Economic Currents: The State Of The State Economy, Alan Clayton-Matthews
Economic Currents: The State Of The State Economy, Alan Clayton-Matthews
Public Policy and Public Affairs Faculty Publication Series
Over the course of the summer, the Massachusetts economy appears to have begun to turn the corner. In the first quarter of this year, gross state product, as measured by the current index for Massachusetts, experienced its ninth consecutive quarter of decline. In the second quarter, it was flat, and in the third quarter, managed to eke out a small gain, growing at an annualized rate of 0.4 percent. The shift in direction is being led by a recovery in demand for, and production of, technology products that began at the end of 2002, and has continued to gather momentum …

The Counselor As Expert Witness: Changes In The Michigan Hearsay Rule, John J. Pietrofesa, Cathy J. Pietrofesa, John David Pietrofesa
Michigan Journal of Counseling: Research, Theory and Practice
This article discusses the expanding role of the professional counselor as expert witness. The preferred role of the expert witness is one in which the expert informatively presents the facts and does not act as an advocate trying to influence a legal decision. The expert witness in Michigan now has to consider changes in the Michigan Rules of Evidence which disallows any hearsay evidence the counselor may have acquired during counseling. Additionally, supporting documentation for opinions may not simply be cited, but must be placed into evidence. This article concludes with suggestions for counselors in preparing for the role as …

Children, Sports, And Family Dynamics: Are We Having Fun Yet?, Patrick J. Morrissette, Roberta Graham
Michigan Journal of Counseling: Research, Theory and Practice
The involvement of children in sports is rarely an individual endeavor and can positively and /or negatively affect the entire family system to varying degrees. However, little has been written about how children’s participation in sports impact family dynamics. In working toward filling this void, this paper elaborates on several themes that can emerge when children participate in school or community sports. The themes that will be discussed in this paper include: parent/coach/child triangulation, parent coach-parent conflict, performing a dual role, the family all-star, time, financial commitment, and differing parental perspectives. Based on informal observations and discussions with children, parents, …
Assessing Extension Internal Organizational Needs Through An Action Research And Learning Process, Michael Havercamp, Elizabeth Christiansen, Deborah Mitchell
Assessing Extension Internal Organizational Needs Through An Action Research And Learning Process, Michael Havercamp, Elizabeth Christiansen, Deborah Mitchell
Journal of Extension
A participatory action research and learning process was used to carry out an internal needs assessment for a statewide Extension organization in a western United States land-grant institution. Focus groups, a written questionnaire, and employee feedback sessions were utilized as a means of identifying strategic organizational issues, needs, and resources that the organization would prioritize based on a 5-year time frame. The research and learning process, discussion of the results, limitations of the study, and implications for similar use of this process are discussed in this article.

Success Outcome Markers In Extension (Some): Evaluating The Effects Of Transformational Learning Programs, S Kay Rockwell, Ladeane Jha, Eileen Krumbach
Journal of Extension
Success outcome markers (SOMs), and the process of creating them, offer Extension a new approach to plan, monitor, and evaluate programs. Generating success outcome markers helps to carefully determine all partners (including beneficiaries) who may need to change to accomplish program goals and identifies steps to continuously track incremental successes. Hard-to-measure human behaviors become more concrete when success outcome markers are listed. To successfully use SOMs, one must (a) create a vivid and compelling vision, (b) list your WHOs, (c) write an outcome challenge for each WHO, and (d) determine SOMs. Then decide how to monitor and report on each …

Logger Training Leads To Improved Market Access But No Price Premium, Renė Germain, Steve Harris
Journal of Extension
The Sustainable Forestry Initiative (SFI) Program is a catalyst to develop or improve state-based logger training programs. SFI characterizes the role of loggers as the most visible and engaged participants in the implementation of sustainable forest management. This article discusses the use and compensation of trained loggers, contrasting SFI wood procurement operations with non-SFI operations. The results indicate that trained loggers are being used but are not receiving additional compensations for their training efforts. Logger training providers, such as Cooperative Extension Forestry Programs, should be aware that training for loggers may not translate into a price advantage but is likely …

Value Of An Educational Program On Osteoporosis, Judy A. Driskell, H Darlene Pohlman, M Michelle Naslund
Journal of Extension
Cooperative Extension helped initiate a community-based educational program on osteoporosis prevention and treatment. The program utilized a network of partners and coalitions. A team approach was taken in presenting the educational session, offered twice, and answering/discussing participant questions. Statistically significant differences were observed in the program participants' reported knowledge of osteoporosis, taking of calcium supplements, eating of a calcium-rich diet, and performing weight-bearing exercises 1 month after the sessions as compared to prior. The results demonstrate that Cooperative Extension can play a leadership role in building partnerships that implement effective programs that improve the health behaviors of individuals and strengthen …
Volunteers: The Key To Expanding Extension Programming For Older Adults, Claudia C. Collins
Volunteers: The Key To Expanding Extension Programming For Older Adults, Claudia C. Collins
Journal of Extension
With the rapid growth of the nation's aging population, Extension is trying to provide useful programming for seniors. Like many other Extension programs, older adult wellness education is expanding through the use of volunteer instructors. For the University of Nevada Cooperative Extension's Seniors CAN program, these volunteers come primarily from two groups: peer-educators who are over 55 years of age, including those from diverse populations, and the staff of agencies that already provide services to elderly clients. The inclusion of these volunteer instructors has the benefit of bringing Extension programming to a much larger and more diverse aging audience.
Transformative Explanations: Writing To Overcome Counterintuitive Ideas, Joye C. Gordon
Transformative Explanations: Writing To Overcome Counterintuitive Ideas, Joye C. Gordon
Journal of Extension
This article presents a five-step writing tool, called "transformative explanation," that provides a proven mechanism to promote acceptance of hard-to-understand concepts. When Extension messages present counterintuitive information, message consumers are psychologically motivated to reject the proposition and retain previous understandings. Because gaining perceptual compliance is often a prerequisite to other communication objectives, transformative explanations provide an important tool for message designers.

Opposing Excessive Use Of Employer Bargaining Power In Mandatory Arbitration Agreements Through Collective Employee Actions, Michael Z. Green
Opposing Excessive Use Of Employer Bargaining Power In Mandatory Arbitration Agreements Through Collective Employee Actions, Michael Z. Green

When you review the modern employment relationship and the role of contract, you have to start with the default position of employment-at-will, which allows an employer, in general, to terminate an employee for good reason, bad reason, or no reason at all. A number of exceptions to the employment-at-will rule exist, including tort and statutory employment discrimination claims that allow employees to seek legal remedies and punitive damage awards from juries. As these exceptions have developed outside of contract law, employers have responded by a major contractual effort to shift these disputes away from the courts and into arbitration. The …
The Pernicious Effect Of Employment Relationships On The Law Of Contracts, Franklin G. Snyder
The Pernicious Effect Of Employment Relationships On The Law Of Contracts, Franklin G. Snyder
Faculty Scholarship
The relationship between employment and contract law is peculiar. On the one hand, employment in modern American society seems to be a classic voluntary agreement among consenting adults. It is a "promise or a set of promises," in the wooden but circular language of the Restatement, "for the breach of which the law gives a remedy, or the performance of which the law in some way recognizes as a duty." Thus, employment relationships figure prominently in a great many landmark contract law decisions, in areas like capacity, duress, certainty, consideration, promissory estoppel, illegality and public policy, anticipatory repudiation, mitigation of …

In November 2001, member states of the World Trade Organization (WTO) approved the proposal to admit China to the international trading body. After fifteen years of exhaustive negotiations, China finally became the 143rd member of the WTO on December 11, 2001. To reflect on this event, this panel brings together six China experts to explore the ramifications of China's accession to the WTO. Among the issues addressed are whether China is making progress in its compliance with the WTO requirements, whether China is suffering setbacks in the socio-economic arena, whether there are any prospects for democratic reforms and stronger human …
Four Common Misconceptions About Copyright Piracy, Peter K. Yu
Four Common Misconceptions About Copyright Piracy, Peter K. Yu
Faculty Scholarship
Copyright piracy is one of the most difficult, yet important, transnational problems in the twenty-first century. Although legal literature has discussed copyright piracy extensively, commentators rarely offer a "grand unified theory" on this global problem. Rather, they give nuanced analyses, discussing the many aspects of the problem-political, social, economic, cultural, and historical.
This nuanced discussion, however, is missing in the current public debate. To capture the readers' emotion and to generate support for proposed legislative and executive actions, the debate often oversimplifies the complicated picture by overexagerrating a particular aspect of the piracy problem or by offering an abbreviated, easy-to-understand, …

Implications Of The Precautionary Principle For Environmental Regulation In The United States: Examples From The Control Of Hazardous Air Pollutants In The 1990 Clean Air Act Amendments, Bernard D. Goldstein, Russellyn S. Carruth
Implications Of The Precautionary Principle For Environmental Regulation In The United States: Examples From The Control Of Hazardous Air Pollutants In The 1990 Clean Air Act Amendments, Bernard D. Goldstein, Russellyn S. Carruth
Law and Contemporary Problems
Goldstein and Carruth argue that the hazardous air pollutant provisions of the 1990 Clean Air Act Amendments provide an example of the Precautionary Principle incorporated into US environmental legislation. Evaluating the outcome thus far leads them to the conclusion that utilizing the Precautionary Principle as a basis for legislation can be problematic to public-health goals.

College Students And Problematic Drinking: A Review Of The Literature, Lindsay S. Ham, Debra A. Hope
College Students And Problematic Drinking: A Review Of The Literature, Lindsay S. Ham, Debra A. Hope
Department of Psychology: Faculty Publications
Problem drinking during the college years is a significant public health concern. The goal of the current review was to examine the primary psychosocial factors that predict problem drinking in college students. Variables examined included demographic variables, personality, drinking history, alcohol expectancies, drinking motives, stress and coping, activity involvement, and peer and family influence. Evidence from studies of college drinking indicated that the variables associated with college drinking seem to vary at levels dealing with one’s personality and coping mechanisms, one’s thought processes about drinking, and the environment. It seems that expectancies and drinking motives may serve as explanations for …

Predicting Fish Species Diversity In Lotic Freshwaters Of Greece, Eugene G. Maurakis, David V. Grimes
Predicting Fish Species Diversity In Lotic Freshwaters Of Greece, Eugene G. Maurakis, David V. Grimes
Virginia Journal of Science
Objectives were to test the hypothesis that stream order and stream width alone account for species diversity in drainages of Greece, and to create a mathematical model that predicts fish diversity in small and medium sized freshwater streams in the southern Balkan Peninsula in accord with the stream classification system proposed by the European Environmental Agency (EEA). Thirty-seven species of fishes in 12 families (Petromyzontidae, Anguillidae, Cyprinidae, Moronidae, Centrarchidae, and Blenniidae) were collected in five stream orders (1-5) from 19 river drainages in Greece in 1993 and from 2000-2002. Numbers of species were significantly correlated with stream order (+), width …

Grading The Government, Richard Parker
Grading The Government, Richard Parker
Faculty Articles and Papers
For over a decade, scathing critiques of government have been fueled by a group of studies called regulatory scorecards, which purport to show that the costs of many government regulations vastly outweigh their benefits. One widely-cited study by John Morrall, an OMB economist, claims that government regulations cost up to $72 billion per life saved. Another study, co-authored by Bush's regulatory czar, John Graham, claims that over 60,000 people lose their lives each year due to irrational government regulation. A third group of scorecards - compiled by Robert Hahn of the AEI-Brookings Joint Center for Regulatory Studies - claims that …
