Screening Versus Plea Bargaining: Exactly What Are We Trading Off?, Gerard E. Lynch Jan 2003

Screening Versus Plea Bargaining: Exactly What Are We Trading Off?, Gerard E. Lynch

Faculty Scholarship

I was delighted to be invited to comment on Ronald Wright and Marc Miller's important and instructive article, The Screening/Bargaining Tradeoff. Those familiar with the authors' work, including their original and fascinating criminal procedure casebook, will be unsurprised by many of the article's virtues, including a focus on empirical examination of real-world practice and (perhaps a special case of that more general virtue) attention to practices at the state and local level, where most criminal law enforcement actually occurs. Wright and Miller develop some interesting insights into the potential for changes in plea bargaining practices that have frequently been …

Local Institutions, Foreign Investment And Alternative Strategies Of Development: Some Views From Practice, Tamara Lothian, Katharina Pistor Jan 2003

Local Institutions, Foreign Investment And Alternative Strategies Of Development: Some Views From Practice, Tamara Lothian, Katharina Pistor

Faculty Scholarship

This Essay summarizes the major insights gained from a panel discussion with legal practitioners about the relevance of local institutions to foreign direct investors. The Essay offers a critique of policy conclusions drawn from empirical studies that suggest a positive correlation between legal institutions and foreign investment flows. It points out that the data used in these studies are far too general to allow policy conclusions and that neither the data nor the policy conclusions are sufficiently attuned to the challenges or opportunities that foreign direct investment projects face on the ground. According to the results of the panel discussion, …

Sequencing, Acoustic Separation, And 3-D Negotiation Of Complex Barriers: Charlene Barshefsky And Ip Rights In China, Rebecca Green, James K. Sebenius

Faculty Publications

Taking the perspective of the lead U.S. negotiator, Charlene Barshefsky, this article details and analyzes the negotiations that took place in the mid-1990s between the United States and the People's Republic of China over intellectual property rights (IPR). Employing a "negotiation analytic" methodology, Charlene Barshefsky's actions are interpreted to suggest a number of promising approaches to managing the daunting complexities of trade and other negotiations: recognizing the multiparty aspects of apparently bilateral dealings and capturing them in a "deal diagram;" carefully assessing "barriers" to agreement; sequencing to build a winning coalition and overcome potentially blocking ones; "acoustic separation" of issueframes; …

Comparisons Of Local Infiltration-Excess, Overland Flow And Associated Erosion Behaviour With River Behaviour At The Catchment Scale Jan 2003

Comparisons Of Local Infiltration-Excess, Overland Flow And Associated Erosion Behaviour With River Behaviour At The Catchment Scale

Journal of Spatial Hydrology

Modeling overland flow and erosional behaviour is a very important scientific task today to prevent environmental impacts from human activities as well as physical disasters such as floods and desertification. In the particular project the impacts from selective logging that occurred in Malaysia has been attempted to identify and quantify by comparing hydrological parameters both in local and catchment scale. Measurements of rainfall, overland flow and suspended sediment flux have been recorded for a year with a resolution of five minutes. A Databased Mechanistic (DBM) modeling approach has been applied to the data to facilitate physical interpretation of the results, …

Isovolumetric Regulation In Mammal Cells: Role Of Taurine, B. Ordaz, R. Franco, National University Of Mexico Tuz Jan 2003

Isovolumetric Regulation In Mammal Cells: Role Of Taurine, B. Ordaz, R. Franco, National University Of Mexico Tuz

School of Veterinary and Biomedical Sciences: Faculty Publications

The ability to regulate cell volume is an ancient conserved trait present in essentially all species through evolution. The maintenance of a constant cell volume is a homeostatic imperative in animal cells. Changes in cell water content affecting the concentration of intracellular messenger molecules impair the complex signaling network, crucial for cell functioning and intercellular communication. Although the renal homeostatic mechanisms exert a precise control of extracellular fluid osmolarity, this is challenged in a variety of pathological situations. The intracellular volume constancy is continuously compromised by the generation of local and transient osmotic microgradients, associated with nutrients uptake, secretion, cytoskeleton …

Radio Regulation Revisited: Coase, The Fcc, And The Public Interest, David A. Moss, Michael R. Fein Ph.D. Jan 2003

Radio Regulation Revisited: Coase, The Fcc, And The Public Interest, David A. Moss, Michael R. Fein Ph.D.

Humanities Department Faculty Publications & Research

It is now more than forty years since Ronald Coase’s seminal article on the Federal Communications Commission first appeared in the pages of the Journal of Law and Economics.1 The article remains important for a number of reasons, not least of which is that it offered his first articulation of the Coase Theorem.2 Of even greater importance for our purposes, the article literally redefined the terms of debate over American broadcast regulation, in both historical and contemporary treatments of the subject. Focusing particularly on the development of radio regulation, Coase rejected the prevailing notion that the establishment of the Federal …

Monograph Series

It is significant that the African American Professors Program (AAPP) at the University of South Carolina is producing the third edition of its annual monograph series at this time-the fifth anniversary of AAPP. The program graciously accepts the challenge of putting into place a requirement for the scholars to produce quality research papers worthy of publication. This provides widespread visibility for them and enhances their curriculum vitae concurrently.

Scholars who have contributed manuscripts for this monograph are to be commended for adding this additional responsibility to their academic workload. Writing across disciplines adds to the intellectual diversity of these papers. …

Transformation Of Bangkok In The Press During The Reign Of Rama V (1868-1910), Pirasri Povatong Jan 2003

Transformation Of Bangkok In The Press During The Reign Of Rama V (1868-1910), Pirasri Povatong

Manusya, Journal of Humanities

This essay describes the emerging public discourse on Bangkok's urban and architectural transformations in print media from the reign of Rama V. It discusses and compares different representations and visions of the civilizing city that were architectured by three groups of publishing elites: the royal elite, the commoner intellectuals, and the Westerners. In April 1869, the Siam Repository had printed an editorial article titled "Bangkok, Siam. As It Is." The Repository's editor was an American missionary, Samuel J. Smith, and the first half of the article was a typical description of the capital city of this "heathen country." The flat …

The Perfect Perspective: A Mathematical Analysis Of Perspective Using Tools Available To Middle School Students, W. Griffin Jan 2003

The Perfect Perspective: A Mathematical Analysis Of Perspective Using Tools Available To Middle School Students, W. Griffin

Journal of Mathematics and Science: Collaborative Explorations

This paper examines the basic properties of perspective drawings, the history of perspective drawings, and the basic mathematics of perspective. Using a side view and a top view of a three-dimensional projection, similar triangles can be used to find distances from the axes and vanishing point in a projection. By breaking the three-dimensional projection into two, two-dimensional planes, one can recreate projections based on actual figures, or create placements of figures in real space based on a projection. Using this method, one 'can change a projection based on the changing position of the vanishing point. This simple approach to perspective …

Making Waves: Circumventing Domestic Law On The High Seas, Shannon Renton Wolf Jan 2003

Making Waves: Circumventing Domestic Law On The High Seas, Shannon Renton Wolf

UC Law SF Journal on Gender and Justice

As abortion is illegal in Ireland, many Irish women who seek to exercise reproductive rights cross the Irish Sea to have abortions in England. However, given the cost of such travel, some Irish women do not have access to abortion. A Dutch organization, Women on Waves, recently attempted to sail a Dutch-registered ship to countries where abortion is either illegal or difficult to obtain. To circumvent domestic law, the abortions would be performed in international waters. While the effort was unsuccessful, the attempt raises a host of issues involving international law, state sovereignty, the law of the sea, and human …
