From Genes, Marriage And Money To Nurture: Redefining Fatherhood, Nancy E. Dowd Oct 2003

From Genes, Marriage And Money To Nurture: Redefining Fatherhood, Nancy E. Dowd

UF Law Faculty Publications

Genes should not define fatherhood. This is wrong for men, and wrong for children. Genes define identity, but that link should be separated from the obligations and rights of parenthood. Specifically, I argue that fatherhood should be defined by doing (action) instead of being (status), with the critical component being acts of nurturing. In this essay I define in more detail this concept of fatherhood and its characteristics; discuss the consequences related to genetic ties; and consider the policy implications of defining fatherhood around nurture when genetic ties can be established for all children. It is critical throughout to remain …

The Symbols Of Governance: Thurman Arnold And Post-Realist Legal Theory, Mark Fenster Oct 2003

The Symbols Of Governance: Thurman Arnold And Post-Realist Legal Theory, Mark Fenster

UF Law Faculty Publications

This article is an effort to provide both the intellectual context of Thurman Arnold's work and, through his work, a better sense of where and how the study of law turned after realism. The article is in five parts. Part I describes Arnold's relationship with legal realism, looking at the earliest part of his academic career when, as a mainstream realist, he performed empirical studies of local and state court systems. Part II is Arnold's proposed field of "Political Dynamics," an interdisciplinary approach to the symbols of law, politics, and economics. Part III considers Arnold's authorial voice in Symbols and …

The Lawyering Process: An Example Of Metacognition At Its Best, John M.A. Dipippa, Martha M. Peters

Law Faculty Scholarship

This article celebrates the 25th anniversary of the publication of Gary Bellow and Bea Moulton's The Lawyering Process by looking at the work from personal and theoretical perspectives. From the personal perspective, the authors discuss how The Lawyering Process influenced them as teachers and scholars. From the theoretical perspective, the authors show how the book modeled various metacognitive processes. Combining the personal with the theoretical, the article shows how The Lawyering Process challenged lawyers to be-come aware of their own thinking by demonstrating how it challenged the authors to do so.

Taking The Lawyer's Craft Into Virtual Space: Computer-Mediated Interviewing, Counseling, And Negotiating, Robert M. Bastress, Joseph D. Harbaugh

Law Faculty Scholarship

Bellow's and Moulton's The Lawyering Process emphasized the need for law students and lawyers to draw on other disciplines for effective skills development, to make self-analysis of their professional skills and principles a career-long practice, and to remain ever vigilant of emerging ethical issues. This article attempts to honor those lessons by applying them to lawyers' use of computer mediated communication (CMC) in interacting with clients and in negotiating for clients. The article examines the social science research on CMC, applies that research to the lawyer's context, and makes some tentative assessments about the skills involved in lawyers' use of …

Fetal Surgery And Wrongful Death Actions On Behalf Of The Unborn: An Argument For A Social Standard, Jonathan D. Stanley Oct 2003

Fetal Surgery And Wrongful Death Actions On Behalf Of The Unborn: An Argument For A Social Standard, Jonathan D. Stanley

Vanderbilt Law Review

Imagine a young couple in the not-too-distant-future who are eagerly awaiting the birth of their first child. During the eighteenth week of the pregnancy, the mother has an ultrasound performed to detect possible developmental problems with the child. To their dismay, the ultrasound reveals a malformation in the fetus. The defect will not be fatal, but if left untreated will cause the child severe breathing problems once born. The problem can be fixed with surgery after birth, but such a procedure will result in disfiguring facial scars. After thoroughly considering their options, which range from an abortion to carrying the …

Robot Heavens And Robot Dreams: Ultimate Reality In A.I. And Other Recent Films, Frances Flannery-Dailey Oct 2003

Robot Heavens And Robot Dreams: Ultimate Reality In A.I. And Other Recent Films, Frances Flannery-Dailey

Journal of Religion & Film

Numerous recent films understand ultimate reality to be multi-layered. This article examines the various formulas films use to express this idea, such as heaven, dreams, technology, temporal loops and altered mental states, while also exploring the various religious and philosophical traditions on which these "ultimate reality films" draw. Next, I suggest a postmodern framework as a way of accounting for the ubiquity of the reality theme across filmic genres and I argue that film is a unique medium for expressing this epistemology. Finally, I turn to an extensive analysis of A.I. as a case study of a postmodern, multivalent "ultimate …

Business Faculty Opinions Of Teaching Methods And Resources, Gundars Kaupins, Malcolm Coco Oct 2003

Business Faculty Opinions Of Teaching Methods And Resources, Gundars Kaupins, Malcolm Coco

Mountain Plains Journal of Business and Technology

About two hundred and eighty business professors compared seventeen teaching methods and resources based on four objectives. Interactive, hands-on teaching methods such as internships were rated first and less interactive teaching resources such as radio were rated last. Web courses that included more interaction such as chats were rated higher than Web courses with audio, typed lectures, and videos. However, all four types of Web courses investigated were rated in the bottom half of the teaching methods and resources. Results correspond to major principles of andragogy theory.

Navigating The Statute Of Limitations Maze In The Federal Income Tax Arena, Joseph S. Merrill, Katherine D. Black Oct 2003

Navigating The Statute Of Limitations Maze In The Federal Income Tax Arena, Joseph S. Merrill, Katherine D. Black

Mountain Plains Journal of Business and Technology

Individual taxpayers frequently realize that a tax return filed with the IRS needs to be changed for various reasons that may include: previously estimated amounts may later be discovered to have been in error, prior ignorance may have been rectified, or new interpretations of law may have been rendered by the courts or the IRS. The need to adjust a previously filed return may be discovered in the year of filing, or several years later.

State and federal laws generally create statutes of limitation that let the parties to litigation know when the deadlines for bringing the suit expire. Sometimes …

This is the curriculum for a program known as "REAL MEN," an acronym for "Returning Educated African American and Latino Men to Enriched Neighborhoods." A collaborative effort, the REAL MEN program was a public health intervention based at Rikers Island and at a community-based organization, Friends of Island Academy, for young men, ages 15-19, who were leaving jail and returning to their home communities. The curriculum for this program was designed to reduce drug use, HIV risk, and rearrest by helping participants examine alternative paths to manhood and consider racial/ethnic pride as a source of strength.

The Counselor As Expert Witness: Changes In The Michigan Hearsay Rule, John J. Pietrofesa, Cathy J. Pietrofesa, John David Pietrofesa

Michigan Journal of Counseling: Research, Theory and Practice

This article discusses the expanding role of the professional counselor as expert witness. The preferred role of the expert witness is one in which the expert informatively presents the facts and does not act as an advocate trying to influence a legal decision. The expert witness in Michigan now has to consider changes in the Michigan Rules of Evidence which disallows any hearsay evidence the counselor may have acquired during counseling. Additionally, supporting documentation for opinions may not simply be cited, but must be placed into evidence. This article concludes with suggestions for counselors in preparing for the role as …

Children, Sports, And Family Dynamics: Are We Having Fun Yet?, Patrick J. Morrissette, Roberta Graham

Michigan Journal of Counseling: Research, Theory and Practice

The involvement of children in sports is rarely an individual endeavor and can positively and /or negatively affect the entire family system to varying degrees. However, little has been written about how children’s participation in sports impact family dynamics. In working toward filling this void, this paper elaborates on several themes that can emerge when children participate in school or community sports. The themes that will be discussed in this paper include: parent/coach/child triangulation, parent coach-parent conflict, performing a dual role, the family all-star, time, financial commitment, and differing parental perspectives. Based on informal observations and discussions with children, parents, …
