned the Boston Herald showed that not only does the ownership affect the objectivity of the coverage of these two newspapers on 2000 presidential election, the endorsements also affect the degree of …

The Fate Of Nitrogen In The Marshland Upwelling System, Jeremy Fontenot Jan 2003

The Fate Of Nitrogen In The Marshland Upwelling System, Jeremy Fontenot

LSU Master's Theses

The Marshland Upwelling System (MUS) is an alternative method for coastal dwellers to treat their wastewater. Past studies have dealt with the removal of fecal pathogens from wastewater. However the objectives of this research were to: 1) evaluate the treatment capability of the MUS under high hydraulic loadings and cool temperatures with respect to CBOD5, TKN, TAN, NO2--N, NO3--N, TP, and PO4-P, and 2) determine the ideal flowrate and injection frequency to achieve satisfactory nitrogen removal without hydraulic failure. The artificial wastewater study was performed to evaluate the treatment of …

Note, A Woman’S Life, A Woman’S Health: Equalizing Medicaid Abortion Funding In Simat Corp. V. Arizona Health Care Cost Containment System, Sara Gordon

Scholarly Works

This casenote discusses the Arizona Supreme Court’s decision in Simat Corp. v. Arizona Health Care Cost Container System. In a decision deviating from those of the United States Supreme Court, the Arizona Supreme Court declared the Arizona statute and accompanying Arizona Heath Care Cost Containment System provisions unconstitutional because they did not survive strict scrutiny analysis under the Privileges and Immunities Clause of the Arizona Constitution. Where the state of Arizona has undertaken to fund abortions for indigent women whose lives are directly threatened by pregnancy, it cannot refuse to pay for abortions for similarly indigent women whose health, …

A Diffusion Of Innovations Approach To Investigate The Brand Name Change Of A Higher Education Institution, Jacqueline Eiswirth Tisdell Jan 2003

A Diffusion Of Innovations Approach To Investigate The Brand Name Change Of A Higher Education Institution, Jacqueline Eiswirth Tisdell

LSU Master's Theses

Understanding the communication concepts behind promoting a brand name is essential to the successful adoption of that innovation. This research links diffusion of innovations theory, branding, and public relations by exploring the name change of a higher education institution. Extensive work has been done in the areas of branding and diffusion of innovations theory. However, this study links the two. The adoption of the University of Louisiana at Lafayette new name by its alumni was studied by analyzing the public relations campaign post-name change and by gathering background information on previous diffusion of innovations research and the importance of brand …

Across The Borders: Immigrant Status And Identity In Law And Latcrit Theory, Ruben J. Garcia Jan 2003

Across The Borders: Immigrant Status And Identity In Law And Latcrit Theory, Ruben J. Garcia

Scholarly Works

Immigrants make up a large and increasing portion of the American community. The recent census found an unprecedented number of immigrants within the United States. Immigrants, however, have fewer legal protections than almost any other individuals within our borders. This lack of protection is especially disconcerting given that immigrants are often the most subordinated members of our communities. Particularly after the events of September 11, 2001, the rights and protections available to immigrants—whether they are documented or not—are tenuous. As LatCrit scholars have pointed out, immigration law is intensely racialized, and yet other bodies of law, such as civil rights …

Louisiana Sugar: A Geohistorical Perspective, Elizabeth Vaughan Jan 2003

Louisiana Sugar: A Geohistorical Perspective, Elizabeth Vaughan

LSU Doctoral Dissertations

The planting of sugarcane in Louisiana’s southern parishes has persisted with stunning continuity since its introduction in the late eighteenth century. This industry, however, is an economic and agricultural anomaly. It is a relic of the sixteenth-century expansion of European capitalism in which granulated sugar, then a novel product, stimulated the Atlantic slave trade and contributed to the incorporation of the sugar-producing colonies of the Americas into an emerging European-world economy. The Louisiana sugar industry was launched in 1795 with a historic granulation from a new variety of sugarcane recently introduced into the Caribbean. From this early success, the industry …
