Barriers To Physicians’ Decisions To Discuss Hospice: Insights Gained From The United States Hospice Model, E. Kiernan Mcgorty, Brian H. Bornstein Aug 2003

Barriers To Physicians’ Decisions To Discuss Hospice: Insights Gained From The United States Hospice Model, E. Kiernan Mcgorty, Brian H. Bornstein

Department of Psychology: Faculty Publications

Due to its comprehensive and cost-saving design, hospice has become a critical component of health care. Physicians have become the primary gatekeepers to information on hospice and sources of referral to hospice. However, many physicians do not discuss hospice options until late in the disease course, when patients and their families are no longer able to benefit from hospice services. Although physicians, as well as patients and hospice personnel, cite patient and hospice structure factors as barriers, the present article will focus on barriers physicians have more control over, such as their discomfort discussing terminality and fear of losing contact …

Takings Formalism And Regulatory Formulas: Exactions And The Consequences Of Clarity, Mark Fenster Aug 2003

Takings Formalism And Regulatory Formulas: Exactions And The Consequences Of Clarity, Mark Fenster

ExpressO

A vocal minority of the U.S. Supreme Court recently announced its suspicion that lower courts and state and local administrative agencies are systematically ignoring constitutional rules intended to limit, through heightened judicial review, exactions as a land use regulatory tool. Exactions are the concessions local governments require of property owners as conditions for the issuance of the entitlements that enable the intensified use of real property. In two cases decided over the past two decades, Nollan v. California Coastal Commission (1987) and Dolan v. City of Tigard (1994), the Court has established under the Takings Clause a logic and metrics …

Hatch–Waxman Reform And Accelerated Market Entry Of Generic Drugs: Is Faster Necessarily Better?, Sarah E. Eurek Aug 2003

Hatch–Waxman Reform And Accelerated Market Entry Of Generic Drugs: Is Faster Necessarily Better?, Sarah E. Eurek

Duke Law & Technology Review

Recently there has been a considerable amount of pressure to accelerate consumer access to generic drugs, which are significantly less expensive than their brand-name counterparts. One way to bring generic drugs on to the market sooner is through revision of the existing law relating to pharmaceutical patents. This iBrief describes recent regulatory changes to the Drug Price Competition and Patent Term Restoration Act (the Hatch-Waxman Act), which governs the patenting process for new drug products, as well as current legislative efforts to speed generic access through Hatch-Waxman reform. This iBrief also assesses whether these changes will be beneficial to consumers …

Testing The Focal Point Theory Of Legal Compliance: Expressive Influence In An Experimental Hawk/Dove Game, Richard H. Mcadams, Janice Nadler Aug 2003

Testing The Focal Point Theory Of Legal Compliance: Expressive Influence In An Experimental Hawk/Dove Game, Richard H. Mcadams, Janice Nadler

Law and Economics Papers

Economic theories of legal compliance emphasize legal sanctions, while psychological and sociological theories stress the perceived legitimacy of law. Without disputing the importance of either mechanism, we test a third way that law affects behavior, an expressive theory that claims law influences behavior by creating a focal point around which individuals coordinate. The focal point theory makes three claims: (1) that the need for coordination is pervasive because "mixed motive" games involving coordination model common disputes; (2) that, in such games, any third-party cheap talk that calls the players' attention to a particular equilibrium tends to produce that equilibrium; and …

The independent variables were gender and levels of substance use. The dependent variables were reasons for living scores and emotional empathy scores.

A 2 (gender) X 3 (level of substance use) Analysis of Variance was used. For empathy, a main effect was found for …

The Combined Effects Of Criminal Justice Intervention On Domestic Violence: A Re-Analysis Of The Minneapolis Intervention Project., Nadia A. Bebawy Aug 2003

The Combined Effects Of Criminal Justice Intervention On Domestic Violence: A Re-Analysis Of The Minneapolis Intervention Project., Nadia A. Bebawy

Electronic Theses and Dissertations

Over the past 20 years, a plethora of research has been conducted on the effects of arrest in reducing recidivism of domestic violence offenders. The findings of such research have been varied. This study uses data from the Minneapolis Intervention Project to test the effectiveness criminal justice sanctions (i.e., arrest, jail, counseling, and the combination) on reducing recidivism of male domestic violence offenders. Results from bivariate analysis found that the criminal justice sanction of arrest and jail was related to recidivism. However, criminal justice sanctions could not predict recidivism.
