India's Wto Challenge To Drug Enforcement Conditions In The European Community Generalized System Of Preferences: A Little Known Case With Major Repercussions For "Political" Conditionality In Us Trade Policy, Robert Howse

Chicago Journal of International Law

The use of trade sanctions for broad foreign policy purposes has been a matter of longstanding controversy in the United States. Apart from questioning the effectiveness of such sanctions, and pointing out that they may have innocent victims (such as workers in oppressive regimes whose jobs are dependent on export opportunities), free traders often claim that sanctions violate the rules of the World Trade Organization ("WTO"). In fact, the General Agreement on Tariffs and Trade ("GATT"), the centerpiece of the WTO as far as trade in goods is concerned, does not put free trade above other political values and contains …

Où Est Votre Chapeau? Economic Sanctions And Trade Regulation, Michael P. Malloy Sep 2003

Où Est Votre Chapeau? Economic Sanctions And Trade Regulation, Michael P. Malloy

Chicago Journal of International Law

This article seeks to determine whether US economic sanctions can be maintained consistently with the obligations of the international trade regime. In Part I, it will consider the extent to which the current prevalence of economic sanctions may create tension with international trading rules. In Part II, the article will assess arguments that sanctions are inconsistent with applicable principles of customary international law. Part III will consider whether sanctions are inconsistent with international trading regimes and consequently are impermissible. In Part IV, the article concludes that while sanctions are legally permissible in the face of indeterminate legal obligations and international …

Libertarian Paternalism Is Not An Oxymoron, Cass R. Sunstein, Richard H. Thaler Sep 2003

Libertarian Paternalism Is Not An Oxymoron, Cass R. Sunstein, Richard H. Thaler

University of Chicago Law Review

The idea of libertarian paternalism might seem to be an oxymoron, but it is both possible and desirable for private and public institutions to influence behavior while also respecting freedom of choice. Often people's preferences are unclear and ill-formed, and their choices will inevitably be influenced by default rules, framing effects, and starting points. In these circumstances, a form of paternalism cannot be avoided. Equipped with an understanding of behavioral findings of bounded rationality and bounded self-control, libertarian paternalists should attempt to steer people's choices in welfare-promoting directions without eliminating freedom of choice. It is also possible to show how …

Grading The Government, Richard W. Parker Sep 2003

Grading The Government, Richard W. Parker

University of Chicago Law Review

For over a decade, scathing critiques of government have been fueled by a group of studies called "regulatory scorecards," which purport to show that the costs of many government regulations vastly outweigh their benefits. One widely cited study by John Morrall, an OMB economist, claims that government regulations cost up to $72 billion per life saved. Another study, co-authored by Bush's regulatory "czar," John Graham, claims that over 60,000 people lose their lives each year due to irrational government regulation. A third group of scorecards--compiled by Robert Hahn of the AEI-Brookings Joint Center for Regulatory Studies--claims that over half of …

Effects Of Cecropia Obtusifolia Leaf Ingestion On Lung Capacity, September 2003, Catherine Ross Sep 2003

Effects Of Cecropia Obtusifolia Leaf Ingestion On Lung Capacity, September 2003, Catherine Ross

Monteverde Institute: Tropical Ecology and Conservation

People in developing countries have traditionally used forests as sources of local, cheap medicines. One plant used throughout the Neotropics is Cecropia spp., most notably for asthma. The purpose of this study was to determine if tea made from Cecropia obtusifolialeaves increases lung capacity and in what time frame this takes place. This was accomplished by treating a group of people with Cecropia tea for five days and another group with a placebo treatment and comparing the change in lung capacity of the two. The short term change in the placebo group had a statistically insignificant decrease of 2% while …

Technology, Transformation, And New Operational Concepts, Elihu Zimet, Robert E. Armstrong, Donald C. Daniel, Joseph N. Mait Sep 2003

Technology, Transformation, And New Operational Concepts, Elihu Zimet, Robert E. Armstrong, Donald C. Daniel, Joseph N. Mait

Defense Horizons

Throughout history, technology has been central to warfare, often giving qualitative advantages to numerically inferior forces. Typically, the rate of technology development has been relatively slow and the introduction of new weapons systems even slower, which has allowed evolutionary development of operational concepts. Today’s accelerated pace of technology development no longer allows sequential development of operational concepts. In addition, the current global political environment has placed demands upon the military that range from engaging in major regional conflicts to stabilization, reconstruction and peacekeeping, all creating a continuous need for flexible, adaptive systems and new concepts of operation.

The first purpose …

Context-Induced Contrast And Assimilation In Judging Supportiveness, Catherine Lutz, Jay L. Cohen, Lynn C. Neely, Sarah Baltman, Susan Schreiber, Brian Lakey Sep 2003

Context-Induced Contrast And Assimilation In Judging Supportiveness, Catherine Lutz, Jay L. Cohen, Lynn C. Neely, Sarah Baltman, Susan Schreiber, Brian Lakey

Psychology Faculty Publications

Social support research increasingly draws from research on social cognition. Most of this research has studied assimilation and chronically accessible (i.e., frequently activated) social support constructs. This article presents three studies, in both laboratory and treatment settings, on context-induced contrast and assimilation in support judgments. In each study, participants exposed to positive social contexts subsequently rated supportive stimuli more negatively than participants exposed to negative social contexts. These effects were observed in ratings of participants’ own social networks, the social climate of a residential treatment environment, and a videotaped supportive interaction. In two studies, negative contexts also were associated with …

Promoting Savings And Investment Culture For National Development, O. J. Nnanna Sep 2003

Promoting Savings And Investment Culture For National Development, O. J. Nnanna

Economic and Financial Review

The paper examined the performance of Nigeria's savings and investment profile relative to some selected economies of the world. It noted that the fundamental issues militating against an effective savings and investment culture in Nigeria has remained, financial sector distress, high inflationary expectation, low yield on investments and inappropriate institutional structures. Amongst the various efforts being made to enhance savings and investment culture in Nigeria, the paper identified the recently introduced National Savings Certificate ( NSC) as a key investment window for the low income group with attractive yield and thus, a strong alternative to bank deposits, the proposed pension …
