Classes, Persons, Equal Protection, And Village Of Willowbrook V. Olech, Robert C. Farrell May 2003

Classes, Persons, Equal Protection, And Village Of Willowbrook V. Olech, Robert C. Farrell

Washington Law Review

In most contexts, the Equal Protection Clause serves as a limitation on government classifications, but it has also been used as a protector of individual rights. These competing versions of equal protection are contradictory, but courts have for the most part ignored this problem. In Village of Willowbrook v. Olech, the United States Supreme Court determined that an individual homeowner had stated a valid equal protection claim when she alleged that she alone, without regard to her membership in any class, had been treated differently from other similarly situated homeowners. The Court's decision in Olech has created a powerful …

The Tangled Web--Complexities, Fallacies And Misconceptions Regarding The Decision To Release Treated Sexual Offenders From Civil Commitment To Society, Leroy L. Kondo May 2003

The Tangled Web--Complexities, Fallacies And Misconceptions Regarding The Decision To Release Treated Sexual Offenders From Civil Commitment To Society, Leroy L. Kondo

Northern Illinois University Law Review

"When should a treated rapist, child molester or other sexual offender, convicted under a sexually violent predator statute, be released to society?" This question is fraught with multiple levels of complexity in a tangled web of misconceptions, fallacies, myths, and pitfalls reflected in the scientific and legal literature. Several excellent scientific reviews have documented tremendous progress in sexual recidivism research over the past few decades. However, decision-makers (e.g., psychiatrists, psychologists, social workers, judges, juries, district attorneys, public defenders, parole officers, and administrators of both correctional facilities and hospitals) remain confronted with a plethora of conceptual landmines and a morass of …

Get It Out Of My Backyard! Why We Need To Proactively Plan For “Sensitive” Uses, Tara A. Kelly May 2003

Get It Out Of My Backyard! Why We Need To Proactively Plan For “Sensitive” Uses, Tara A. Kelly

Master's Projects

Today’s planning literature is ripe with articles and books proclaiming the value of “Smart Growth” and to a lesser degree New Urbanism. Planning conferences*, magazines and websites repeatedly proclaim the need for planners and municipal leaders to adopt Smart Growth practices and New Urbanist design guidelines as they shape the futures of their regions.

Broadly, Smart Growth is a set of planning principles largely defined and popularized in reaction to what is seen as the failures of sprawling single-family development which has dominated post-World War II housing construction in the United States.

Smart Growth’s counterpart, New Urbanism, was developed primarily …

Public/Private Partnerships And Environmentalism, Abbe L. Hoenscheid May 2003

Public/Private Partnerships And Environmentalism, Abbe L. Hoenscheid

Master's Projects

This report explores public/private partnerships and their use in protecting critical lands. It examines the structure of such partnerships, including the benefits and downfalls, the players involved, and the strengths and weaknesses of the players.

Four case studies are examined that illustrate ways that public/private partnerships be specifically geared toward resource conservation. From the facilitation of land purchases intended to preserve sensitive environmental resources, as shown in the discussions of the Trust for Public Lands and the Ballona Wetlands Land Trust, to the protection and ongoing operation of national landmarks, as illustrated in the discussions of the Presidio Trust and …

The convenient sample consisted of ten male adolescents living in Florida.

The researcher used the Self-Evaluation Scale Form A (Cautela et al, 1983) to determine the level on each of its seven domains (body image, perception of own learning, others' perception, adaptive functioning, self-worth, self confidence, and socials skills). The results of this scale for each participant were analyzed and compared. …

Discussing The First Amendment, Christina E. Wells May 2003

Discussing The First Amendment, Christina E. Wells

Michigan Law Review

Since the First Amendment's inception, Americans have agreed that free expression is foundational to our democratic way of life. Though we agree on this much, we have rarely agreed on much else regarding the appropriate parameters of free expression. Is the First Amendment absolute or does it allow some regulation of speech? Should the First Amendment protect offensive speech, pornography, flag-burning? Why do we protect speech - to promote the search for truth, to promote self-governance, or to protect individual autonomy?2 History is rife with disagreements regarding these issues to which there are no definitive answers. Certainly, the text of …

Community Factors That Correlate With Middle-Adolescent Antisocial Behavior, Olga Kamenchuk May 2003

Community Factors That Correlate With Middle-Adolescent Antisocial Behavior, Olga Kamenchuk

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Many adolescents nowadays display antisocial behavior. A large number of theories explaining origin of antisocial behavior have been developed in the last several centuries. The current study utilizes the "ecological" theoretical framework that allows the researcher to consider multiple ecological systems in which individuals operate and to focus on the community factors influencing antisocial behavior.

The researcher used part of the Prevention Needs Assessment survey to identify which community risk and protective factors correlate with middle-adolescent antisocial behavior. Analysis included intercluster, cluster-item correlations, and partial correlations. Results indicated correlations between antisocial behavior and a number of community risk factors, and …

The Echr And States Of Emergency: Article 15 - A Domestic Power Of Derogation From Human Rights Obligations, Mohamed M. El Zeidy

San Diego International Law Journal

This study is divided into two sections. The first section is further divided into two subsections. The first subsection examines the problems in defining emergencies; in the second subsection, we will examine the preconditions required for a valid derogation. The second section determines the Strasbourg machinery for the protection of human rights. This section is also divided into four subsections. Each subsection examines separate case laws from the European Court of Human Rights. Finally, a conclusion will be deduced in the light of the former reviews.

Escaping The Asylum: When Freedom Is A Crime, Grant H. Morris May 2003

Escaping The Asylum: When Freedom Is A Crime, Grant H. Morris

San Diego Law Review

This Article discusses the constitutionality and desirability of laws that criminalize escape by civilly committed mental patients from the hospitals or other treatment facilities in which they are confined. Although escape by sentence-serving convicts is a crime in many states, regardless of whether they escape from prison or from another place of confinement or custody, escape by “regular” civilly committed mental patients is not. Nevertheless, criminalization of escape is becoming increasingly popular for “special” civilly committed patients, such as individuals who have been acquitted of crime by reason of insanity and sexually violent predators. Pivotal Supreme Court decisions involving specially …

Tendencies In The Portrayal Of The National Civilian Police Of El Salvador By The Salvadoran Press, Carlos Ponce

All-Inclusive List of Electronic Theses and Dissertations

El Salvador, located in Central America, is a country that experienced a civil war during which its government fought for the prevalence of democracy and the rebel groups for a communist regime. The armed conflict ended in 1992 with a peace treaty signed by the two sides. After the end of the civil war, El Salvador was no longer a focus of international attention. As a result of the agreements reached in 1992, national security forces were abolished and a new national law enforcement agency was created: the National Civilian Police. Since the end of the civil war, El Salvador's …
