Progress In Reducing Tobacco Use Across Nebraska, Jeff Willett, Ian Newman, Cheryl Wiese, Seth Emont, Tandiwe Njobe, Peter Finn

Department of Educational Psychology: Faculty Publications

Tobacco use is the leading cause of preventable death in the United States, causing over 400,000 deaths annually. In Nebraska each year, 2,400 adults die prematurely because of cigarette smoking. It is estimated that 45,000 Nebraskans now under the age of 18 will eventually die prematurely from cigarette smoking. Cigarette smoking is responsible for $419 million of Nebraska's annual health care costs (representing approximately 7 percent of the state's annual health care costs, including 12 percent of Nebraska's annual Medicaid expenditures), and smoking-related mortality results in over $400 million in forgone future earnings in the state per year.

Sector Differences In Student Learning: Differences In Achievement Gains Across School Years And During The Summer, William Carbonaro Dec 2003

Sector Differences In Student Learning: Differences In Achievement Gains Across School Years And During The Summer, William Carbonaro

Journal of Catholic Education

Public and private schools have been the focus of considerable research, comparing student achievement, attendance, dropout rates, graduation rates, disciplinary incidents, and a variety of educational and prosocial outcomes across sectors. Comparative studies of student achievement have tended to concentrate on the high school years and without any effort to measure gains or losses during specific years. This study concludes that sector differences in learning vary across grade levels and that summer learning rates vary by school sector. More study of sector differences in learning is recommended, especially longitudinal studies that examine seasonal gains across school sector over the entire …

Ethical Issues In Defending A Terrorism Case: Stuck In The Middle, Joshua L. Dratel Dec 2003

Ethical Issues In Defending A Terrorism Case: Stuck In The Middle, Joshua L. Dratel

Cardozo Public Law, Policy & Ethics Journal

The article discusses the ethical and legal challenges faced by criminal defense attorneys in terrorism cases, particularly focusing on the impact of Special Administrative Measures (SAMs), the Foreign Intelligence Surveillance Act (FISA), and the Classified Information Procedures Act (CIPA). These measures create significant barriers to effective legal representation, undermining the constitutional rights of defendants and the attorney-client relationship. The author argues that these practices not only impair the defense in terrorism cases but also risk encroaching on civil liberties in ordinary criminal cases.

The Constitution In Crisis Times, Jack N. Rakove

Cardozo Public Law, Policy & Ethics Journal

The article examines the challenges the U.S. Constitution faces during crises, particularly in the context of the post-9/11 "War on Terror." It argues that terrorism represents a persistent condition rather than a traditional war, requiring a balanced approach to security and civil liberties. The author emphasizes the importance of constitutional checks on executive power and the role of Congress in ensuring civil liberties are protected during crises.

Sector Differences In Opportunities For Parental Involvement In The School Context, Gail M. Mulligan Dec 2003

Sector Differences In Opportunities For Parental Involvement In The School Context, Gail M. Mulligan

Journal of Catholic Education

Research has consistently related school effectiveness to parental involvement. Catholic schools in particular have tended to have high levels of parental involvement, more so than public schools. This study measured the opportunities for parental involvement present in private and public schools. While Catholic school parents tend to demonstrate higher levels of parental involvement than public school parents, public schools offer significantly more opportunities for parental involvement than Catholic schools.

The Importance Customers Place On Specific Service Elements Of Bus Rapid Transit, Michael R. Baltes Dec 2003

The Importance Customers Place On Specific Service Elements Of Bus Rapid Transit, Michael R. Baltes

Journal of Public Transportation

Bus Rapid Transit (BRT) is a rapidly growing national trend in the provision of public transportation. At present, with more than 150 New Start Rail Projects currently in the FTA pipeline, a wide range of alternatives is necessary to fulfill the demand for cost-effective rapid public transportation. As a lower cost, high-capacity mode of public transportation, BRT can serve as an option to help address the growing traffic congestion and mobility problems in both urban and nonurban areas. Careful documentation and analyses of BRT systems and the unique features of these projects will help determine the most effective features offered …

Evaluating The Urban Commute Experience: A Time Perception Approach, Yuen-Wah Li Dec 2003

Evaluating The Urban Commute Experience: A Time Perception Approach, Yuen-Wah Li

Journal of Public Transportation

This article examines the perception of travel time and evaluation of the urban commute experience. It reviews the literature on time perception in psychology, positing perceived travel time as a function of commute characteristics, journey episodes, travel environments, and expectancy. Insights from emerging behavioral economics are drawn to illuminate evaluation of the urban commute experience. The perception–evaluation correspondence presents the potential of a new research approach to travel behavior. A time perception model for evaluating urban commute experience is formulated to accommodate all the posited relationships, with possible moderations by goal attainment, economic values associated, and time urgency. Practical significance …

Gender Differences In Accurate Route Recall In Novice Drivers Using Landmarks In Electronic Maps, Kimberly K. Brantley Dec 2003

Gender Differences In Accurate Route Recall In Novice Drivers Using Landmarks In Electronic Maps, Kimberly K. Brantley

Master's Theses - Daytona Beach

Past literature has found a link between gender and accuracy of route recall in traditional paper maps using landmarks. Research also suggests that what is already known about wayfinding behavior in the physical world can be applied to computer-generated environments. The goal of this study is to merge these two conclusions to determine if gender and route recall differences remain constant for global, electronic maps. Analysis of gender by accuracy as measured by number of trials showed that males required fewer trials (M = 3.63) than females (M = 4.09), F (1,99) = 7.29, p < .05 and accuracy as measured by number of errors in trial 1 also showed that males had fewer errors (M = 3.33) than females (M = 4.09), F (1,99) = 5.79, p < .05. Analysis of landmarks by accuracy as measured by number of trials showed participants viewing Landmark High Maps required fewer trials (M = 3.64) than those viewing Landmark Low Maps (M = 4.12), F (1,99) = 7.68, p < .05. Accuracy as measured by number of errors in trial 1 showed participants viewing Landmark High Maps had fewer errors in trial 1 (M = 3.16) than those viewing Landmark Low Maps (M = 4.33), F (1,99) = 11.87.

Enabling Work For People With Disabilities: A Post-Integrationist Revision Of Underutilized Tax Incentives, Francine J. Lipman Dec 2003

Enabling Work For People With Disabilities: A Post-Integrationist Revision Of Underutilized Tax Incentives, Francine J. Lipman

American University Law Review

Federal employment strategies for people with disabilities do not seem to be working. Scholars argue that the Americans with Disabilities Act and similar legislation that exemplify the disability theory of integrationism with the goal of integrating people with disabilities into mainstream employment cannot succeed. Society cannot eradicate barriers to employment for people with disabilities simply by the integrationist modest approach of reasonable accommodation. A post-integrationist approach may be required to provide legitimate equal employment opportunities for people with disabilities.

In December 2002, the General Accounting Office released its report on its study of three federal business tax incentives to encourage …

Hardiness As A Career Transition Resource, Katherine Lee Rathburn Dec 2003

Hardiness As A Career Transition Resource, Katherine Lee Rathburn

Theses and Dissertations

The relationship of hardiness to career transition resources was examined. Hardiness scores were obtained through the use of the Cognitive Hardiness Scale (CHS)(Nowack, 1996) and transition resources were measured by the Career Transitions Inventory (CTI) (Heppner, Multon, & Johnston, 1994). The study included 120 male and female adult participants from multiple settings (primarily from a local university, technical college, and job agency) who had a career transition in the last 15 months. Most participants had experienced multiple career-related changes. The general hypothesis for this study was that certain constructs measured by the CTI correlate with hardiness (the Personal Control factor …

Coping With Stressful Situations: The Use Of Humor As A Preventative Coping Mechanism For Preceived Stress In Public Speaking, Randall J. Smies Dec 2003

Coping With Stressful Situations: The Use Of Humor As A Preventative Coping Mechanism For Preceived Stress In Public Speaking, Randall J. Smies

Theses and Dissertations

This study attempted to determine the effects of using a humorous intervention as a preventative coping mechanism to lower the perceived stress that can be associated with public speaking. Further, it examined the effects that the humorous intervention would have on both the perceived self-efficacy for the current public speaking and for future public speaking situations. It was hypothesized that a humorous intervention administered before an actual stressful situation in an individual's life would lower stress and also increase their perceived self-efficacy regarding the stressor in the present and in the future.

Participants included 64 college students recruited from an …

The Relationship Between Personality And The Experience Of Solution-Focused Therapy And Cognitive Therapy, Shannon T. Woulfe Dec 2003

The Relationship Between Personality And The Experience Of Solution-Focused Therapy And Cognitive Therapy, Shannon T. Woulfe

Theses and Dissertations

Throughout the past 20 years, a growing emphasis on client competence building within the psychotherapy literature has led to the creation of specific therapeutic interventions, such as narrative therapy and solution-focused therapy. These interventions offer a distinct alternative to traditional deficit-based interventions, where clients are viewed as having a dysfunction that is causing specific symptoms. This study indirectly compared the experiences of a client undergoing a competence model of helping, solution-focused therapy, with the experiences of the same client undergoing a deficit model of helping, cognitive therapy. Information about how personality dimensions are related to the experience of both solution-focused …

Ethical Issues In Defending A Terrorism Case: How Secrecy And Security Impair The Defense Of A Terrorism Case, Joshua L. Dratel Dec 2003

Ethical Issues In Defending A Terrorism Case: How Secrecy And Security Impair The Defense Of A Terrorism Case, Joshua L. Dratel

Cardozo Public Law, Policy & Ethics Journal

The article discusses the unique ethical and legal challenges faced by criminal defense attorneys in terrorism cases, particularly highlighting the impact of Special Administrative Measures (SAMs), the Foreign Intelligence Surveillance Act (FISA), and the Classified Information Procedures Act (CIPA). These laws and regulations, expanded post-September 11, 2001, create significant barriers to effective representation, undermining the attorney-client relationship and constitutional protections. The article emphasizes how these measures not only complicate terrorism cases but also risk bleeding into other areas of criminal law, eroding civil liberties more broadly.

A Round "Peg" For A Round Hole: Advocating For The Town Of Oyster Bay's Public Access Channel Restrictions, Thomas Werner Dec 2003

A Round "Peg" For A Round Hole: Advocating For The Town Of Oyster Bay's Public Access Channel Restrictions, Thomas Werner

Federal Communications Law Journal

New technological devices which allow consumers to skip commercials are driving corporations to engage in alternative advertising. The development of more “organic” methods of integrating products into the content of television programs makes those advertisements much more difficult to detect. As it becomes more difficult to divorce the product being sold from the content of the program, it also becomes more difficult to determine whether or not an advertisement actually exists. Without such blatant references, these programs would be likely candidates to appear on public access channels. This poses a severe threat to the service that those channels were intended …

Retaining Judicial Authority: A Preliminary Inquiry On The Dominion Of Judges, Larry Catá Backer Dec 2003

Retaining Judicial Authority: A Preliminary Inquiry On The Dominion Of Judges, Larry Catá Backer

William & Mary Bill of Rights Journal

Why do the people and institutions of democratic states, and in particular those of the United States, obey judges ? This article examines the foundations of judicial authority in the United States. This authority is grounded on principles of dominance derived from the organization of institutional religion. The judge in Western states asserts authority on the same basis as the priest - but not the priest as conventionally understood. Rather, the authority of the judge in modern Western democratic states is better understood when viewed through the analytical lens of priestly function developed in the philosophy of Friedrich Nietzsche. Focusing …

Beauty As Currency, Joseph Abide Dec 2003

Beauty As Currency, Joseph Abide

Electronic Theses and Dissertations

This body of work addresses the concept of physical beauty and the attendant value that we as a society place upon it. Beauty shares characteristics with other prized possessions in life. It may be traded for monetary gain, as is the case with professional models. The exchange is not always so obvious. What constitutes beauty is open to many interpretations as to why it is deemed desirable. I have observed physical characteristics which are valued as attractive, change, from one social group to another and within that same society evolve with the passage of time.

Physical beauty differs from other …
