Influences On Achievement In Literacy And Numeracy, Sheldon Rothman, Julie Mcmillan

LSAY Research Reports

This report examines the influence of a range of factors on the literacy and numeracy achievement levels of Year 9 students in Australia. The data were obtained from students in the first wave of LSAY and were analysed using hierarchical linear modelling to account for the sample design of LSAY. Modelling procedures followed a theoretical construct, incorporating variables believed to be important influences on achievement in literacy and numeracy. In addition, variables were selected to ensure consistency between cohorts and between literacy and numeracy. Included in the analyses were variables relating to students (gender, Indigenous background, language background, home location), …

Using factor analysis, the same two factors were identified for this study as the original standardization group for the PAM. Factor 1 for this study was defined by 17 items and was labeled Communication and Teamwork for Mothers. Factor 2 had 3 items and was labeled Feels Respected by the Other Parent. The Pernicious Effect Of Employment Relationships On The Law Of Contracts, Franklin G. Snyder Oct 2003

The Pernicious Effect Of Employment Relationships On The Law Of Contracts, Franklin G. Snyder

Texas Wesleyan Law Review

Using contract law to solve problems in a status relationship like employment has been as harmful to contract law as it has been to employment law. To make this point, Part II of this article begins with a brief discussion of both contract and employment law, specifically focusing on their origins, their relationship to each other, and the role of status in each. Part III examines three areas of contract law-consideration, capacity, and promissory estoppel-focusing on the influence that employment issues have had on contract law. Part IV concludes with a brief investigation of how courts continue to grab the …

Fatality Case Reports--Other

On June 19, 2003, a 58-year-old bulldozer owner/operator (decedent) died when he was thrown off the track of his bulldozer. The bulldozer owner/operator and a laborer were having difficulty starting the bulldozer. Together, the two men had tried several different methods to start the bulldozer including: spraying ether into the air chamber, having the battery recharged, replacing the battery cables with new ones and tightening wires to the starter. Do Physicians Examine Patients In Contact Isolation Less Frequently? A Brief Report, Sanjay Saint, Leigh Ann Higgins, Brahmajee K. Nallamothu, Carol Chenoweth Oct 2003

Do Physicians Examine Patients In Contact Isolation Less Frequently? A Brief Report, Sanjay Saint, Leigh Ann Higgins, Brahmajee K. Nallamothu, Carol Chenoweth

United States Department of Veterans Affairs: Publications

Background: Patients who are hospitalized and infected with multi drug-resistant bacteria are usually placed in contact isolation, which requires hospital personnel to gown and glove before patient examination. Contact isolation with active culture surveillance appears beneficial in preventing the spread of drug-resistant infections; however, contact isolation may impede the ability to examine patients as a result of the additional effort required to gown and glove. We assessed whether patients who are hospitalized and placed under contact precautions are examined less often by second- and third-year medical residents (ie, senior medical residents), and attending physicians during morning rounds.

Filling The Poverty Gap, Then And Now, James P. Ziliak Oct 2003

Filling The Poverty Gap, Then And Now, James P. Ziliak

University of Kentucky Center for Poverty Research Discussion Paper Series

The extent to which means-tested transfers, social insurance, and tax credits fill the gap between a family’s private resources and the poverty threshold is a periodic barometer of the social safety net. Using data on families from the Current Population Survey I examine how the level and composition of before- and after-tax and after-transfer poverty gaps changed in response to changes in the policy and economic landscapes over the past two decades. The estimates presented here indicate not only dramatic changes in the level and sources of income maintenance programs filling the poverty gap, but also dramatic changes in which …

Foreword: The Role Of Contract In The Modern Employment Relationship, Rachel Arnow-Richman Oct 2003

Foreword: The Role Of Contract In The Modern Employment Relationship, Rachel Arnow-Richman

Texas Wesleyan Law Review

To be sure, many questions about the relationship between contract and employment remain unanswered. The complexity of employment issues-the inherent tension between public regulation and private ordering, between legal agreements and moral obligations, between business interests and human need-will doubtlessly continue to challenge courts and legal scholars. The voices collected here offer a first step toward a richer understanding of the contractual dimension of employment and employment's influence on contracts in addressing some of the most pressing issues of the contemporary labor economy.

Opposing Excessive Use Of Employer Bargaining Power In Mandatory Arbitration Agreements Through Collective Employee Actions, Michael Z. Green Oct 2003

Opposing Excessive Use Of Employer Bargaining Power In Mandatory Arbitration Agreements Through Collective Employee Actions, Michael Z. Green

Texas Wesleyan Law Review

In this Article, I focus on how employees can respond and address excessive bargaining power issues when employers require individual employees to agree to arbitrate employment disputes as a condition of employment. My thesis is that individual employees can and should seek self-help through collective action to level the playing field for bargaining about arbitration. Furthermore, I contend that the best collective action would be for unions to play a major role in how individual employee disputes, including the various statutory and tortbased exceptions to the employment-at-will doctrine, are negotiated and resolved in arbitration. Section II of this Article reviews …

Attention All Students: Please Deposit Your Constitutional Rights At The Door, Emily Crockett

Texas Wesleyan Law Review

This Note argues that the Court should return to the fact-specific balancing test utilized in Vernonia and close the door to the further expansion of suspicionless drug testing in public schools. Part II of this Note will discuss the steady erosion of Fourth Amendment protections in the school context, as well as the expansion of drug testing outside the school setting. Part III will discuss the factual and procedural background of Pottawatomie and will focus on the Supreme Court's analysis and the dissent's application of the Vernonia standard to Pottawatomie's facts. Part IV will explore the problems and ramifications of …

Identification Of App1 As A Regulator Of Phagocytosis And Virulence Of Cryptococcus Neoformans, Chiara Luberto, Beatriz Martinez-Mariño, Daniel Taraskiewicz, Benjamin Bolaños, Pasquale Chitano, Dena L. Toffaletti, Gary M. Cox, John R. Perfect, Yusuf A. Hannun, Edward Balish, Maurizio Del Poeta

MUSC Faculty Journal Articles

Cryptococcus neoformans is a fungal pathogen that, after inhalation, can disseminate to the brain. Host alveolar macrophages (AMs) represent the first defense against the fungus. Once phagocytosed by AMs, fungal cells are killed by a concerted mechanism, involving the host-cellular response. If the cellular response is impaired, phagocytosis of the fungus may be detrimental for the host, since C. neoformans can grow within macrophages. Here, we identified a novel cryptococcal gene encoding antiphagocytic protein 1 (App1). App1 is a cryptococcal cytoplasmic protein that is secreted extracellularly and found in the serum of infected patients. App1 does not affect melanin production, …
