The Challenges Of Attracting Foreign Investment Into North Korea: The Legal Regimes Of Sinuiju And Gaeseong, Joongi Kim Jan 2003

The Challenges Of Attracting Foreign Investment Into North Korea: The Legal Regimes Of Sinuiju And Gaeseong, Joongi Kim

Fordham International Law Journal

Though still in its infant stages, the process of establishing the Sinuiju Special Administrative Region and the Gaeseong Industrial Complex heralds a tremendous paradigm shift on the part of North Korea. This Essay will seek to analyze the comprehensive legal structure that North Korea has adopted for these regions. It will seek to offer a glimpse into the future of how North Korea will establish similar economic zones throughout the country and, eventually, a market-based economic system across the entire country. This Essay will first offer an overview of the impetus behind North Korea's efforts to develop Sinuiju and Gaeseong. …

The Legal Development Of The Environmental Policy In The Democratic People's Republic Of Korea, Sangmin Nam Jan 2003

The Legal Development Of The Environmental Policy In The Democratic People's Republic Of Korea, Sangmin Nam

Fordham International Law Journal

Credited with transforming North Korea into a green and livable people's land due to his environmental vision, Kim Il Sung often pointed out serious environmental degradation, such as air pollution in industrial cities, water pollution, and deforestation. Eventually, the leadership turned to laws for better implementation of environmental protection. In explaining this law-making process, this Essay first discusses the understanding and interpretation of the environment in the DPRK. It is critical to discuss North Korean leaders' perceptions of the environment because their interpretation precedes the decisions and laws of the Cabinet and the Korean Workers' Party. After discussing the failings …

The Sword In The Mirror – The Lawfulness Of North Korea's Use And Threat Of Use Of Nuclear Weapons Based On The United States' Legitimization Of Nuclear Weapons, Charles J. Moxley, Jr.

Fordham International Law Journal

This Article addresses the lawfulness of the use or threat of use of nuclear weapons by the Democratic People's Republic of Korea ("North Korea" or "DPRK"). I address the topic from three perspectives: 1) North Korea's own statements of the matter; 2) U.S. statements of the law as applied to its own nuclear weapons; and 3) my evaluation of the matter based on international law as stated by the United States and as found by the International Court of Justice in the Nuclear Weapons Advisory Decision.

America's De Facto Guest Workers: Lessons From Germany's Gastarbeiter For U.S. Immigration Reform, Nicole Jacoby Jan 2003

America's De Facto Guest Workers: Lessons From Germany's Gastarbeiter For U.S. Immigration Reform, Nicole Jacoby

Fordham International Law Journal

Part I of this Note describes West Germany's post-war Gastarbeiter [guest worker] program from 1961 to 1972. Part II focuses on the long-term results of the Gastarbeiter program, with special emphasis on the legal status of Turkish Gastarbeiter in Germany. This assessment concludes that guest worker programs inevitably result in the permanent settlement of foreigners in the host country. If not properly anticipated and planned for, this settlement leads to social stratification and political divisiveness. Part II also presents for comparison U.S. immigration policies and their effect on Mexican immigrant workers. The section asserts that the United States over the …

No Recourse: Transnational Corporations And The Protection Of Economic, Social, And Cultural Rights In Bolivia , Maria Mcfarland Sánchez-Moreno, Tracy Higgins

Fordham International Law Journal

This Report analyzes two cases in which TNC activities have had an impact on Bolivian citizens' enjoyment of economic, social, and cultural rights (“ESC rights”). In so doing, it analyzes not only corporate conduct but also the Bolivian government's role in protecting ESC rights from violation. The cases involve an oil spill by Transredes, a TNC partly owned by Enron and Shell, in Bolivia's Desaguadero River, which affected over one hundred indigenous communities; and the water war that took place in the city of Cochabamba over the privatization of Cochabamba's water system and its operation by the consortium Aguas del …

Developments, Issues, And New Remedies – The Duties Of National Authorities And Courts Under Article 10 Of The Ec Treaty , John Temple Lang

Fordham International Law Journal

The Court of Justice is using Article 10 of the EC Treaty more frequently, in a wide variety of cases. This Article summarizes and comments briefly on more than forty cases which have been decided and issues which have arisen since the Congress of FIDE, the Fédération Internationale pour le Droit Européen, in Helsinki in 2000, where the case law on Article 10 was discussed at length. The Court is continuing to draw a variety of practical conclusions from the general words of the Article, elaborating and applying existing case-law, and ruling on both positive and negative duties resulting from …

Two Roads Diverged In A Yellow Wood: The European Community Stays On The Path To Strict Liability, Josephine Liu

Fordham International Law Journal

Part I of this Note will briefly outline Community policy on product liability as detailed by the Product Liability Directive, then review the development of product liability law in various Member States of the European Community. Part II will analyze how the concept of state-of-the-art highlighted tensions between a strict liability regime and a negligence regime in U.S. product liability. It will then review similar discord in the European Community caused by the development risk defense. Finally, Part III of this Note will argue that in contrast to the United States, the European Community has thus far chosen to stay …

Vengeance And Empire: The Leftist Case For War In Iraq – William Shawcross, Allies: The U.S., Britain, Europe, And The War In Iraq , Hal Blanchard Jan 2003

Vengeance And Empire: The Leftist Case For War In Iraq – William Shawcross, Allies: The U.S., Britain, Europe, And The War In Iraq , Hal Blanchard

Fordham International Law Journal

Shawcross is superbly equipped to assess the impact of rogue States and terrorist organizations on global security. He is also well placed to comment on the risks of preemptive invasion for existing alliances and the future prospects for the international rule of law. An analysis of the ways in which the international community has “confronted evil,” Shawcross' brief polemic argues that U.S. President George Bush and British Prime Minister Tony Blair were right to go to war without UN clearance, and that the hypocrisy of Jacques Chirac was largely responsible for the collapse of international consensus over the war. His …

David Feller, Senior Partner, Michael H. Gottesman Jan 2003

David Feller, Senior Partner, Michael H. Gottesman

Georgetown Law Faculty Publications and Other Works

While in law school, in the late 1950's, I decided that I wanted a career in labor law, representing unions. I asked my labor law professor what firms I should consider. He told me there was one firm nationwide that stood out from all the rest: Goldberg, Feller and Bredhoff. He warned, though, that the firm was very small, and the chances of getting a job there remote. I did some research and discovered that the firm had only four lawyers: three partners (Arthur Goldberg, Dave Feller, and Elliot Bredhoft), and one associate (Jerry Anker). The firm was General Counsel …

Sovereignty - Modern: A New Approach To An Outdated Concept, John H. Jackson Jan 2003

Sovereignty - Modern: A New Approach To An Outdated Concept, John H. Jackson

Georgetown Law Faculty Publications and Other Works

This article, however, does not purport to cover all possible dimensions of sovereignty but, instead, focuses primarily on what might be thought of as the core of sovereignty - the "monopoly of power" dimension - although it will be clear that even this focus inevitably entails certain linkages and "slop-over penumbra" of the other sovereignty dimensions. This "core" dimension is examined in the context of its roles with respect to international law and institutions generally, and international relations and related disciplines such as economics. National government leaders and politicians, as well as special interest representatives, too often invoke the term …

Suing The Federal Government: Sovereignty, Immunity, And Judicial Independence, Vicki C. Jackson Jan 2003

Suing The Federal Government: Sovereignty, Immunity, And Judicial Independence, Vicki C. Jackson

Georgetown Law Faculty Publications and Other Works

As I suggest below in Part I, federal sovereign immunity was a doctrine of limited effect in the early years of this republic and allowed for a number of remedies for governmental wrongdoing. Moreover, the constitutional provenance of federal "sovereign immunity" is obscure, and was a matter of genuine uncertainty in early years. Over time the doctrine developed, drawing support from some aspects of constitutional architecture as well as from unreasoning and mistaken extensions of other versions of "sovereign immunity." Among the strands of constitutional structure behind federal "sovereign immunity" are Congress' powers over appropriations and the jurisdiction of the …

Law As Social Work, Jane H. Aiken, Stephen Wizner Jan 2003

Law As Social Work, Jane H. Aiken, Stephen Wizner

Georgetown Law Faculty Publications and Other Works

In our work as lawyers for low income clients and as clinical teachers, we are sometimes told by our professional counterparts in private practice - especially those who work in large corporate firms - that what we do "isn't law, it's social work." Similarly, our students sometimes complain that the work they do on behalf of low income clients "isn't law, it's social work." In the past we have tended to respond to this "social worker" charge defensively. We insisted that what we and our students do is "law," that it is really no different from what private practitioners do …

Representation Of Web Data In A Web Warehouse, Sourav S. Bhowmick, Sanjay Madria, Wee Keong Ng

Computer Science Faculty Research & Creative Works

We believe that, to manage Web data effectively, there is a need to build a data warehouse of Web data, i.e. a Web warehouse. in this paper, we focus on how to represent and store relevant hyperlinked Web documents effectively in a Web warehouse called WHOWEDA (WareHouse of WEb DAta) for further querying and manipulation. We present a simple and general model for representing metadata, structure and content of Web documents and hyperlinks in WHOWEDA. We discuss node and link objects which are used to represent Web documents and hyperlinks respectively in WHOWEDA. These objects are first class objects in …

Reciprocal Effects Of Crime And Incarceration In New York City Neighborhoods, Jeffery Fagan, Valerie West, Jan Holland Jan 2003

Reciprocal Effects Of Crime And Incarceration In New York City Neighborhoods, Jeffery Fagan, Valerie West, Jan Holland

Faculty Scholarship

The concentration of incarceration in social groups and areas has emerged in the past decade as a topic of research and policy interest. This interest was fueled by several factors: persistent continued growth of incarceration through the 1990s, even as crime rates fell nationally for over seven years; persistent racial disparities in incarceration; assessments of the collateral consequences of incarceration that potentially aggravate the causal dynamics that lead to elevated crime rates; rapid growth in the number of returning prisoners to their communities; an influx that may strain social control in neighborhoods where social and economic disadvantages have already created …

Re-Imagining Justice, Robin West Jan 2003

Re-Imagining Justice, Robin West

Georgetown Law Faculty Publications and Other Works

What do we mean by legal justice, as opposed to distributive, or social, or political justice; what is the justice, that is, we hope law promotes? What is the justice that lawyers and judges, peculiarly, are professionally committed to pursue? What is the virtue around which, arguably, this profession, and the individuals within it, have defined their public lives?

Justice -- and more particularly legal justice -- is a badly under-theorized topic in jurisprudence; perhaps surprisingly, there is little written on it. The paucity of writing of course has a history. It can be traced to the turn of the …

The Original Meaning Of The Necessary And Proper Clause, Randy E. Barnett Jan 2003

The Original Meaning Of The Necessary And Proper Clause, Randy E. Barnett

Georgetown Law Faculty Publications and Other Works

In this Article, I present the evidence of the original public meaning of the Necessary and Proper Clause." These findings will, of course, be of interest to originalists. But, they should also be of interest to the many constitutional scholars who consider original meaning to be one among several legitimate modes of constitutional analysis, or who consider original meaning the starting point of a process by which this meaning is translated into contemporary terms. By either account, it is important to find the correct original meaning, even if it is not dispositive of today's cases and controversies. I will show …

Drm And Privacy, Julie E. Cohen Jan 2003

Drm And Privacy, Julie E. Cohen

Georgetown Law Faculty Publications and Other Works

Interrogating the relationship between copyright enforcement and privacy raises deeper questions about the nature of privacy and what counts, or ought to count, as privacy invasion in the age of networked digital technologies. This Article begins, in Part II, by identifying the privacy interests that individuals enjoy in their intellectual activities and exploring the different ways in which certain implementations of DRM technologies may threaten those interests. Part III considers the appropriate scope of legal protection for privacy in the context of DRM, and argues that both the common law of privacy and an expanded conception of consumer protection law …

Security And Freedom: Are The Governments' Efforts To Deal With Terrorism Violative Of Our Freedoms?, David Cole Jan 2003

Security And Freedom: Are The Governments' Efforts To Deal With Terrorism Violative Of Our Freedoms?, David Cole

Georgetown Law Faculty Publications and Other Works

One of the most common things that is said about September 11th is that it changed everything. In some respects, that is true. In the most important respects it would be more accurate to say it has changed everything for some, far more than it has for others. One instance of that can be seen in a pole that National Public Radio did one year after September 11th. They asked people to what extent their life had changed. They asked them whether they had to give up any important rights or freedoms in the war on terrorism. Only seven percent …

The Joy Of Teaching Legislation, Chai R. Feldblum Jan 2003

The Joy Of Teaching Legislation, Chai R. Feldblum

Georgetown Law Faculty Publications and Other Works

I am going to talk about teaching legislation, a class I have taught several times at Georgetown University Law Center, as well as teaching a federal legislation clinic, which I founded ten years ago at the law school. Bill Eskridge has done a wonderful job laying out the different ways one can teach a course in legislation; you will see that my approach focuses on teaching the skills that, as Bill also correctly noted, all young lawyers will need when they start practicing.
