Legal Interviewing And Counseling: An Introduction, Ann Shalleck, Robert Dinerstein, Stephen Ellmann, Isabelle Gunning

Scholarly Articles in Law Reviews & Journals

n this article, the authors, who are writing their own textbook on interviewing and counseling, reflect on the ways in which Gary Bellow & Bea Mou/ton's groundbreaking textbook, The Lawyering Process, has shaped and is shaping their work. The authors include the introductory chapter of their forthcoming textbook interspersed with commentary on the influence of Bellow & Moulton on each of the primary themes through which their textbook will explore interviewing and counseling: variations in the lawyer-client relationship, context, connection, ethics and theory-driven lawyering. This review allows them to evaluate, not only how deeply and pervasively the Bellow & Moulton …

How Should We Theorize Class Interests In Thinking About Professional Regulation: The Early Naacp As A Case Example, Susan Carle

Scholarly Articles in Law Reviews & Journals

INTRODUCTION The Editors of the Cornell Journal of Law and Public Policy have specifically requested that I address in this essay some research I finished quite a while ago, but to which I hope to return in the near future, concerning the history of the first national legal committee of the National Association for the Advancement of Colored People (NAACP). (1) Therefore, I plan to raise a big picture question left unanswered by that earlier research here: how should we understand lawyers' class interests in relation to their involvement in the development of legal ethics rules concerning public interest law …

Mental Health And Incarceration: What A Bad Combination, Olinda Moyd

Scholarly Articles in Law Reviews & Journals

The District of Columbia has one of the highest per capita incarceration and criminal justice supervision rates in the United States1 and among the highest in the world. The local prison population has risen dramatically over the past decade for a variety of reasons including increased rates of re-incarceration for parole violations and the imposition of longer sentences for drug offenses. Recent acts of Congress have seriously impacted the sentencing laws in the District including determination of where persons sentenced for violating local D.C. laws will serve such sentences. On August 5, 1997, President Clinton signed into law The National …

Marriage Law: Obsolete Or Cutting Edge?, Michigan Journal Of Gender & Law

Michigan Journal of Gender & Law

Over the past hundred years, social and cultural expectations surrounding various forms of committed relationships have changed dramatically, and contemporary legal systems have struggled to adapt. The result has been an extraordinary opportunity to test fundamental assumptions about law, about the cultural understandings that are enforced through state power, and about the mechanisms that drive law's evolution. The Michigan Journal of Gender & Law has drawn together an exceptional group of panelists who will discuss these questions throughout the day.

Guidelines With Commentary For The Evaluation Of Legal Externship Programs, J.P. "Sandy" Ogilvy Jan 2003

Guidelines With Commentary For The Evaluation Of Legal Externship Programs, J.P. "Sandy" Ogilvy

Scholarly Articles

This Article is part of a larger project to create a set of guidelines, with commentary, for the evaluation of clinical legal education programs. The Externship Guidelines ("Guidelines") are published here with the hope and expectation that the legal education community will read, analyze, and comment on them. As a result of that input, subsequent drafts of the Guidelines should reflect a broad consensus among legal educators with respect to the standards for good legal externship programs and a methodology for evaluating legal externship programs. It also is anticipated that working on guidelines in the discrete area of legal externships …

Court Review: Journal of the American Judges Association

Before describing each of the articles in this issue, let me take a moment to comment on the sorts of problems that arise in editing a journal intended for both a United States and Canadian audience. The American Judges Association was formed in the United States and has most of its members there. It also has a substantial—and growing—membership in Canada. As our Canadian readers are well aware, there are some differences in the way the English language is used in Canada and in the United States. (For an entertaining and enlightening discussion of some of the differences, prepared by …

Court Review: Volume 39, Issue 4 - Helping The Pro Se Litigant: A Changing Landscape, Paula Hannaford-Agor

Court Review: Journal of the American Judges Association

For several years, judges, court staff, and a growing number of lawyers have recognized that at least one party is not represented by a lawyer in a sizeable portion of family law and smaller civil cases. Often both parties are self-represented. Two underlying factors associated with self-represented litigation— the relative scarcity of affordable legal services and an increased “do-it-yourself” attitude by many litigants—are fairly self-evident. What is less clear is how best to ensure that these litigants have sufficient access to the justice system to be able to resolve legal problems fairly and effectively.

Courts and legal service providers have …

The Constitutional Tension Between Apprendi And Mckeiver: Sentence Enhancements Based On Delinquency Convictions And The Quality Of Justice In Juvenile Courts, Barry C. Feld Jan 2003

The Constitutional Tension Between Apprendi And Mckeiver: Sentence Enhancements Based On Delinquency Convictions And The Quality Of Justice In Juvenile Courts, Barry C. Feld

Articles

In Apprendi v. New Jersey, the Supreme Court ruled that any fact that increases the penalty for a crime “other than the fact of a prior conviction” must be submitted to a jury and proved beyond a reasonable doubt. Apprendi exempted the fact of a prior conviction from its holding because criminal defendants enjoyed a constitutional right to a jury trial at the time the state obtained that conviction which assured the accuracy and reliability of the prior record. By contrast, a plurality of the Supreme Court in McKeiver v. Pennsylvania denied juvenile delinquents a constitutional right to a jury …
