Reform Of Juvenile Criminal Justice: A Special Focus On The Effectiveness Of Correctional Treatment In Approved Schools / Chong Phaik Kee, Phaik Kee Chong
Student Works (2000-2009)
It is now an old adage that juvenile justice reform is no sport for the short-winded. Juvenile law reform is both an incomplete achievement and an ongoing process, where the more progressive and the regressive forces of the different professionals and citizen groups skirmish between soft-line and hard-line extremes, contesting the need for further legal checks and balances. The violence of some juvenile offenders in this country is arousmg growing concern. Concerns about the welfare of the young have too often been seen as in conflict with the aims of protecting the public, punishing offences and preventing offending. This confusion …

Uma: Some Roads Not Taken, The, Joseph B. Stulberg
Journal of Dispute Resolution
I do not want to overstate my claim. There is nothing in the UMA that precludes conducting a mediated conversation in a manner consistent with what I frame below as a "robust vision" of the mediator's role. The Act, however, does not provide sustained support for it and, more seriously, appears to license the type of intervener that I believe is inconsistent with basic process goals. Hence, I am conjecturing - though I do not believe it is "idle conjecturing" - as to how parties, representative, and the mediator shall conduct their mediation conference under the vision of mediation embedded …
Internet Pharmacies And The Need For A New Federalism: Protecting Consumers While Increasing Access To Prescription Drugs, Linda C. Fentiman
Internet Pharmacies And The Need For A New Federalism: Protecting Consumers While Increasing Access To Prescription Drugs, Linda C. Fentiman
Elisabeth Haub School of Law Faculty Publications
In this article I will argue that Internet pharmacies pose a significant public health problem, as they raise the classic eternal triangle of health care issues--access, quality, and financing--in a new technological context. Part II describes the phenomena of Internet pharmacies, and Part III reviews the present regulatory scheme. Part IV explains why the current legal framework is inadequate to address the public health and safety problems posed by Internet pharmacies, focusing particularly on the jurisdictional, constitutional, and practical obstacles to effective state oversight of Internet pharmacies. Part V argues that comprehensive federal oversight of Internet prescribing and dispensing is …

Living Away From Home: The Long Term Substitute Care Of Disabled Children, Wendy Cousins, Marina Monteith, Nicola Kerr
Irish Journal of Applied Social Studies
The Centre for Child Care Research at Queen's University Belfast has been involved in a three and a half year, three part study reviewing how the services provided to meet the needs of these children and young people with disabilities have been affected by the implementation of the Children (Northern Ireland) Order 1995. This article reviews the research literature pertaining to long-term substitute care for children with disabilities in the UK and, with regard to the Children (NI) Order Legislation, will present some results from a survey about such services provided by the 11 Northern Ireland Health and Social Services …

The Recidivism Of Violent Youths In Juvenile And Adult Court: A Consideration Of Selection Bias, David Myers
The Recidivism Of Violent Youths In Juvenile And Adult Court: A Consideration Of Selection Bias, David Myers
Criminal Justice Faculty Publications
Contemporary research suggests that increased efforts to transfer juveniles to the adult criminal justice system may backfire, as waived youths generally exhibit greater recidivism as compared to similar offenders retained in juvenile court. One concern with this research is the possibility of selection bias, meaning that the findings could be explained as merely a simple consequence of the highest risk youth being transferred. This study examined this issue for 494 violent youths from Pennsylvania, of which 79 were waived to adult court and 415 were retained in juvenile court. The likelihood, seriousness, and timing of their recidivism were analyzed, with …
Visualized Narratives: Editorial Cartoonists Respond To 9/11, Janis L. Edwards
Visualized Narratives: Editorial Cartoonists Respond To 9/11, Janis L. Edwards
Iowa Journal of Communication
The violent episodes of September 11th were occasions where visual domains dominated, helping to shape the interpretation of events as an "Attack on America." An examination of the depictive rhetoric used by political cartoonists to place 9/11 in larger interpretive frame works reveals developing narratives of national unity, heroism, and patriotic sacrifice that reflect and contribute to a nationalistic ethos and a nostalgia for a mythic interpretation of terrorist acts as acts of war. The role of editorial cartoons in the construction and maintenance of social and political values is underscored.

Does The Children’S Internet Protection Act Induce Public Libraries To Violate The First Amendment?, Susanna Frederick Fischer
Does The Children’S Internet Protection Act Induce Public Libraries To Violate The First Amendment?, Susanna Frederick Fischer
Scholarly Articles
The Children's Internet Protection Act contains filtering provisions for public libraries that condition the receipt of federal assistance for Internet access and related services on libraries' operation of technological measures that block all patrons' access to obscene and pornographic materials and also block minor patrons' access to material that is "harmful to minors." Now the Supreme Court has agreed to review a trial court's decision that enjoined the government from enforcing these filtering provisions on the basis that they are facially invalid under the First Amendment.

Property Rights, Federalism, And The Public Rights-Of-Way, Frederick E. Ellrod Iii, Nicholas P. Miller
Property Rights, Federalism, And The Public Rights-Of-Way, Frederick E. Ellrod Iii, Nicholas P. Miller
Seattle University Law Review
This introductory section describes how section 253 works, and notes that the importance of local right-of-way management has increased since September 2001. Section II of the Article identifies the fundamental property rights at issue, their implications for compensation requirements, and their relationship to constitutional federalism. Section III then looks briefly at the characteristic mistake made by many analysts: construing local communities' control of their public rights-of-way as purely regulatory and ignoring the property aspect. Section IV explores in more depth the way in which section 253 fits into the structure of property rights, regulation, and federalism, by detailing the legislative …

Human Rights Approach To Intellectual Property Protection: The Genesis And Application Of Sub-Commission Resolution 2000/7, David Weissbrodt, Kell Schoff
Articles
On August 17, 2000, the United Nations Sub-Commission on the Promotion and Protection of Human Rights (the Sub- Commission) adopted Resolution 2000/7, entitled Intellectual Property Rights and Human Rights .1 This resolution signified the Sub-Commission s belief that international intellectual property regimes were not adequately accounting for human rights norms.2 Resolution 2000/7 called on U.N. Member States, intergovernmental bodies, and various U.N. entities to reaffirm their commitments toward the achievement of international human rights norms, adopt a human rights approach to the development of international intellectual property regimes, and further study the interaction between intellectual property protection and human rights.3
