Director's Duties In A Post-Enron World: Why Language Matters, Margaret M. Blair Jan 2003

Director's Duties In A Post-Enron World: Why Language Matters, Margaret M. Blair

Vanderbilt Law School Faculty Publications

This essay observes that, in the face of corporate scandals of the last few years, a number of prominent advocates for shareholder primacy have retreated to the position that directors and officers should attempt to maximize long run share value performance, rather than short term value. But the mantra of share value maximization has no distinctive meaning and policy implications if it is not interpreted to mean maximization of short term value. This is because the actions required to maximize share value in the long run are indistinguishable in practice from actions taken in pursuit of other more broadly-stated goals …

Integrity And Reflection, Suzanna Sherry Jan 2003

Integrity And Reflection, Suzanna Sherry

Vanderbilt Law School Faculty Publications

Professor Waldron and Professor Michelman have presented us with two interesting, but very different, views on what procedural components might contribute to the integrity of lawmaking. I will focus on a different aspect of legislative integrity: legislation reflection. "Reflection" has two meanings, and in this context they are direct opposites. A legislature can be reflective as a mirror is reflective: It can be a reflection of its constituents and therefore a relatively direct agent of popular sovereignty. But reflective can also mean thoughtful and deliberative; a legislature that is reflective in this sense "reflects" or deliberates to reach its own …

Saru, A Sara Homolog, Is Repressed By Sart And Regulates Virulence Genes In Staphylococcus Aureus, Adhar C. Manna, Ambrose L. Cheung

Dartmouth Scholarship

In searching the Staphylococcus aureus genome, we previously identified sarT, a homolog of sarA, which encodes a repressor for alpha-hemolysin synthesis. Adjacent but transcribed divergently to sarT is sarU, which encodes a 247-residue polypeptide, almost twice the length of SarA. Sequence alignment disclosed that SarU, like SarS, which is another SarA homolog, could be envisioned as a molecule with two halves, with each half being homologous to SarA. SarU, as a member of the SarA family proteins, disclosed conservation of basic residues within the helix-turn-helix motif and within the beta hairpin loop, two putative DNA binding domains within this protein …

A Comparison Of The Quality Of The School Experience For Current High School Students And For Teachers When They Were High School Students, James R. Willison, Sr. Jan 2003

A Comparison Of The Quality Of The School Experience For Current High School Students And For Teachers When They Were High School Students, James R. Willison, Sr.

Theses and Dissertations

This study is designed to compare the quality of school experiences for teachers when they were students with that of current high school students. Teachers and students from one urban, one suburban, and one rural high school in Central Arkansas completed the Concord High School Student Survey (CHSSS), an instrument designed to measure the quality of the school experience. Mean scores on the CHSSS for teachers and students were compared using a two-sample t-test. The data conclude that there is a statistically significant difference between perceived quality of school experiences for current students and the perceived quality of school experiences …

Testing The Relationship Between Student's Perceptions, Achievement, And Learning Style Characteristics In Campus Based Lecture Classes, Campus Based Lecture Classes With Computer Enhanced Components, And Classes Offered On-Line, Blake Embrey Robertson

Theses and Dissertations

Educational professionals have always been attracted by the potential of what is going to happen in the future. From film in the 1920s, to television in the 1950s, to computers in the 1980s, and now informational technology in the 1990s, there have always been great expectations that new technology would soon enhance learning and instruction. This study investigated the relationship between student perceptions, academic achievement, and learning style characteristics across three instructional delivery formats: campus-based lecture classes, campus-based lecture classes with computer-enhanced components, and classes offered fully online. As users of the electronic classroom, faculty must properly and professionally integrate …

Every Day Is Halloween: A Goth Primer For Law Enforcement, Gordon A. Crews

Criminal Justice Faculty Publications

The following article is based upon field research conducted by Dr. Gordon A. Crews dealing with juveniles and young adults involved in the “Goth” lifestyle across the United States. This research is part of his ongoing efforts over the last decade to examine the impacts of alternative lifestyles, beliefs, and practices upon juvenile delinquency and violence. Most of the information in this article has been derived from face-to-face interviews with individuals aged 13 to 39 years of age proclaiming to be Goth, Vampires, Satanists, Pagans, Wiccans, New Agers, Druids, and a myriad of other occult-based identities.

Mappfinder: Using Gene Ontology And Genmapp To Create A Global Gene-Expression Profile From Microarray Data, Scott W. Doniger, Nathan Salomonis, Kam D. Dahlquist, Karen Vranizan, Steven C. Lawlor, Bruce R. Conklin

Biology Faculty Works

MAPPFinder is a tool that creates a global gene-expression profile across all areas of biology by integrating the annotations of the Gene Ontology (GO) Project with the free software package GenMAPP (http://www.GenMAPP.org). The results are displayed in a searchable browser, allowing the user to rapidly identify GO terms with over-represented numbers of geneexpression changes. Clicking on GO terms generates GenMAPP graphical files where gene relationships can be explored, annotated, and files can be freely exchanged.

Volcanic ash clouds can be fed by an upward-directed eruption column (Plinian column) or by elutriation from extensive pyroclastic-flows (coignimbrite cloud). For large-scale eruptions, there is considerable uncertainty about which mechanism is dominant. Here we analyze in a novel way a comprehensive grainsize database for pyroclastic deposits. We demonstrate that the Mount Pinatubo climactic eruption deposits were substantially derived from coignimbrite clouds, and not only by a Plinian cloud as generally thought. Coignimbrite ash-fall deposits are much richer in breathable <10 m ash (5–25 wt%) than pure Plinian ash at most distances from the source volcano. We also show that coignimbrite ash clouds, as at Pinatubo, are expected to be more water rich than Plinian clouds, leading to removal of more HCl prior to stratospheric injection, thereby reducing their atmospheric impact.

Tough Love: Nurturing And Coercing Responsibility And Recovery In California Drug Courts, Stacy Lee Burns Jan 2003

Tough Love: Nurturing And Coercing Responsibility And Recovery In California Drug Courts, Stacy Lee Burns

Sociology Faculty Works

This article considers the activities of the participants in California drug treatment courts and their differences from more traditional criminal courts. The article focuses on how drug court judges and defendants interact to construct the defendant as a personally responsible and rehabilitatively changed "recovering" person, or, alternatively, as an essentially "addicted" and deficient self. The research also explores broader links between the ways drug courts operate and the potential complications involved in mixing coerced treatment and "voluntary" participation. The study finds that certain kinds of defendants may be discovered to be unsuitable for participation in the program; that clients negotiate …

A New Framework For Building Secure Collaborative Systems In Ad Hoc Network, Hans-Peter Bischof, Alan Kaminsky, Joseph Binder

Articles

Maturing software development organizations are beginning to identify a distinct role in the software team: Software Process Engineer. A software process engineer designs the software processes used by the organization. The software process includes the process content (identification of the roles, activities, and work products of the processes, along with specific techniques, tools, guidance, examples and other supporting information) and the lifecycle model (the ordering of and dependencies between software engineering activities and work products). A process engineer assembles a process from existing process components, choosing and tailoring components to provide the balance of agility and discipline necessary for their …

Comparative Study Of Spectral Reflectance Estimation Based On Broad-Band Imaging Systems, Francisco Imai, Lawrence Taplin, Ellen Day Jan 2003

Comparative Study Of Spectral Reflectance Estimation Based On Broad-Band Imaging Systems, Francisco Imai, Lawrence Taplin, Ellen Day

Articles

We have been practicing spectral color estimation for museum artwork imaging and spectral estimation. We have had success using both narrow-band imaging based on a liquid crystal tunable filter (LCTF) and various broad-band imaging approaches using the same monochromatic digital camera system. Details about our spectral color imaging system description, imaging procedures and the performance of spectral estimation methods used can be found in our previous technical reports.1,2 In previous reports we focused in methods of reconstruction from narrow-band images using LCTF, while we only reported preliminary analyses of reconstruction from wide-band images using six glass filtered images and a …

Hubble Space Telescope Observations Of Ngc 6240: A Case Study Of An Ultra-Luminous Infrared Galaxy With Obscured Activity, Joris Gerssen, Roeland P. Van Der Marel, David Axon, J. Christopher Mihos, Lars Hernquist, Joshua E. Barnes

Articles

We present results from an HST study of the morphology and kinematics of NGC 6240. This merging galaxy with a double nucleus is one of the nearest and best-studied ultraluminous infrared galaxies. HST resolves both nuclei into seperate components. The distance between the northern and southern optical/near-infrared components is greater than that observed in radio and X-ray studies, arguing that even in K-band we may not be seeing all the way through the dust to the true nuclei. The ionized gas does not display rotation around either of the nuclei, or equilibrium motion in general. There is a strong velocity …

Aspects Of Land Use In Slash And Burn Agriculture, Amitrajeet A. Batabyal, Dug Man Lee Jan 2003

Aspects Of Land Use In Slash And Burn Agriculture, Amitrajeet A. Batabyal, Dug Man Lee

Articles

In this paper we first construct a theoretical model of land use by swidden cultivators when these cultivators can choose whether to grow a cash crop or a food/subsistence crop. Second, we study the land quality accumulation decision faced by shifting cultivators and, in the process, we show how to compute the optimal length of time during which cleared land is to be left fallow. Finally, we investigate the implications that the optimal land quality accumulation decision has for the relative price of the food crop in particular and slash and burn agriculture in general.

Constraints On Cosmic Dynamics, Manasse Mbonye Jan 2003

Constraints On Cosmic Dynamics, Manasse Mbonye

Articles

Also archived at: arXiv:gr-qc/0309135 v1 30 Sep 2003 Observationally, the universe appears virtually critical. Yet, there is no simple explanation for this state. In this article we advance and explore the premise that the dynamics of the universe always seeks equilibrium conditions. Vacuum-induced cosmic accelerations lead to creation of matter-energy modes at the expense of vacuum energy. Because they gravitate, such modes constitute inertia against cosmic acceleration. On the other extreme, the would-be ultimate phase of local gravitational collapse is checked by a phase transition in the collapsing matter fields leading to a de Sitter-like fluid deep inside the black …

The Irony Of Campbell V. Jones: Tolerating Slander In The Pursuit Of Justice, James Macduff, Kristen Rudderham Jan 2003

The Irony Of Campbell V. Jones: Tolerating Slander In The Pursuit Of Justice, James Macduff, Kristen Rudderham

Dalhousie Journal of Legal Studies

In determining whether the defence of qualified privilege should shield defamatory comments from liability, Canadian courts must assess many contextual factors that aim to strike an appropriate balance between the right to free expression and the protection of an individual's reputation. This paper examines the Nova Scotia Court of Appeal's decision in Campbell v. Jones, where the majority found that this privilege should extend to cover remarks alleging racist police motivations to the world at large. Chief Justice Glube and Justice Roscoe held that the two lawyers who made these comments had a professional responsibility to seek improvements to the …

The New Privacy, Paul M. Schwartz, William Michael Treanor Jan 2003

The New Privacy, Paul M. Schwartz, William Michael Treanor

Georgetown Law Faculty Publications and Other Works

This article reviews Overseers of the Poor: Surveillance, Resistance and the Limits of Privacy John Gilliom (2001).

In 1964, as the welfare state emerged in full force in the United States, Charles Reich published The New Property, one of the most influential articles ever to appear in a law review. Reich argued that in order to protect individual autonomy in an "age of governmental largess," a new property right in governmental benefits had to be recognized. He called this form of property the "new property." In retrospect, Reich, rather than anticipating trends, was swimming against the tide of history. …

The Art Of Legislative Lawyering And The Six Circles Theory Of Advocacy, Chai R. Feldblum Jan 2003

The Art Of Legislative Lawyering And The Six Circles Theory Of Advocacy, Chai R. Feldblum

Georgetown Law Faculty Publications and Other Works

A "legislative lawyer" is a person who exists in Washington, D.C., and in almost every city and state in this country where legislation and administrative regulations are developed. But most people do not know who that person is or what that person does. In fact, most advocacy organizations that should be hiring legislative lawyers have no idea who a legislative lawyer is.

The author coined the term "legislative lawyer" when she created a Federal Legislation Clinic at the Georgetown University Law Center in Washington, D.C. over a decade ago. The author needed to explain to her faculty colleagues what type …

In this review, I will concentrate on the policies and experiences of the Federal Trade Commission - an agency with which I am more familiar than the Department of Justice. Professor Grimes appreciates that FTC disclosure policies provide more information than the Antitrust Division of the DOJ. I will leave it to others to explain why Department of Justice policies, particularly in the area of criminal enforcement, deserve to be different.

Pushing Drugs: Genomics And Genetics, The Pharmaceutical Industry, And The Law Of Negligence, Heidi Li Feldman Jan 2003

Pushing Drugs: Genomics And Genetics, The Pharmaceutical Industry, And The Law Of Negligence, Heidi Li Feldman

Georgetown Law Faculty Publications and Other Works

This article presents a piece of a larger, ongoing project on the phenomenon of market-driven manufacturing (MDM) and how tort law should address it. In contrast to the larger project, this article provides a relatively brief overview of the general phenomenon of MDM, but zeros in on how pharmaceutical manufacturers specifically practice MDM. MDM is a well-documented, much practiced activity, although American courts do not recognize MDM as a discrete category of conduct. The basic idea of MDM is that marketing considerations should continuously control every aspect and stage of a product's lifecycle. When a company engages in MDM, it …
